Court assembled at ten- o'clock, and Judge
M'Candless delivered to the jury empanneled
in the cftse of the M'Cleary family, indicted for
counterfeiting United States coin, a brief but
able and concise - dui*, which occupied some
twenty .minutes. Ho held that the evidence
was clear against the elder, that the wife and
daughter may have been coerced by him, and
that they might Safely be acquitted under the
laws, which are not strenuous as to females un
der control of the head of the .family. As to
the son, although he was of age and had no
visible oempation, -yet. there was apparently
not suffleient evidence to convict him: , This
was, however, a mere expression of opinion by
the Court, as the Judge tremurked, and the
jury would act according to:their understand
ing of the evidence.
The jury retired, and in half an hour return
ed with a verdict of guilty in manner and form
as indicted, as to John and James .IrCleary,
the father and son, and not guilty as to La
vinia and Eliza 3.l'Cleary, the mother and
daughter.
The former were remanded to prison to await
sentence, and the females .held in their own
recognizances to appear at the next term of
Court to answer.a charge of counterfeiting gold
coin; should the Muted States District Attor
ney seetit to.prosetaute:them. under en indict
ment already found.
The traverse jurors were then discharged
With the thanks of the Court, and the Court
adjourned until cloven o'clock on Wednesday
morning, when the M'Clearys will probably
be sentenced.

club at Fort Wayne, has been eclipsing all

TUESDAY, Juno ith, 185 i)
Court met at ten o'cUiek, consumed an hour
in disposing of a few trilling surety of the
peace cases, and adjourned until two o'clock.
In the afternoon .the Port Perry homicide
case was taken up. , Luke Berry, Isaac Ander
son, Thomas J. Cratty and John King, indict
ed jointly with Andrew_Stroup, who has never
been arrested, were brought in and placed in
the prisoner's box. The indictment, which,
was read to Berry, who was first arraigned, is
fur murder, and charges the parties with hav
ing beaten August Dihlman, with sticks and
stones, at the house of Frederick Naser, in
Port Perry, during an affray, on Monday,
April 6th, 1838, inflicting wounds which re
sulted in his death on Tuesday, the 13th of the
same month. After the reading of the indict
ment, Berry, whose name in the indictment
was given as Lewis Berry, pleaded a misnomer,
asserting that his name was Luke, and verify
ing the fact. The Court was accordingly ad
journed until nine o'clock this morning ; In
the meantime a new indictnient will be drawn,
and the case will go to trial-to-day.

NEW Torts, Juno 7.—The body found in
the water near Fort Hamilton, was identified
yesterday as that of Mrs. Fanny Dean Halsey,
an actress. The deceased disappeared on Wed
nesday last under circumstances which gave
rise to' the suspicion that she bad been murder
ed. Owing to various causes, suspicion point
ed to her husband as knowing something of the
cause of her death, and ho was arrested. Upon
a post mortom examination, no evidence was
found of violence, or anything to indicate the
pred , enco of poison in the stomach. Henry
Percy. Halsey, the'busband, of the deceased, is
a son of Henry William Richard Howard Hal
icy, of Henley Park, Surrey, England, a man
of large estates aud influence.

PORT JERVIS, N. Y., Juno 7e—A man
named Cole has been arrested at Montague,
Sussex county, N. J., on the charge of having
poisoned his wife to death during her confine
ment to childbed. ^ Facts have transpired
which, it is alleged, show that Cole and his
family physician, Dr. Wickham, had conspired
to commit the horrible crime, and an insurance
of $4,000 having been first obtained on tho life
of Mrs. Cole. Colo is in custody, but Dr.
Wickham managed to escape.
