This seemed, to bus against Mr. Howard, became, as he bald, ever since 1792 the construction given by the courts to the clause on which he relied in the constitution had been in favor of holding the local court of Oyer & Terminer, even though the Supreme Court might be In session at the same time and in the statue county. In the case above quoted, Judge Tighlman had, in a private note to Judge Ilal towell given his opinion that the clause in the constitution meant to restrict the trial the local court, when at the same time and place the Supremo Court was sitting as a Court of Oyer & Terminer. - Mr. Howard remarked that it was singular how such a construction could be given In view of the express words of the constitution that "the Judges of the Court of Common Pleas shall not hold a court of Oyer & Terminer or general jail delivery while the Judges of the Supreme Court or any of them are sitting in the same county." At the lime of the trial of Jacoby, the Judges of the Supreme Court were in session in this county sod Were trying the civil list for this county. With these remarks he- left the point with the court. Mr. Howard then passed to the exceptions taken at the time of the trial. It is a rule of law that a party calling a witness, shall not ask him a leading question. The exhi bition of the article of clothing before it has been described, is itself a leading question.
