The opinion virtually decidi-s that the whole plan of constructing sewers upon tho foot-front plan is illegal and void, and that the assessment cannot lie collected. The case arose upon the application of Mrs. Harrison T. Witmnn, a proH-rty ow ner of the first sewe-r district of Head ing, for an injunction to restrain the city from the collection of an assessment ujkiii her property for the payment of the sewer laid in front thereof. The de cision takes the ground that as the first aewer district stretches over a large area in w hich there is a great variation in tho value of projierty, ranging from l,iin a foot on Penn square to ?jn a foot on somo of the narrow street in the outlying dis trict the f.sit front rule cannot be applied, since it w ould lie unjust to compel the one to pay as much as the other. The charge of false pretense against Jas per Augustine, by Joseph Wolf, the Hun garian King, of Hraddock, was tried in the Allegheny County Criminal County Friday. The whole case was badly mix ed up, but the undisputed testimony showed that Augustine had Iiougiil a farm near FairchuiKv, Fayette County, from John Clark for three horses and two hundred bushels of grain. Augustine, Clark, nor Wolf never saw the farm. Augustine sold one-half of tlie farm to Wolf, and says the price was 1'm.n.i I bricks and a jKMn.ite. The value of the three horses and two hundred bushels of grain was $ii.Mto ?si), and the price put in the deed was?is.ii. The false pretense al leged by Wolf is that Augustine said he paid f A "S' for the farm, and stated that there was irw. ore on it. Augustine denied tho charge, saying that 110 cash was Used ill the deal ; that he told Wolf hat he gave for the farm, and that the deed was to Ik made for fln.oM, in order to sell it to some one else for that amount. Wolf tiled a bill in equity in Fayette County against Augustine to prevent the collection ofthe note and recover the val ue of the brick. A w itness named It. F. Fulmcr swore that Wolf said to him some time ago that Augustine must settle, or he would hear from him. "lie will hear something ho will Is more anxious to settle than this." The witness continued: "He said: 'I will spend every cent I have. 1 will l.tiy every witness and juror in Fayette and Allegheny Count h. If that don't fix him 1 will have his bloiwl.
