AXIMALS KI'NMNi; AT I.Al'.fii: SECTION 1. lie it ordained and enacted by the Town Council of the Borough of Eagles Mere in the. County of Sullivan ana State of Pennsylvania, in council as sembled, and it is hereby ordained and enacted by authority of the same that it shall not be lawful lor any horse, mare, mule, cattle, sheep or swine to run at large in the Borough of Eagles Mere. SEC. 2. That it shall be the duty of the High Constable of said Borough of Eagles Mere to take up and cSnfine in some suitable pen or enclosure any horse, mare, mule, cattle, sheep or swine found running at large within the limits of said Borough. Provided, however, that in no case shall this ordinance be so construed as to prohibit the driving of said animals through the streets when in charge of any person or persons. SEC. 3. It shall be the duty of the High Constable after confining any liorse, mare, mule, cattle, sheep'or swine, to within 12 hours affix a writen or printed notice on three of the most public places in said Borough stating when such horse, mare, mule, cattle sheep or swine was taken up, and unless an owner applies to said High Constable within live (ft) days thereafter, and tender the fees and expen ses hereinafter mentioned said animals shall be forfeited, and said High Constable after giving two days written or printed notice, affixed in 3 ol the most public places in said Borough of the time and place ol sale, shall proceed to sell the same, and the proceeds of such sale shall be paid to the Treasurer of the said Boro. of Eagles Mere after deducting lor use of High Constable .">0 cents tor taking up and confining each horse, mare, mule, cattle, sheep or swine 2f> cents per day lor keeping each one and 50 cents for ilie selling ot each one. SEC. 4, That when the owner of any horse, marc. mule, cattle, sheep or swine shall apply to the High Constable before time of sale the same shall be immediate ly delivered up. on the owner's paying to said High Constable the fees and expen ses before mentioned for taking up and keeping said animals. SKC. 5. That it shall he lawful ibrany person or persons to take up any horse, mare. mule, cattle, sheep or swine lound trespassing on said person's or persons' premises, and to deliver the same to the High Constable of r-aill Borough, who shall thereupon confine the same and pro ceed as directed in the proceeding section of this ordinance. SEC. ti. All lines, penalties, tees, cost and expenses imposed by any of the pro visions of this ordinance may be sued lor, collected and recovered before any Justice having jurisdiction, as debts of like i amount and lines and penalties imposed •for the violation ol Borough ordinances are now by law collectable and recover-" able and shall be paid over to the Treas urer of sail I Rorough tor the use ol said Borough.
