P. J.Tbe citizens of Mil lerstown, Perrjr county, have addressed this court, in reference to the mainte nance of wandering peisons, coaiuionly called and known as tramps. Thoy oomplain, that, situated as that town is, on the highway to Pittsburg, these destitute travelers are nightly quarter ed upon the citifens, and they ask what can be done to shift the burden upon the county. The act of the 13th of June, 183(5, defines vagrancy, or its equivalent, and section 22, paragraph IV, covera the tramp thus : 'All persona going about from door to duor, or placing themselves in the streets, hig'iways or other roads, to brt or gitber alms, and all other person wandering abroad and begging. Section 1, act of 1767, 21st Febru ary, lirigbtlj's Pardon, page 1453, rnvvides : "It shall and may be lawful for anj jostle of the peace of the county whete such idie and disorderly person may be found, to commit sunh offend ers (being legally convicted thereof be fore him, on his own view or by the confession of such offenders, or by the oath or affirmation of one or more cred ible wines3es) to the work bouse of such county, if such there be, other wise to the common jail of the county, there to be kept at bard labor, by the keeper of snch work-house or jail, for any time not exceeding one month." The same act makes it the duty of a constable to arrest such persons, and take them before a justice of the peace, that he may hear and convict, and com mit the accused, 4c. Now, here is the only authority that exist' for the arrest and imprisonment of vigraufs, and it must be observed, that the coiumitment must be fur vi brancy, and the sentence must be to hard labor, and hence a mere permit from the justice to the jailor, to keep over night, is void, does not author ixo the sheriff to charge the county for the keeping, i uuiberlarid county vs. Ilolconib, 12 Casey, 349. Then, when commitment is in due firm, bow far is the county liable for constables' sod justices' fees ! It may be stated as a general proposition, that where a statute imposes a public duty on a public officer, who proceeds in the name of the couiuioowralth, aud there arise benefits to the public from the performance if the duty, as where the proceeding is for the preservation f order, there is an implied agreement on t ie part of the county to pay for such STTiees. County of Lancaster vs. Uriurha'.l, 5 Casey, 38 ; ounly of Northampton vs. West, 4 Ca.-ey, 174 ; 12 Casey, 349. This would compel the county to pay both j'jetice and cou siable their fees for committing a va grant. This view of the case would justify the citizens of any town in the country in having the vagrants arresttd, com mitted by a justice to the county jail, and the officers would be entitled to their fees. But it is clear that this course would greatly iucrease the ex penses of the county, aud would justify the commissioners in making any ar rangement with parties in the several towns, to keep these vagrants at less cost for instance, itistead of bringing the tramp to the couuty jail, the justice turns him over to some one employed bv the commissioners to keep him over night. This would relieve the citizens and save the county the cost of remo val. Contracts made on Sunday cannot be en forced. A note by a minor is void. A contract made by a minor is also void. A contract made with a lunatic is void. A note obtained by fraud or from a per son in a state cf intoxication cannot be col lected. If a note is lost or stolen it docs not re lease the maker. He must p-iy it if the consideration for which it was given an 1 the amount can be proven. An indorser of a note is exempt from lubillty if not surved with notice o dis honor within twenty-four hours ol its non payment. Notes bear interest only when it is so stated.
