Dr. Roger Landry, who lives near the township property thatis home to the proposed Cellular One tower, will take the opportunity to ap- peal a zoning permit issued by Leonard Kozick, zoning officer. If Landry wins the appeal, Cel- lular One’s permit will be revoked and the company will have to seek a variance from the zoning / board. But if Landry loses the appeal, Cellular One could begin construction. ; Landry said if he loses Aug. 11 he will appeal the decision to a higher court and if a higher court reversed the decision, Cellular One would be forced to tear down any portion of the tower that had been built. Cellular One first approached the township about the cellular tower at a public meeting in early March. The plan is to build a 280- foot tri-legged tower directly be- hind the municipal building on Dallas Township property. A 12 by 20 foot unmanned equipment shed is to be erected next to the tower. i The company agreed to pay the township S800 a month to lease the property for the tower. Cellu- lar One would also allow the town- ship to use the tower without cost to the township for policeand 911 antennas. Cellular One feels the tower is necessary to cover gaps in the cellular system in the Back Moun- tain. Cellular One has approxi- mately 2,500 Back Mountain cus- tomers, explained Rich Rusnok, Real Estate Specialist for the com- pany. With gaps in coverage, cel- lular customers have trouble us- ing their phones. Rusnok feels this not only inconveniences cus- tomers, but could also prove to be a safety hazard. “We have seen a tremendousincreasein 911 calls,” Rusnok said. This is not the only tower planned for the Back Mountain. Andy Hustey, vice president of Mericle Commercial Realty, said there's an “85 percent likelihood” the deal will go through. The poten- tial buyer is already offering ware- house space, and Hustey said he has plans to develop the property into a Rd. and Rt. 309. : Dallas Township residents are not convinced the large tower is necessary. After hearing about Cellular One’s courtship of Dallas Township, several residents at- tended the March 18 supervisors meeting to voice concern about the structure. Landry feels the tower would be an eyesore and would probably harm property values. Fox Hollow resident Bob Nause agrees with Landry. “It will be visible from one of the main thoroughfares,” Nause said at the March 18 meeting. Bernard Banks from American Asphalt had questions about the township’s handling of public records.
