In the afternoon .the Port Perry homicide case was taken up. , Luke Berry, Isaac Ander son, Thomas J. Cratty and John King, indict ed jointly with Andrew_Stroup, who has never been arrested, were brought in and placed in the prisoner's box. The indictment, which, was read to Berry, who was first arraigned, is fur murder, and charges the parties with hav ing beaten August Dihlman, with sticks and stones, at the house of Frederick Naser, in Port Perry, during an affray, on Monday, April 6th, 1838, inflicting wounds which re sulted in his death on Tuesday, the 13th of the same month. After the reading of the indict ment, Berry, whose name in the indictment was given as Lewis Berry, pleaded a misnomer, asserting that his name was Luke, and verify ing the fact. The Court was accordingly ad journed until nine o'clock this morning ; In the meantime a new indictnient will be drawn, and the case will go to trial-to-day.
