Mayer Gold smith, tho commonwealth's expert ac countant, was on tho stand all day yesterday In tho trial of Senator Quay, making statements of fact that are ap parently damaging to the defendant s sldo of the caae. Goldsmith Is tho main witness for the prosecution nnd it Is through him that all of the docu mentary ovldonco is to bo presented. This witness has examined the bank's books thoroughly and he came Into court yesterday with a number of typewritten sheets containing figures that he gathered from the various books, relating mainly to tho deposit of the state treasurer and tlie account of Senator Quay. He swore to the cor rectness of his work nnd then the dis trict attorney formally offered the paper in evidence. This was objected to by tho defenso on tho ground that such a paper Is not testimony. It was In sisted that tho books thomsolvesshould bo placed before the witness and his statements uttered from what ho saw entered in them. Tho Judge decided In favor of the defenso. Although the defense apparently gained this point, the paper was prac tically In evidence, wltnoss Goldsmith using its contents In framing his an swers to tne district attorney s ques tions. When the Quay lawyers ob jected to this they were met by the Judge's explanation that whllo the paper could not be used as sworn evi dence, the witness might use It to re fresh his momory. Ono effect of all this was to make certain that tho case will now go to tho Jury, thero having been some doubt on this point up to tho decision to admit all that Goldsmith might havo to say. Just before the close of tho day s proceedings there was another ruling by Judge Diddle In favor of the de fense which may have an important bearing on the future of the case. The statute of limitations has been pleaded again and again by Senator Quay s lawyers as a bar to much of tho testi mony presented by tho commonwealth. As Sir. Quay was Indicted on Nov. 17, 1838, the two years allowed by tne statute for prosecution would extend back only to Nov. 17, 189G. On this basis Mr. watson has frenuently urged Judge Blddle to exclude men tion of transactions dating back to 1886, when Mr. Quay was state treas urer. Tho court has uniformly held, in effect, that the statute of limitations does not affect the evidence but docs affect the crime. Tho district attorney pointed out that he alleges the defendant's guilt during tho two years tho law confines him to, and to prove this tho corro borative evidence of the previous years should certainly be admitted. Judge Blddle decided against the com monwealth. He ruled that tho evi dence should be confined to tho con spiracy alleged and not to some other conspiracy. It Is interesting to note that there was every Indication that the Judco was about to rule against Mr. Quay wnen Mr, Watson got In another little speech, begging the court to consider tho point that tho prosecution has so far failed to show a specific conspiracy, and this should bo done before It went into tho general question of conspir acy. The Judge took this view, and ruioa accordingly. The lawyers for the defense claim that tho decision practically rules out tho figures prior to Nov. 17, 1896. Mr. Rothermel says Its effect will bo to prevent him from offering much of tho evidence ho hoped to present. All day long Mr. Goldsmith read out figures taken from the banlc books. embracing the various settlement pe riods of six months, each dating back to Oct. 31, 1893, showing tho amount of the stato deposit, tho amount loan ed to Senator Quay during each six months, tho amount of Interest allow ed the state treasurer for that portion of the state deposit apparently not set aside for Senator Quay's use, the amount of interest, if any, the senator paid on his loans, and the amount of money used to purchase stock for him, Tho doposlt during the years men tioned ranged from $1,200,000 to $400.- 000. Senator Quay's loans were shown to be as great as $860,000 in one pe riod of six months. Occasionally, tho witness said, small and inadequate payments of interest by Senator Quay were snown, nut generally there was nothing to Indicate that ho paid for the use of the bank's money. While all these figures wero going In counsel for Sonator Quay sat silent and motionless, listening to the monotonous routine of question and answer. This was In pursuance to an understanding that the defense ob jected to every answer, that the ob jection was overruled and an exception noted. This Is lor future uso In a higher court, if necessary. Once Mr. Shields felt constrained to enter an earnest protest against a witness be ing permitted to placo a man's liberty In Jeopardy by making such mon strous statements, based merely on conjecture. There is no doubt that nearly all of the export's deductions and figures were obtained from the "red book." about which so much has been said, and against the introduction of which the Quay counsel made such vehement but unavailing objection.
