SPecial Despatch to the Bulletin.] WASHINGTON, Feb. 20.—The Reconstruc tion Committee met to-day, and, after a short discussion, -instructed their chair man to report a concurrent resolution declaring that no Senators or Representa tives from the eleven Southern States should be admitted without the consent of Con gress. This is in direct antagonism to the views of the President, as enunciated in his veto message. It is thought now that Tennes see's chances for admittance are very slim The principal theme to-day of conVtrsa tion is the President's veto message. The friends of the bill in the Senate are confi dent of being able to carry it over the veto, Thee opposed are equally sanguine that it will be defeated. The vote will be very close, there not being two to spare on either side. The matter will be debated for several daYs. Trade with Canada: TORONTO, C. W., Feb. 20.—The Grand Trunk Railway Company has issued a cir cular notifying the agents that, in conse quence of the abrogation of the reciprocity treaty, they have decided in the meantime to give the preference to the shipments of all freights for the 'United States. SURIUDICE COITIZT AT Nest Pants—Chief Justice Woodward.—The Chief Justice this morning delivered the following important opinion: Waterman and Beaver vs. The Philadelphia and Reading Railroad Company, At Ind Prins. Case stated. The opinion of the Court was delivered by Woodward, Chief Justice. The con.stituttonslity of the 97th Section of the Act of Congress of June Seth, 1864, commonly called the "Excise law," being conceded, or rather not questioned, I am ofopinion that the con tract of the partiee, though mane - before' the law was passed, is within the pervlew of the 97th Section, and that the iron manufactured wider that contract 13 sub ject to the ecise dutie imsed by ih Act. By the Actof July 1, s 1862, r po ailroad ir e on was subject to a duty o f one dollar and et-half a ton and pig iron when used by the manufacturers in making rails, was, I suppose, exempted by virtue of the 781 section of that act, But by the act of '64 pig iron Is subject to ,a duty, two dollars per toniand the tax on railroad Iron Is raised to three dollars the ton, and one of the provisos of the 94th section (which is tne section that imposes these taxes) reads as follows: "provided that casting of iron and iron oral' descriptions, advanced beyond pig iron, blooms, slabs, or loups, upon which no duty has been assessed or paid In, the form of pig iron, blooms. slabs or loops shall be messed and pay in addition to the foregoing rates .of iron so advanced, a duly of three dollars per ton." The meaning of tills legislation Is_that pig iron shall pay aduty of two dollars the ton, tad that railroad iron manufactured out ofpig iron that has paid that duty, shall itself be assessed with three dollars the ton: but that railroad iron made of pig iron that has not been assessed, shall pay six dollars the ton. As there wait a large amount of pig iron on hand when the act of '64 was passed, whicn waa not lie ely to be returned for assessment, the Legislature -.probably meant by the proviso to tax it in the form_ ofralia, ant as an inducement to manufacturers of ratitt to return their pig iron for assessment, the proviso rnakesithe tax on rails something higher than it would be if duty were paid on the pig iron. The plaintiffs are reanafacturens both of pig iron and of railroad !SOD. They contracted with the de feat antes in February, 1564, to manafactnre and deliver 4,000 tons of rails, of which 1,662 15-614ths were by the terms of the contract to be delivered and were actually delivered after the first of July, 1864 , the date of the act of Cengreest in question. These rails were manu factured out of pig iron, which the plaintiffs also mautr lectured, but whether before or after the date of the law is not ascertained In the case elated. It Is admitted' however, that no duty had been paid on thapig-Iron ' that entered into these rails, and it ts earnestly argued that no duty was assessable under the act of '64, because this pig iron was neither sold nor consumed, or used by the manufacturers. Pig iron is undoubtedly an artiqe of commerce, and it is equally certain that it was not sold sepia-iron in this instance. But under the 94th section of the act it was taxable if " used by the manufacturer thereof." These are the very words of the enacting clause. And can it be doubted that a manufacturer uses his pig iron when he converts, or to uses statutory word"-ad vances" it, into railroad iron, and then sells the rails? Pigiron is never used without conversion or advance ment into some other form of iron. Such conVendon is indeed the only one of which it is susceptible, and 'I hold the plaintiffs 'used" their pig iron, within the meaning of rase statute when they made rails of it. his . conclusion. sufficiently supported by the words of the 94th section, is strongly corroborated by the End and 86th sections of the same act. Then it should have been returned for asses.ment and should have paid the prescribed duty of two dol lars the tor, but as no duty was assessed or paid upon it the rails manufactured out of it are within the terms of the proviso to the 94th section, and liable to "pay in addition to the foregoing rates of iron so advanced, a duty ofthree dollars per ton," that is the rails are sob j eat to a duty pf six dollars per ton. __ It was suggested that if the plaintiff, through neglect of a public duty, had subjected the defendants to a higher rate of taxation than was necessary, the plain tiff should bear the loss. However equitable this may be, I have no power under the case stated, to adjust the equity. lam only empowered to enter judgment for one of several fixed sums of money, according to the view I may take of the meaning of the several pin- Visions of the statute bearing on the subject. - Having endeavored to express very briefly my un derstanding of the statute on the particulars in quest ' lion, it is apparent that judgment must be entered for the largest sum mentioned in the case stated.
