The Opluton of Judge Savltlge lu an Im portant Damage vase. The decision of Judge Savldge, of North umberland county, in disposing of the suit for damages, Griffiths vs. Girard Coal Com pany, is worthy of reproduction bore. In substance bis decision is that if the traveling ways were improperly constructed and unsafe, and did not comply witb the re quirements of the Act of 1897, the Qlrard Coal' Company is not responsible or liable for damages, because by this act the mine in spector, who is a state officer, is required to seo that tho provisions are complied with and the operator is required to employ a mine foreman who must receive certificates of capability from the state and who aro placed in charge of the mine workings which are under their control, anil consequently plaintiff couldn't recover any damages from tho mine owner. lie therefore took tbe case out of the jury's bands and directed a ver dict for tho defendant. In other words, in tbe event of an accident, the company is not responsible if they employ a mine foreman who is capable This leaves no remedy for the miner's widow. She can not bring suit against tbe inspector, for he is a state otliccr, She can not sue the mine foreman, for what damages could she recover? This opinion is of tbe groatost moment to the miners and the course of tbe suit in the Supreme Court, where it will be taken, will be watched with great interest.
