CITED FOR BRAVERY - Kingston Township Police officers Michael Moravec and Charles Rauschkolb were given commendations along with Frances Slocum lifeguard Michael Sabatini for their efforts in trying to save the life of an Inkerman woman who drove her car into Slocum Lake in August. (Post Photo/Rich Johnson) By RICH JOHNSON Staff Writer The Kingston Township Super- visors cited “spot zoning” in deny- ing a proposed rezoning of land along Harris Hill Road last week. A public hearing, held during the regular monthly meeting of the board, was for the proposed rezon- ing of 1.6 acres of land on Harris Hill Road from an A-1 (agricul- tural) to a B-1 (Commercial). ~ The application for the rezoning was made by Jack Moreck and Michael Molitores. Moreck wanted the land rezoned so he could put a commercial office on the property. However, area residents ex- pressed concern about allowing a business in a residential area and said that the rezoning would con- stitute spot zoning. Municipalities generally do not allow spot zoning, which is arbitrarily taking a piece ofland in the midst of one zone and making that piece of land another zone. Moreck, his wife and his attor- ney provided testimony on why the rezoning should be allowed. Two families spoke against the proposal. According to Moreck, he wanted to make an office building for his building and development com- pany by converting an old barn on the property into an office and storage area. ™ Moreck said that the land around the area was not limited to residential oragricultural. He noted a swimming club and a trailer park in that area are zoned something other than agricultural. “Putting a B-1 there with all the other zones would not constitute spot zoning,” said Moreck. He added that his business would help the area and would not cause a hazard to neighbors. The neighbors disagreed. John Turner argued that extra traffic and equipment for Moreck’s busi- ness would add to risks for chil- dren in the area. Township zoning officer Ben Gorey said that the planning commission recommended that the board deny the application. The commission felt that approving the proposal would constitute spot zoning. ; Township solicitor Ben Jones III told the supervisors that when making a decision they should, “...consider how it fits in with the comprehensive plan of the town- ship.” Jones said that he was not sure about spot zoning in this case. “Spot zoning is a close call,” said Jones. “I could go either way when it comes to this case.” He said that he felt the compre- hensive plan of the township showed that the'proposed area on Harris HillRoad was “...generally'a conservation district,” and toldthe supervisors: they would have to make the decision. Supervisor Donald Gavigan made the motion to deny the appli- cation and it was seconded by Herbert Hill. The board voted unanimously to deny it, citing concerns over spot zoning. Rezoning denied in K Iingston Twp. Moreck said after the decision that there is still a problem in that area and he hoped the board would look at it in the future. “We are still stuck with 1.6 acres of land that needs a use,” said Moreck. “This could have been an answer." He added that in making the application he had the best inter- est of the neighborhood in mind and added, “We will be faced with a bigger problem down the road.” Moreck has also made an appli- cation to the planning commission to have 30 acres of land around the barn rezoned. Whether or not this will take care of the spot zoning concern is an issue that the plan- ning commission and the supervi- sors may have to address in the near future. “It would be a detriment to allow it (the barn) to deteriorate more,” Moreck told the supervisors. “Let's get it back on the tax rolls and let it be a benefit to the community.” In other business at the meet- ing, the board: eApproved three ordinances on first reading in which the township would assume ownership of roads in the Somerfields subdivision, the Cedar Lane Phase II subdivision, ‘and the Woodridge II Phase II subdivision. eAppointed Donald Fritzges to the newly created position of as- sistant road superintendent at an annual salary of $22,295. eAppointed Edward Price Jr. and Randall Glidden to the planning . commission. i Attention: Three Women I am trying to locate the three women that were on the Martz Bus, 7:30 AM. to New York City, Thursday, October 11, 1990. | | I gave my newspaper and a packet of wipes to the woman sittng - behind me. Borough officials have taken action against Laurie Danielle of Walnut Street for not having her home connected to the sewer system. A hearing was scheduled last week before District Justice Earl Gregory on the matter but the case was continued for 30 days to allow Danielle more time to hook up to the system. Gregory said that Danielle had. to comply with a borough ordi- nance that requires her to be con- nected to the sewer system. He said if she did not comply with the ordinance within the 30 days she would be fined for every day she is not connected.
