oner, who was In Court, :stated that As to the

On the first, be quoted`-let Ash. 28.1. Com.
vs. Gross. This seemed, to bus against Mr.
Howard, became, as he bald, ever since 1792
the construction given by the courts to the
clause on which he relied in the constitution had
been in favor of holding the local court of Oyer
& Terminer, even though the Supreme Court
might be In session at the same time and in the
statue county. In the case above quoted, Judge
Tighlman had, in a private note to Judge Ilal
towell given his opinion that the clause in the
constitution meant to restrict the trial the
local court, when at the same time and place the
Supremo Court was sitting as a Court of Oyer &
Terminer. -
Mr. Howard remarked that it was singular
how such a construction could be given In view
of the express words of the constitution that
"the Judges of the Court of Common Pleas shall
not hold a court of Oyer & Terminer or general
jail delivery while the Judges of the Supreme
Court or any of them are sitting in the same
county." At the lime of the trial of Jacoby, the
Judges of the Supreme Court were in session in
this county sod Were trying the civil list for
this county. With these remarks he- left the
point with the court.
Mr. Howard then passed to the exceptions
taken at the time of the trial. He had objected
on the trial to the clothing found on the dead
body previOns to a description from the witness.
It is a rule of law that a party calling a witness,
shall not ask him a leading question. The exhi
bition of the article of clothing before it has
been described, is itself a leading question. Af
ter the articles on' the identification of which
this case turned had been placed In the limb of
witnesses, the chance of the defence In cross
examination was gone.
Mr. Howard then referred to the questions
put by the Commonwealth to the matron of the
Orphans' Home. The question was—Are the
children of Christian Jacoby at the Orphans'
Home, etc. And in this it Is warned that they
were the children of Jacoby! To this point be
quoted Ist W. & S. 248; sth W. & 5.' 336.
The next objection was the handing of the
ear-ring to a witness and asking if ouch an or
nament was worn by Mrs. Jacoby. This was a
leading quaatlon.• The cue Is similar to that of
handing a letter to a witness when it is not al
lowed to read the letter until It is proved wire
it came from, and whether the witness knows
the signature,

the Claytanßulwer treaty. This resolution was at

eign Affairs.
Mr. Ititchie moved the resolution to lie on the
table, which was negatived by 90 against 93.
The resolution wt' referred to a Committee of the
Whole on:the State of the Union.
Mr. Bernheisol, the Utah delegate, offered a reso
lution; which was'adopted, instriteting the Commit
tee on Military' Affairs to enquireinto the expediency
of refunding to Utah the expenses incurred by said
Territory in suppressing Indian hostilities in 1853;
also Instructing the same committee to enquire into
the orpediericy of constructing a military road from
Bridger'epass to Salt take City. .
Mr. Stephens, of Ua., 'offered a resolution, which
was adopted, instructing the Committee On Military
Affairs to enquire into-the expediency of construct
tog a wagon road from Fort Arbuckle to Seatte, Pa
get's-,Souri, Territory of Washington; and for the
surrey of the Upper Missouri and Columbia Rivera
for•military purposes.

Among the witnesses were Mr. Sanford, collector of
the port; Mr. Smith, deputy collector; also General
Walker; Mr. Natsemer; Julius Ilene; and IVilliam
A. Smith. They were all rigorously examined. Oen.
Walker was before the jury about six hours and was
interrogated as to his life in California, Sonora and
Nicaragua. No bill had been found on Friday, when
the Court adjourned over till Monday.
Judge Campbell left for Washington tod ay. A
secret agent of the government, Mr. Wilson; of Ohio,
who had been sent here to watch the Nicaragua
