What did be do ? ',Here is the very point of • the ease. Did hit pay 'over the public' money when it was demanded! When the County An ditor made hie retort, the defendant had in MS' hands of the State funds $ 16 6,000. When the . Auditor-General nettled his aceount, there were due the State $BO,OOO. On the first of August last the balance was 6330,000. And 'there is, at this day, unpaid, upwirds of $30,000. In view of these facts I cannot say, and-I don't see how you licsn say, that he has paid. If be has not paid, be has failed 'to pay. If be has failediO pay and has given no legal excuse for his fait ore, then he is a defaulter. I say again, that • an excuse, to be worth anything, must be such': a one he will show that he could not keeplt. If it were burnt or stolen, or carried away by' ' his agente, whom he trusted, without ills knowl edge, it might do; but not if he was ignorant or careless, or allowed it to be invested injudicious- . ly. He must show that its loss was no fault of his. • Was there a demand made? Moot, be should not be convicted. He had a right to keep the money until it was demanded. Oa the first of July, the State Treasurer wrote the defendant a . letter, making a demand, in which he stated' that, unless the whole of the balance was paid by the first of August, he would proceed against him civilly and criminally. No payment was made as demanded. Oa the first of August, the State Treasurer came to Philadelphia, and urged the payment, without effect. Can It be said' that there was no demand. That the State Treasurer agreed .to take $20,000 in cash, and glee him 60 dkjs time to pay the balance, is of no importance in law, as a dented had been pre vionaly made. But the case does not stop here. He is charged with. investing a portion of the money for his own profit, sedinaning it to oth ers, with or without interest, If he had paid the money even when demanded; but in the at ter *, had lent it to others, it would be the same, under the law, as if be had not paid it at all. He admitted at the Batik that he could not real ize the money from his Investments. The Judge then reviewed the portion of the testimonylwhich bore upon this fact. The feet that the defendant bad invested $6,000 himself, was explicitly admitted. That Seisser and Christman had $52,000, was also admitted. It was not said in so many words, that defendant .. had loaned it to them ; • but bow, 'or on whit' terms did they get it? If he permitted them to ' have it with the understanding, express or Im plied, that it waa to be returned, it was borrow ing. If this was not the understanding, he meet have given It to them for nothing, or they must Lave stolen It. Neither of these views are rea 'Enable or consistent with the ether fasts. If you believe that defendant was a de fanner, or that he invested, or loaned the pub, lio money in his hands, then he is guilty on ell the counts of the indictment except the 14th and 16th. _ If you believe that he is a defaulter, but did . not invest or loan the money, you may find him guilty on the Ist, 2i and 7th counts, and not guilty on the others.
