BE IT ENACTED AND ORDAINED by the Borough of Marietta, Lancaster County, Pennsylvania, and it is hereby enacted and ordained as tollows: SECTION I. That portion of Cherry Alley, a sixteen (16’) feet wide alley as des- cribed in more detail below, between the now existing properties of Marlin Mc- Connell and Paul Herr on the West and Jerrold Martin on the East, extending from the Northern edge of West Front Street to the Southern edge of Hazel Alley, as more fully described in Section II below, is hereby vacated, closed and removed from the Marietta Borough Street Plan. SECTION II. A more de- tailed description of the aforesaid sixteen (16°) feet wide alley is as follows: All that certain tract of land known as Cherry Alley in the Borough of Marietta, Lancaster County, Pennsyl- vania, more fully described as follows: Beginning at a point at the Northeast intersection of said Cherry Alley and West Front Street, thence ex- tending in a Northerly direction a distance of two hundred six (206°) feet, more or less, to a point on the Southern edge of West Hazel Street; thence ex- tending in a westerly direc- tion a distance of sixteen (16’) feet, more or less, to a point; thence extending in a Southerly direction a dis- tance of two hundred six (206°) feet along properties now or late of Paul Herr and Marlin McConnell to a point on the Northern edge of West Front Street; thence extending in an Easterly direction along the said Northern edge of West Front Street to the place of Beginning. SECTION III. Notwith- standing any other pro- visions of this Ordinance, the Borough of Marietta makes an express retention of a right-of-way through the aforesaid Cherry Alley for the purposes of drain- age. Said right-of-way shall include the right of ingress and egress by the Borough for maintenance and repairs to the existing storm sewer system. The Borough of Marietta further reserves the right to install a new storm sewer system through the aforesaid Cherry Alley if, at any time in the future, it deems it necessary and advisable to do so. After - entering upon the aforesaid Cherry Alley to exercise its rights under this reservation of right-of-way, the Borough agrees to return the alley to a condition approximating as nearly as possible the condition of the land prior to entry upon it by the afore- said Borough of Marietta.
