It appearing to the court that the counsel of Robert Ewing were on their way to attend this Court, pursuant to its ;order of Nov. Ist, but were detained—and the order of Nov. 15th, 1862, having been made on account of their non-attendance: is ordered that the order in the above 'case, made Nov. 15th, 1862, makintabso- I ate the rule to quash the certiorari, be hereby dissolved, vacated and made null. IM'the Court of Oyer and Terminer, on Holiday morning, Judge Sterrett presi ding, another homicide case was taken up, that 'of Commonwealth vs. Rudolph Weil, inaiCted for the murder of Charles Haney, in the village of Mt. Washington, this county. The circumstances of the killing are sub stantially as follows On the night of the eth of September last, about eleven o'- clockil' Haney, who had been employed during the summer in watching the or chard' -of George Chivers, in Lower St. ClairlOwnship, went to a beer hall in Mt. Washington,kept by Frederick Kaaff, to get a glass of beer. He left a gun, which he hactiwith him, standing in the corner of the room, and sat down at :.he table to drink his beer. Several persons were in the room, Wiel among the number, and they soon had the gun in their hands, ex amining at. Haney told them the gun was loaded' and might go off, but they did not heed hi'm and he got up and went toward them. All let go except Weil, who held on to thelgun, refusing to give it up unless Haney gave him $.7) "for his hold." At this Haney became enraged and remark ing "I' have another" drew from his pocket ki double barreled pistol. Weil said : "Too would not draw that on me" andl immediately seized the pistol. A struggle ensued, in which the barrels of the piskil became separated from the stock, theharrels remaining in the hands of Weil, e Who, a moment after, struck the deceasedheavy blow upon the head with the muzzles, felling him to the floor. It was soon found that Haney had received a bad fracture of the skull, from the effects of which'lie died about nine o'clock on the following tmorning, (Sunday,) while Dr. McCook.was probing the wound. Soon after the cjtizens arrested Weil, who was at once brought to the city and committed to jail. Weil is p, German, some thirty years of age and ha's a wife and four children. He cannot speak English arid the interperter's services are frequently called into requisi ti On. HaiVey was an Irishman and left a family. Binh resided in Lower St. Clair township. 11 1 The zounsel for the prosecution are Dis trict Attotiey Miller, C. B. M. Smith and A. H. Werizell, Eggs., and for the de fence, Thoe'; M. Marshall and Jno. H. Bailey, Esqa. A jury was not empaneled until the mid dle of the afternoon, when, after a brief opening of ;the case, the Commonwealth proceeded, to theexamination of witnesses, whose testimony aid not differ, in any ma-' terial poiht, from the statement given above. The ease'excites a good deal of interest and the attendance in the Court room is about as large as usual on such occasions, Gen. MeClellan's Birth-Day. The 3d dug of December next, General McClellan's birtb-day is to be celebrated by the Yoirg Men's Democratic Club, of this city, by a ball at Lafayette Hall. The preparations will be made on a large and liberal scale and a lively time may be ex pected. The proceeds will be devoted to the establishrent ofa Democratic reading room. NewlDailroad Depot. We obserte that the Pittsburgh, Fort Wayne and ii. Chicago Railway Co. are erecting a new freight depot on their large lot, corner Penn and Wayne streets, to accommodate their large and increasing business. If will ba 240 feet long by 40 feet wide, , substantial)y built of wood. The floor is' already laid, and the building will soon be Illnished. As there is to be a gate on Wayne street, the pressure of ve hicles on Penn street will be materially relieved. Indoortant Order. The necessity of filling up the old regi ments in the; field, has elicited a new order from "Adjutant General Thomas, through the recommendation of Governor Curtin, by which the drafted State Militia hate the privilege of volunteering in the old regiment#, either in companies or squads, under i i their own selected officers. This order requires all substitutes here after employed to enter the old regiments on being accepted and mustered into ser vice. This must be distinctly understood by those who intend entering the army as substitutes. .!I •i Divorced. In the Court of Common Pleas, on Sat urday; Jamek McDonald was divorced from his wife Nary, and Sarah H. 'Cave from her hmiband Henry Cave. It is stated that desertions from Camp Howe have beeome very frequent of late, some two hundied having left and taken the cars for h4ne at one time and that the rolls now showiaome five or six hundred drafted men absent. The usual Cross having been raised before the altar, the missionaries, seven in number, and attired in the habit of their order, pre sented themselves at the Cathedral door, and were received by the Very Reverend Father McMahon,Vicar General, who, on behalf of the shop, gave them a cor dial and generous welcome. They were then escorted up the centre aisle to the main altar, where, after a brief period passed in prayer, they were invested with the Stole, the emblem of authority in the Catholic Church The ceremony of investiture is usual, we believe, on all occasions of this character. It denotes that for the time being the Bishop and regular clergy of l the church delegate their authority to the missiona ries, leaving the spiritual interests of' the congregation, so long as the mission may last, entirely in their hands. The ceremony closed with a benediction by Father Gies sen, Superior of the Order, after which high mass was sung, the choir, under Prof. Wamelink, performing the part ill a very creditable manner. Father Jacobs then addressed the congregation, stating the object of the mission, and what it was ex pected to accomplish through it. The Reverend Father is an exceedingly elo quent and effective speaker, and fairly electrified his audience. His language was unusually chaste and well chosen, and his manner of delivery that of a practised and accomplished orator. In the even ing Father Giessen preached to an .audi ence of 5,000 persons. The Cathedral was densely crowded, and the deepest interest in the reverened gentleman's discourse was manifested. As a matter of infOrmation for our Catholic readers we-give below the order of the excercises for the present week :—First : Mass at five o'clock A. M. to be followed by instruction. Second : Mass at nine A. m , to be succeeded by a similar course of instruction to that given at five. Instruction to the children at eleven A. M. At seven r. M. religious ex ercises, to be followed by instruction and a sermon. The Misson. will continue for two .weeks, and will be the means, no doubt, of producing a great awakening among the Catholic portion of the com munity.—Chronicle. Bank Elections.
