SECTION I. Be it enacted and ordained by the Town Council of the Borough of Sal- isbury, County of Somerset and State of Pennsylvania, in Council assembled, and it is hereby enacted and ordained by the au- thority of the same, that from and after the passage of this Ordinance, the Pennsylvania & Maryland Street Railway Company, a corporation duly organized and incorpor- ated under the laws of the State of Penn- sylvania, its successors and assigns, is here- by granted the right, liberty and privilege to erect, construct, maintain and operate a single track electric railway in, through, over and upon the following streets and highways of said Borough,;viz: Beginning at the Borough line of Grant Street on the north side of the Borough, thence along Grant Street on the east side thereof, at a distance from the curb as the Burgess and Town Council may determine, to the inter- section of Grant Street and Ord Street. Sec. II. This is not an exclusive grant, but shall extend to and be valid for a period of fifty years from the date of its passage, Tinless revoked by the failure of the said Pennsylvania & Maryland Street Railway Company or its assigns to comply with or carry out each or any of the provisions and conditions ofthis ordinance, and it is given under the following conditions and restric- tions. SEC. III. That the said track shall be what is known as the standard gauge of four feet eight and one-half inches in width, and shall be laid on the east side of the said Grant Street, at a distance from the curb as shall be determined by the Burgess and Town Council af the said Borough, unless otherwise directed and empowered by the said Borough of Salisbury, as herein after provided. That when the said Pennsylvania & Maryland Street Railway Company shall be furnished with a grade by the said Bor- ough of Salisbury, the said Railway Com- pany shall immediately change or alter their grade to conform with the grade thus furnished, and that no change or alteration in such grade or grades shall be made at any time, except under the special direction and supervision of the said Borough of Sal- isbury, and then only upon proper resolu- tions or ordinances for the specific purpose duly enacted; that in laying, repairing and sustaining their tracks,the said Pennsylva- nia & Maryland Street Railway Company shall strictly conform with such grade or grades, whenever so requested and required by the said Borough of Salisbury, and that in every such event the said Pennsylvania & Maryland Street Railway Company shall fix, adjust, lay, raise or depress its tracks, so as to strictly conform with the grade or grades thus changed or altered as afore- said. Sec. IV. The said Pennsylvania & Mary- land Street Railway Company shall also, at its own proper cost and expense, construct and reconstruct the roadbed between the rails and eighteen inches on the outside of each and all the rails of She said railway, with such materials as are now used upon the saidistreets and highways, in such man- ner as shall be described and required by the said Borough of Salisbury. And if at any time bereajter the said Borough of Sal- isbury shall by proper ordinance determine and resolve to pave, and pave that part of said Grant Street along which the said track of the Pennsylvania & Maryland Street Railway Compary is constructed, and if at the same time the said Borough of Salisbury shall require by proper ordinance the said Pennsylvania & Maryland Street Railway Company to move its tracks to the center of said Grant Street, then and in that event the said Pennsylvania & Mary- land Street Railway Company shall at once move its tracks to the center of said Grant street, and shall also pay to the Borough of Salisbury the sum of Seven Hundred and Fifty ($750) Pollars, in full of its share of the cost of paving the said portion of Grant Street over which the said roadbed of the said Pennsylvania & Maryland Street Rail- way Company is constructed. If, however, the Borough of Salisbury shall by proper ordinance determine and resolve to pave, and pave that portion of Grant Street ovei which the said roadbed of the said Pennsyl- vania & Maryland Street Railway Company is constructed, and the authorities of the said Borough of Salisbury shall not require the said Pennsylvania & Maryland Street Railway Company to remove its track to the center of the said Grant Street, but promises or allows the track to remain on the side of said Grant Street as at first con- structed, then and in that event the said Pennsylvania & Maryland Street Railway Company agrees to pay forthwith to the Borough of Salisbury the sum of Twelve Hundred and Fifty ($1250) Dollars in lieu of its proportionate share of the paving afore- said, whether the said portion of Grant Street on which the said roadbed of the Pennsylvania & Maryland Street Railway Company is constructed is paved by the said Borough or not. In constructing and reconstructing its roadbed on Grant Street, the said Pennsylvania & Maryland Street Railway Company shall place and restore the said streets and highways to the same relative position and condition in which they were found before the construction of the said railway or paving of the said road- bed and portions adjacent thereto,and the said Pennsylvania & Maryland Street Rail- way Company shall at all times at its own proper cost and expense lay its tracks, and keep the same in proper repair, so that driving on, over, upon and across, with all usual and ordinary vehicles and horses, may be safe and convenient; and the said Pennsylvania & Maryland Street Railway Company agrees that the rails of the said track shall not be elevated above the grade line of the street, and that they will further maintain plank between the rails and on the outside of each of the rails at all cross streets alongits right of way and in front of all the business entrances, for a distance of sixteen feet, on the east side of Street, and keep the said crossingsin repair SEC. V. The said Pennsylvania & land Street Railway Company shall, in construction of its said tracks, use such a style of rail known as the “IT” rail, of not less than seventy pounds per yard, and such | poles only as shall be straight, kept covered by durable paint and numbered and kept on the inside of the curb in such manner as to cause the least possible obstruction or injury to such curb and sidewalk, and so as | not to unnecessarily obstruct such portion of the front of private property as may be needed and in use for business or other owner or tenant of said property, and in the event that a dispute shall arise, the Burgess and Town Council shall indicate where such pole or poles shall be located, and that all trolley or other wire or wires to be stretched over, strung along or suspended from such pole or poles over the tracks of the said railway, and stretched, strung and suspended so as to top least eighteen (18) feet. SEC. VI. That the said Pennsylvania & Maryland Street Railway Company shall at all times and in all respects construct and | reconstruct, maintain and operate the said railway appurtenances withdue and proper and convenience of the public. That it shall adopt, procure and use the most im- | proved cars, fenders, brakes, lights, gongs | and other appliances. That its charges for | | a single fare on said railway between two | points within the limits of said Borough of | Salisbury shall not exceed five cents. hat it will stop its cars on the sides of all street crossings, so as not to obstruct the same. Tht in the event of an alarm of fire it will yield the right of way to the fire engines, trucks, arn.d hose carriages of all the fire companies of the said Borough of Salisbury, and it shal not by the running and opera- tion of its cars interfere with the proper necessary use of the fire engines, essary fire apparatus and appointments. That it shall, at its own proper cost and expense, remove all debris resulting from | the construction, reconstruction or repairs | ofits said roadway, and shall remove all { snow and ice from its tracksin such a man- ner as shall not interfere with the public use of the streets of the said Borough. That in the construction or reconstruction of the roadway so as to conform with the present or any future grade, all cuts and fills made or desired by the said Street Rail- said Grant | Mary- | the | way Company, and approved by the Burgess and Town Council, shall be made by the sald Pennsylvania & Maryinnd Street Rall way Company from curb to curb on oppo- site sides of the street. The said Street Railway Company further obligate them- selves to make the necessary repairs to the streets and roadbed so as to leave them in as good condition as before the company began their work, and to keep them in such condition, and upon its failure so to do, and after thirty days notice from the Burgess and Town Council of the said Borough of Salisbury so to do, then and in that event this grant shall become null and void. The said Pennsylvania & Maryland Street Rail- way Company accepts this grant, subject to the right of the Burgess and Town Council to require the said Street Railway Com- pany to move their tracks'to the center of the said Grant Street at time of paving said Grant Street, at their own proper cost and expenses, SEC. VII. The said Pennsylvania & Mary- land Street Railway Company agrees to run not less than “our cars daily, each way, over their line covered by this grant, and continue to run (barring accidents and de- lays, storms, blockades or other unforeseen accidents) at regular intervals, and to re- pair and remoye the cause of all delays within the shoftest time prreticable. That the speed of the cars shall not exceed eight iles per hour within the Borough limits. $ . VIII. That the said Pennsylvania & ‘Maryland Street Railway Company shall indemnify and hold harmless the said Bor- ough of Salisbury in all suits or actions at law which may arise in the construction, maintenance and operation of the said railway. SEC. IX. That except wherein otherwise in this ordinance provided for, the said Pennsylvania & Maryland Street Railway Company shall be subject to such reason- able conditions, regulations, stipulations and restrictions as the said Borough of Sal- isbury shall hereafter and from time to time make and impose by ordinance duly enact- ed and ordained, provided, however, that for a period of six (6) years from the date of the acceptance of this ordinance by said Company, no tax shall be placed upon any of the cars, poles or other apparatus of said Company, and that after that time any taxes imposed by the said Borough of Salis- bury shall not exceed that levied, or that may be thereafter levied upon the several Telephone and Electric Light Companies within the Borough limits. And all ground or non-conducting wires shall be boxed fora distance of eight (8) feet from the ground up, subject to the approval .of the Burgess and Town Council. The Borough authori- ties reserve from the operation of this grant all rightstoregulate the paving, repaving rnd repairing, curb setting, the laying of pipes for conducting water, gas or other purposes across and under the right of way of the said Company within the limits. of the said Borough. SEC. X. The said Pennsylvania & Mary- land Street Railway Company are to begin work on Grant Street,at the borough line on the north side of the Borough, so as to counect with the line at present construct- ed by them, within two weeks from the date of the acceptance of this ordinance, and are to complete said work within the Borough limits within six months from the date of the acceptance of this ordinance; otherwise, all rights under this ordinance shall become void. In the performance of its work under this grant,the Pennsylvania & Maryland Street Railway Company shall so manage their work as not to hinder or delay traffic on the streets of the Borough unnecessarily, and shall not open more than three hundred feet of the street at any one time without the consent of the Burgess ann Town Council, and shall at all times during the construction of their work through the Borough leave the roadway open to travel. SEC. XI. The said Pennsylvania & Mary- land Street Railway Company,or their con- tractors, shall, before commencing work, file with the Clerk of the Town Council their bond in the sum of Five Thousand Dollars, indemnifying the said Borough of Salisbury against all damage done by the said Street Railway Company in digging up the streets aforesaid, or any part thereof, or any damage that may arise from the planting of polesand the stringing of wires, and failure to restore the street to as good condition as it was when the said Company began its operations, and for any damage that the said Borough may be found liable - for by reason of the acts or negligence ot the said Company in the prosecution of its work. Said bond to be delivered up to the bondsmen upon the satisfactory comple- tion of the street railway. SEC XII, ‘If the said Pennsylvania & Maryland Street Railway Company, or as- signs, fail to comply with or carry out all or any part of the provisions and conditions of this ordinance, then and in that event it shall be optional with the Burgess and Town Council, by proper resolution or ordi- nance, to declare this franchise null and void and of no effect. SEC. XIII. The. said. Pennsylvania & Maryland Street Railway Company shall pay the cost of publication of this ordi- nance, and this ordinance shalt also inure to the benefit of the successors and assigns of the Pennsylvanian & Maryland Street Railway Company. Sec. XIV. That any ordinance or part of ordinance canflicting with the provisions ot this ordinance, be, and the same is hereby repealed, so far as the sume atfects this or- dinance.
