Friends of Mom Jefferson Punishes [From thajiatriot Free Press 1 HISTORY REPEATING ITSELF -PERSECUTION Or DEMOCRATS 'UNDER, THE OLD SEDITION The preSent so-called Republican Ad ministration, which came into power on the plea that it was 'the party of freedom,' and was going to make this country be yond what it ever was before, the land of free soil, free speech and free men—has been guilty of doing, without authority of the Constitution and laws, acts against the liberty of speech and of the press, what the Federal Administration of John Ad ams did not dare to do except under the color of the old sedition law. The fol lowing historical facts in regard to the operations of the sedition act will be read. with interest: [From the Dayton (Ohio) Empire. 1 rThe sedition law proved something besides a scarecrow. We will bring to gether it few instances' of trials under it during Mr. Adame'aditfinistiation "Matthew Lyon,a'ineiAer of Congress, was selected as the •fitatl victim. He was an Irishman by birth-ra'roegh, energetic man, who did not tnipce.phrasee, and an extreme Democrat.' He was indicted for declaring in a letter, pnblished in a Ver mont paper that with the Federal Execu tive 'every consideration of thepublicjwel fare was swallowed up in a continual grasp of power, an unbounded thirst for ridicu lous pomp, foolish adulation and selfish avarice.' In regard to the 'fast day'—for the Federaliatasanctified all their outrages upon liberty and constitution by a fast day —he said that "the sacred name of relig ion bad been used as a State engine to make mankind hate and persecute one another. He was charged also with 'read• ing and commenting on' at a Democratic meeting, during The Congressional can vass, a private letter of Joel Burlow, written from France, saying that he was astonished that the answer of the house of Representatives to the President's speech had not been an order to send him to a mad-house.' This was his of fense . A seditious libel tending to bring the President and his Cabinet into disre pate I And for this he was tried before Judge Patterson, of the Supreme Court. Thejury found Limguilty, and the Judge, after a severe reprimand, sentenced .him to four months' imprisonment and a fine of one thousand dollars. A petition, signed by several thousand persons was sent to the President, asking Lyon's re lease from a narrow, uncomfortable, and, it was alleged, filthy cell ; but Mr. Adams refused, unless the prisoner signed the petition saying 'penitence before pardon.' Lyon declined to sign it and remained in prison. On the 4th of July, 1840, forty nine years afterwards, Congress refunded to Lyon's heirs the $l,OO with the inter est from February, 1797. Bat while in prison his friends made up a lottery scheme of his property to raise the amount of his fine; but seditious matter calculated to `bring the Administration into disrepute,' was found in the plan as published, and the printer was also convicted under the sedition law, fined $2OO and imprison ment two months. But the people re sented all these things, and while Lyon was lying in jail under the sentence, he was re-elected to Congress by a triumph ant majority—a significant hint of the popularjudgment of a law which would not permit a candidate for Congress, in canvassing his district, to speak of the political conduct of the President—which dragged a representative of the people in the highest legislative tribunal of the na tion before a judicial appointee of the President to be there brow-beaten, lectur ed, tiled as a felon, and condemned as a felon, for political language addressed to his own constituents. •`Charles Holt, another victim, publish er of the Bee, printed at New London, Connecticut, was found guilty of defaming tire President and discouraging enlist• ments in the army, and sentenced to three months imprisonment and also a flue of $2OO. .James T. Callender was tried for a libel on the President. His counsel rais ed the question of the constitutionality of the law; but Judge Chase refused to hear them, treating them with the utmost rudeness. They threw up their briefs and left' the Court. The defendant was sen tenced to nine months imprisonment and a fine of $2OO. "Judge Jared Peck, a senator in the Legislature of New York, a man of most exemplary personal character, had the audacity to offer to his neighbor.-ibr their signatures, a petition to Congress for the repeal of the alien and sedition laws in which the odious features of that law were seierely handled. Complaint was made to Harrison, United States District Attor ney of New York ; a Grand Jury was im pannelled who found a bill of indictment (Grand Juries are convenient things some. times in New York,) and Peck vas ar rested in the midst of his family aid taken to the city. The fearless victim, ve doubt not, at every stopping place, ater his usual custom, mingled prayers aid pious exhortations, with vehement poliical ap peals, before the assembled multiudes.— Sammond says: " 'A hundred missionaries in he cause of Democracy, stationed betwen New York and Cooperstown, could lot have done so much for the Democracy cause as the journey of Judge Peck, ai a priso ner, from Otsego to the capitl of the State. The matchless effrontery of this Duane merits the execution of the Alien Law; also, I `am very willing to try its strength upon him.'—lX Adams' Works, p. 36. "As to the number of convictions un der the law, Mr. Randall says : "'lt has been said that the victims of the sedition law were but few. We do not know the number. They were as3uredly few compared with the whole number of, our population. But they were numerous enough for the purposes of intimidation— numerous enough to show that a free criti oism of the acts of the Government, in ILuy class of persons, was uttered by the ; press or in conversation, at *the peril of property and personal liberty. They were numerous enough to give our Government practically, all that power over the people in political affairs which had been exer cised by the highest tory Administrations .during the long reign of George 111, and when the deadly struggle with republican Prance had produced a reactionary feeling against liberalism that was ready to sane tion almost any infringement on personal liberty. England at the present day would not tolerate any approach to those attacks on parliamentary privileges, and on the freedom of the press and of speehh, which were made by the American sedition law. 'The discreet, virtuous and able Princess, who now sits on the throne of England, would scorn to maintain Government measures or protect the Administration from censure, by an analogous action on the part of the legal tribunals of her realm.' "And yet the opponents of the present Administration would be rejoiced, if the instruments of arbitrary power in the year 1861, would content themselves with re sorting to the judicial tribunals of the land, instead of imitating the arbitrary rules of oriental despotism. Mr. Randall says " 'And When we look at the cases and decisions under our sedition law of I';'?:ts, we can not fail to become at once con• Tinned that its aim and intent was not to prevent or punish real sedition—actual open or secret machinations against our institutions and laws. Its manifest object was to shield the Federal Government from damaging censure ; to arm it with power to put down opposition ; in a word. to confer on it authority during its shorter personal tenure, about equivalent to that then possessed and exercised in political affairs by the Government of Great Britain ever the British realm.' "And yet the attempt utterly failed. Be fore this reckless and infatuated policy, the reaction came; Adams' Administra• tion went down, his party perished, and its name and its principles and its meas ures have been hated and execrated for now more than half a century.
