2 The Dallas Post Dallas, PA Wednesday, August 13, 1997 a he DISTRICT COURT BRIEFS Charged with endangering child Mansfield resident Dannie Gardner, 42, was arrested on June 15 by Dallas Township pa- trolman Douglas Higgins after police were called to the Turkey Hill at the intersection of Rt. 415 and Rt. 118. Gardner was sitting on two milk cartons inside the convenience store holding his son. When police arrived he asked them - for adoctor and a new camera and told them he did not want the state’ police to come near him because he believed they put an electronic bug in his son's ear. Gardner would shift between a violent and a calm mood. He would hold his son tightly, squeez- ing him around the neck and then let him go and talk to police in a calm manner, according to police. Gardner told police that he was in a domestic dispute with his ex- wife, who has custody of their five-year-old son. Information from the Mansfield police depart- ment confirmed his story and said they were in the process of obtain- ing warrants for Gardner. The defendant resisted arrest and after police -applied hand- cuffs they took him to the Wilkes- Barre General Hospital to be ex- amined. Gardner's son was sepa- rately taken to the hospital to be examined. Gardner was charged with reck- lessly endangering another per- son, harrassment, criminal mis- chief, endangering the welfare of a child, resisting arrest and disor- derly conduct. ‘The following people waived their right to a preliminary hear- ing before District Justice James Tupper on August 7: .D.U.I. CHARGES _» Wilkes-Barre resident Michael .D. Hivish, 20, who was arrested on May 30 after Dallas Township patrolman Jeffrey Dennis saw his vehicle weave between lanes on Rt. 309. After failing field sobriety tests, Hivish was taken to Wilkes- Barre General Hospital where his blood alcohol level was determined to be .198, twice the legal limit. e New Jersey resident John Payavis Jr., 30, who was arrested on March 28 after Kingston Town- ship patrolman James Ibbotson saw his vehicle weave between lanes on Rt. 309. After failing field sobriety tests, Payavis was taken to Wilkes-Barre General Hospital where his blood alcohol level was determined to be .128. RECEIVING STOLEN PROPERTY Wilkes-Barre resident Richard Anthony White Jr., 20, was ar- rested on July 4 after Dallas Bor- ough patrolman James Drury observed he was driving a Cor- vette with expired plates. After calling in the plate number, police were informed that the car was reported stolen three days earlier. The car belonged to a dealership in Lower Merion Township. White told police the car was give to him by a man from Harveys Lake. He is charged with receiving stolen property, driving without a license and driving an unregis- tered vehicle. Maransky ob- served him speeding and driving erratically on Carverton Rd. and Bunker Hill Rd. Mullen drove at high speeds refusing to stop for police signals until his vehicle hit a tree on Bunker Hill Rd. He was taken by ambulance to the Wilkes- Barre General Hospital where his blood alcohol level was found to be .135. He was charged with driving under the influence of alcohol and fleeing or attempting to elude of- ficers. RESISTING ARREST Edwardsville resident Edward W. Gallagher, 22, was arrested July 29 by Kingston Township patrolman Frank Ziegler after police were called to domestic dis- pute on Meadowcrest. A back- ground check showed that Gallagher was wanted for not ap- pearing in court. After the police informed Gallagher of this he ran out the back door of the Meadowcrest resi- dence into the woods. Police caught up with him and stopped him. Gallagher bit one officer's finger and resisted arrest, accord- ing to police reports. He contin- ued to bang his head on the plexi- glass window inside the car. He was charged with resisting arrest and simple assault. HARASSMENT Scranton resident, Thomas John Davis, 27, was arrested July 26 by Harveys Lake patrolman James Karlowicz after police re- sponded to a fight at Desi’s Sports Bar. Davis continually interfered with the investigation, police said. He was repeatedly told to leave the area and did not do so. He was charged with harass- ment and public drunkenness.
