The district court ruled that NBMA’s members qualified for the exemption because they were engaged in the production of agricultural products. However, the U.S. Court of appeals for the Fifth Circuit reversed that decision stating that farming means “either husbandry of animals or crops or farm ownership.” The U.S. Supreme Court on June 12 ruled that exemption from Sherman Act liability is not available to a cooperative poultry marketing association in which there is even a single member outside the orbit of protection provided by the Capper-Volstead Act. Justice Harry Blackmun, in issuing the ruling, said, “Clearly, Congress did not intent to extend the benefits of the (Capper-Volstead) Act to the processors and packers to whom farmers sold their goods, even when the relationship was such that the processor and packer bore a part of the risk.” Scott said, “The Capper- Volstead Act was enacted by Congress to allow farmers to join together in cooperatives, thereby bolstering their market strength and improving their ability to survive adverse economic periods. We are pleased that the Supreme Court recognizes the clear distinction between a fanner and an integrator who is not by definition a farmer.” In conclusion the Court said any NBMA member “who owns neither a breeder flock nor a hatchery and that maintains no grow-out facility at which the flocks to which it holds title are raised, is not among those Congress intended to protect by enacting the Capper- Volstead Act.”
