The pension fund shall be known as the “Borough of Dallas Road Department Employees Pension Fund * (hereinafter “Fund”). > This agreement shall cover all full- time Road Department employ- ees of the Borough of Dallas, hereinafter referred to as “mem- ber.” Every full-time Road Depart- ment employee employed by the Borough shall, upon the com- mencement of his employment, be a member covered under this agreement and entitled to the benefits provided hereunder. Section 3. Eligibility. Each Road Departmentemployee who is employed by this Borough on a full-time basis who shall have attained sixty-two (62) years of age shall retire (unless the Mayor and Council of this Borough or its designee shall elect by the appli- cation of uniform and consistent standards on a non-discrimina- tory basis to defer such retire- ment) and be entitled to receive pension or retirement benefits as hereinafter provided. Section 4. Retirement Benefits. The monthly pension benefit shall be equal to one percent (1.0%) of member during the last five (5) years of employment multiplied by the number of years of service completed by such member at his retirementdate. Such benefitshall be payable for the member's life- time with payments continuing upon the member's death to the member's surviving spouse equal to fifty percent (50%) of the pen- sion which such member was receiving at the time of death. Section 5. Vesting. If a member before attaining age sixty-two (62) and after having completed five (5) years of total service, for any reason ceases to be employed by the Borough, he shall be entitled to vest his retire- ment benefits until he attains age sixty-two (62) by filing with the Borough Council written notice of his intention to vest, within ninety (90) days of the date of his termi- nation. Upon attainment of age sixty-two (62) he shall be paid a partial retirement benefit. Such benefit shall be equal to one per- cent (1.0%) of the monthly aver- ‘age salary of such member during the last five (5) years of em- ployement multiplied by the num- ber of years of service completed by such member at the date of his termination. Section 6. Pre-Retirement Survivor's Pension Benefit. Upon the death of an active member who has completed five (5) years of total service at the time of death, the member's 'sur- viving spouse will receive a pen- sion equal to fifty percent (50%) of the pension which such active member had accrued at the time of death. Section 7. Disability Retirement. (a) A participant may, upon appli- cation, or upon application of one acting in his behalf, be retired by the Borough Council on a disabil- ity pension if the physician desig- nated by the Borough Council, themonthly average salary of such member made at the place of residence of the member or at a place mutually agreed upon, shall certify to the Borough Council that the member is unable to engage in any gainful employment and hat said member ought to be re- red. (b) The disability benefit shall be equal to one percent (1.0%) of the monthly average salary of such member during the last five (5) years of employment multiplied by the number of years of service completed by such member at his date of disability. Section 8. Members’ Contribu- tions. All members of the plan shall pay into the Plan Six hundred dollars (600.00) per year. Said payments shall be made by each member of the Plan annually for the first three years of employment under the plan. Section 9. Refund of Contribu- tions Upon termination of full-time employment before completion of five (5) years of service, a refund shall be made of any monies paid by such member, with interest. The rate shall be five percent (5.0%) per annum. Section 10. Creation and Mainte- nance of the Pension Fund. The Borough of Dallas Road Department Employees Pension Fund shall be created and main- tained in the following manner: (a) All funds on deposit and held for the pension or retirement benefits of the Borough of Dallas Road Departmentemployees shall be transferred to the Fund created hereby subject to any liabilities which may exist against such Fund. (b) The allocation by the Borough Council of payments made by the Treasurer of the Commonwealth from monies received from taxes paid upon premiums by foreign | after medical examination of the casualty insurance companies anc - % 1 foreign fire insurance companies pursuant to the General Municipal Pension System State Aid Pro- gram.
