Ben Butler scholar to speak to CWRT The monthly meeting of the Wyoming Valley Civil War Round Table is set for Thursday, Dec. 16 at the American Legion building on Rt. 415in Dallas. MemorialHwy., Shavertown, PA y (675-1191) DISTRICT COURTBRIEFS Alleged cigar thief captured on store's video tape, twice James Davis, 22, of 58 Sheridan St., Wilkes-Barre, faces two charges of retail theft related to separate incidents four days apart. Davis allegedly stole a box of ci- gars valued at $198 from Cook's Pharmacy, Shavertown, on Sept. 25 and Sept. 29. According to witnesses testimony, Davis en- tered the store at about 2:30 p.m. Sept. 25, talked with a cashier while standing near the cigar case, then removed the cigars when she waited on a customer. A video tape of the incident showed Davis tucking the box under his shirt, then walking out. Davis returned to Cook's four days later, and was again caught on tape taking a box of cigars and concealing it under his shirt be- fore leaving. On Oct. 6, Davis was arrested for retail theft in Wilkes- Barre, and Kingston Twp. officers were able to positively identify Davis from that incident, and from a photo held by police in Kingston Borough. CRIMINAL MISCHIEF Lehman Twp. police have charged Lonny L. Walsh, 30, of RR 2, Box 115, Shickshinny, with criminal mischief. Chief Howard Kocher said in an affidavit of prob- able cause that Walsh vandalized a car, truck and trailer at Shelly's TruckingonRt. 118, and the home of Ann Marie Benoski in Sweet Valley. A witness said he and Walsh had gone to the Benoski home and vandalized the prop- erty, then went to Shelly's, where Walsh caused the damage. WOMAN FACES ASSAULT, DISORDERLY CHARGES Kingston Township police charged Shelly Volinsky, 38, of 63 W. Mt. Airy Rd., Shavertown, with multiple offenses as the result of an incident Nov. 17. Officers Franklin Buckler and Martin Maransky responded to a call at Volinsky's residence regarding a possible drug overdose. When they arrived a relative said Volinsky was unconscious on a couch in- side. When the officers entered the home Volinsky had been awak- ened by her boyfriend. Her father and stepmother soon arrived and Buckler said Volinsky attacked the woman, then him and he was forced to restrain her with hand- cuffs. She was placed in the back seat of a patrol car, but was soon seen lying on her back and kick- ing arear passenger window, even- tually breaking it, Maransky said in an affidavit of probable cause. Volinsky was transferred to a dif- ferent car, but continued to kick and scream, requiring Buckler to sit with her as she was trans- ported to the police station. Volinsky will face a charge of simple assault, two counts of ha- rassment, three counts of disor- derly conduct and one each of resisting arrest and criminal mis- chief. Hines, 33, of 635 Main Rd., Dallas, arrested at about 3 a.m. Sept. 11 by Dallas Twp. police officer Jeffrey Dennis after Dennis saw a car driven by Hines driving erratically south on Rt. 309. When Dennis attempted to stop the car, Hines pulled into his own driveway. Dennis said Hines appeared to be intoxicated and smelled strongly of marijuana. A marijuana pipe and fresh mari- juana were found in his pocket, Dennis testified. Hines failed field sobriety tests and a portable breathalyzer test measured .167 percent. He refused a blood alco- hol test, which normally results in loss of driver's license for one year, but Hines said his license was already suspended. He did submit to a urine test. Hines will face charges of DUI, possession of marijuana and marijuana para- phernalia, failing to keep right and disregarding a traffic lane * Russell Bellas, 47, of 200-44 Harris Hill Rd., Shavertown, ar- rested by Kingston Twp. police officer Charles Rauschkolb at a DUI checkpoint Sept. 24. Bellas failed field sobriety tests and a test of his blood alcohol measured .126 percent. e Karen Zearfoss, 40, of 624 Hanover Village, Wilkes-Barre, arrested Sept. 5 by Dallas Bor- ough officer James Martin, who saw a car driven by Zearfoss driv- ing erratically south on Rt. 309. When Martin followed the car, he said it was weaving across lanes, with the driver putting the brakes on and off. Martin said he acti- vated his lights and siren but the car did not stop, and he saw a passenger throw items out the window. The car finally stopped in the middle of the driving lane at the intersection of Rt. 309 and Carverton Rd. A portable breath test measured Zearfoss’s blood alcohol level at .231 percent, and she failed field sobriety tests. A later blood test at Wilkes-Barre Memorial Hospital measured .233 percent, more than twice the legal limit. e Thomas L. Feeney testified that he saw a maroon Ford Thunderbirg “ in the roadway on Lower Demunds' Rd. at about 3:40 p.m. Grassand | weeds were stuck in the rims of the tires on the driver's side, and when the car began to move, driv- ing on the shoulder and nearly striking a bridge abutment. Feeney said he turned on his lights and siren as the car turned onto Ransom Rd., and that it weaved across lanes before stopping at Ryman Rd. Feeney said Schulze appeared to be intoxicated, bull) « said he was taking prescription painkillers. Feeney asked Schulze to take a breathalyzer test, but Schulze refused. He was taken to Wilkes-Barre General Hospital for a blood test, but refused that as well. It was learned later that Schulze’s license was under sus- pension for previous DUI inci- dent. Oo “ * Clarence Hopkins, 49, of RR 2, Box 120A, Hunlock Creek, ar- rested the night of Aug. 19 by Lehman Twp. police officer David Fitch, who was called to a one-car accident on Rt. 29. Fitch testified that when he arrived on the scene he saw Hopkins get out of the car and fall down. A breath test mea- sured his blood alcohol at .214 percent, more than twice the legal limit. Bl 4 ‘e Charlotte N. May, 36, of RR5, Box 386, Tunkhannock, arrested May 10 by James Karlowicz of the Jackson Twp. Police Dept. Karlowicz testified that he saw a car driven by May run a stop sign at Huntsville Corners. He followed the car, which was weaving across the traffic lanes, and stopped it § near the police station on Hunts (5 ville Rd. May at first told Karlowicz =~ her name was Caprice Miletta and had left her driver's license home, he said. A breath test measured her blood alcohol at .261 percent. * Raymond Kupris, 42, of 487 Bennet St., Luzerne, arrested by Lehman Twp. police officer David Fitch Aug. 21. Fitch testified that when he attempted to stop a pickup truck Kupris was driving, he ignored the officers lights and} , | siren, and Fitch had to eventually pass the pickup in order to stop it. A blood alcohol test measured .18 percent. * Timothy S. Steltz, 24, of 110 Old Wilkes-Barre Blvd., Wilkes- Barre, arrested at a DUI check- point Sept. 25 by Dallas Borough police officer James Drury.
