The lot's owner — whether it is the McAvoys or someone who buys the lot from them — will be respon- sible for mowing the grass around the pond, the only maintenance work required, Marsh said. - If someone wants to buy the lot to build on, it is large enough to also accommodate a house, well and septic unit, he added. - The commission agreed to ap- prove a bank letter of credit for $96,000 as insurance that Abby Road would be completed accord- ing to the engineer's specifica- tions. “The letter of credit is essen- tially insurance - the cost of build- ing theroad based on a worst case scenario,” explained commission solicitor Charles McCormick. “If the developerdoesn’t complete the road as specified by June, 1997, the township will get the money and finish the work."- The letter of credit protects the township from another situation similar to Crown Hill, in which the developer laid out the roads and said he would build them, then defaulted and allowed the roads to be taken for back taxes by Luzerne County, commission members said. Acceptance of the final Chadsford subdivision plan is subject to McCormick's approval of the letter of credit. Inother business, the commis- sion unanimously approved the Tom Liese major subdivision pre- liminary plan. No action was taken on John Giambra's Bella Mundana major subdivision, be- cause approval is also pending in Exeter Township, and on Willard Bullock's Tall Pines major subdi- vision because the developer plans to supply complete answers to the engineer's review at the February meeting. The planning commission will hold a work session before its February meeting to discuss spe- cial ordinances concerning mo- bile home parks and junk or aban- doned vehicles. Woman guilty of conduct charge after assault on elderly mother Edwardsville resident Judi Marie Ejsmont, 30, pled guilty to a-charge of disorderly conduct at a. preliminary hearing Jan. 21 before District Magistrate James Tupper. _- Related charges of simple as- sault and disorderly conduct were dismissed, according to court records. The charges stemmed from an incident Jan. 20 at the Meadowcrest home of Ejsmont’s mother, Mary Ejsmont, in which the police responding to a com- plaint about a domestic incident found the defendant in her mother's kitchen, cursing, ‘screaming and throwing cans and jars. Mrs. Ejsmont told police her daughter had started an argu- ment, thrown a vacuum cleaner at her and slapped her in the head and body. The vacuum cleaner hit Mrs. Ejsmont in the left leg. | 2 FORGERY CHARGES SENT TO COUNTY .' Pittston resident John R. Allardyce, 21, waived his right to ‘a preliminary hearing Jan. 25 before District Justice James Tupper on charges of forgery, pass- ing bad checks, receiving stolen property and theft by unlawful taking. i The charges stemmed from an incident Nov. 4, in which he alleg- edly took $10 in cash, four credit cards and three blank checks from purse belonging to 'unkhannock resident Ainsley Patton, who had left them on a table in a classroom at College Misericordia. Allardyce admitted to police that he took the items, cashed the three checks for $250 apiece and used the credit cards to make purchases at Boscov's, WalMart and the Wyoming Valley Mall. Represented by attorney Jo- 'seph Blazosek, Allardyce is free lon $300 bail. Police arrested the defendant after she continued to curse at them. After police took her to the station, they called the ambu- lance because the defendant said she had just given birth. While being processed at the Wilkes- Barre General Hospital, the de- fendant dug her fingernails into Officer Wade Curtis's right wrist and thumb, making several small cuts. She refused treatment at the hospital and was taken back to the Kingston Township police sta- tion. During the entire incident she continued to scream obsceni- ties at police and call them rude names. Represented by public defender Leonard Omolecki, Judi Marie Ejsmont is free on $5,000 bail. Officer Wade Curtis was as- sisted by officer Charles Rauschkolb. TWO WILL BE TRIED FOR S.C.L.D. DRUG INCIDENTS An inmate at the State Correc- tional Institution at Dallas and a visitor to the prison waived their rights to preliminary hearings before District Justice James Tupper on drug charges. Inmate Dominick Sullen was charged with conspiracy to de- liver a controlled substance. He was arrested by trooper Dale Cul- ver after a female visitor gave him four half-ounce bags of marijuana, which he was supposed to pass on to another inmate. Sullen was represented by at- torney Demetrius Fannick. Cheltenham resident Patricia McGinnis was charged with pos- session of drug paraphernalia and possession of a controlled sub- stance. She was arrested by trooper Michael Carroll after prison guards saw her pass a balloon containing 39 Valium pills to inmate James Connolley. Represented by attorney Harold Kane, she is free on $3,500 bail. D.U.I. CHARGES SENT TO COUNTY COURT The following D.U.I. cases were sent to Luzerne County court af- ter preliminary hearings Jan. 25 before district Justice James Tupper: e Forty Fort resident William Stasik, 45, who was arrested Nov. 30 by Kingston Township officer Frank Buckler after failing field sobriety tests. A blood test showed his blood alcohol level to be .16. The legal limit is .10. e Lehman resident George Nichols, 77, whowas arrested Nov. 25 by Lehman Township patrol- man William Purcell after being involved in a caraccidenton Route 118. A blood alcohol test showed his blood alcohol level to be .191, nearly twice the legal limit. e Luzerne resident David Bar- ber, 40, who was arrested Nov. 25 by Kingston Township patrolman James Ibbotson after police ob- served him driving erratically on Pioneer Ave. and failing field so- briety tests. A blood test showed his blood alcohol level to be .167. e Shavertown resident Bryan Emershaw, 41, was arrested Nov. 19 by Dallas Township patrolman Brian Feeney after running his car off the roadway and into the snow on Jakemoore Road and failing field sobriety tests. Accord- ing to a blood test, his blood alco- hol level was .261, more than twice the legal limit. e Dallas Township resident Ja- son Hall, 21, was arrested Dec. 3 by Dallas Township Doug Higgins after being involved in a one-car accident on Lower Demunds Road at the Ransom Road intersection. A blood test showed his blood alcohol level tobe .18, nearly twice the legal limit. » Harveys Lake resident Kathy Conrad, 42, was arrested Nov. 5 by Harveys Lake patrolman Mark Karlonis. She was also cited for not signing her driver's license, driving without her eyeglasses, not changing the address on her driver's license and not using her seat belt. Related felony assault charges were dismissed, according to court records. The charges resulted from an incident Jan. 11, in which Burns fought with Kingston Township officers when they arrested him at the Kandle-Lite lounge on Carverton Road. Officer Michael Maransky required stitches for cuts on his upper lip and above his left eye. Officer Frank Buckler was cut on his left middle finger. Represented by attorney Bruce Anders, Burns is lodged in the Luzerne County Prison in default of $50,000 bail. DISORDERLY CONDUCT ADVANCE TO COURT Exeter resident Michael Kozloski waived his right to a pre- liminary hearing Jan. 25 on charges of disorderly conduct, harrassment and resisting arrest before District Justice James Tupper. Related charges of simple as- sault and aggravated assault were dismissed, according to court records. The charges stemmed from an incident Dec. 13, inwhich Kozloski was involved in a one-vehicle ac- cident in Franklin Township, run- ning his car off the roadway. After Kozloski failed field sobri- ety tests, he refused to allow po- lice to place him in handcuffs, refused to get into the cruiser, kicked the radio inside the cruiser and began hitting his forehead against the cruiser’s side window.
