' Also, lhat in the fourth section of the Act of Assembly, entitled An Act relating to executions and for other purposes," approved April 16, 1840, it is enacted lhat the afore Bid 13th section, 'shi II not be construed, to prevent any military officer or borough offi cer, from serving a Judge, Inspector, or Clerk! at any general or specijl election in this Commonwealth." And the said act of Assembly, entitled "an act relating to elections of this Common wealth, p issed July 2d, 1830, further provides That the Inspector and Judges t-hall meet at the respective places appointed for hold ing the election in the district to which they respectively bc'ong, befre nine o'clock on the morning of the second Tuesdiy of Octo ber, and each of said inspectorsshall a ppoint one clerk, who shall be a qualified voter, of such district. ' 'In case the person who shall have re ceived the second highest number of votes for inspector, shall not attend on the day of any election then Ihe person who shall have received ihe tecond highest number of votes for judge ot the next preceding election shall act s inspector in his place. And in case the person who shall have received ihe high est number of voles for inspector thall not attend, the pen-on elected judge shall ap point an inspector in his pi a cp and in case the person elected, as judge shall not attend, then ihe in-pector who received the highest number ot votes ehall opp int a judge in his place; or if any vacancy shall continue in the board for the spnee of one hour after the time fixed by law for the opening of the election, the qmlified voters of the town ship, ward or distiet for which such officers shall have been elected, present at such election, thall elect one of the number to fill such vacancy. Provided. Tint the white freemen citizen of the Un ted States between the ages of twenty-one and '.twenty-two years who had resided in the election district ten days as aforesaid, shall b- entitled to vote, although they shall not ha'e p.iid said taxes. -No person shall be admitted to vote whose ntme is not contained in ihe list ot taxable inhabitants' furnished by the Com missioners, unless first he produces a receipt fbr payment within to years, of a State or County tax assessed agreeably to the Consti tution, and give satisfactory evidence either on his own oith or the affirmation of another that he has paid such tax, or on failure to produce a receipt, slnil make oath to the payment thereof; or, second if he claims a right lo vote by being an elector between ihe ages of 21 and 2'2 years he shall depose on oath or affirmation that he has resided in the State at least one year next before his application and make such proof f residence iu th district as is required by this act, and that liedes verily believe, from the accounts gipn him, that he is of the uge aforesaid, and gives such other evidence as is required by this act, whereupon the name of the per son so admitted lo vote shall be inserted in the alphabetical list by the inspectors and a note mide opposite thereto, by wri'in the word tax,', if he shall be admitted to his vo:c by reason of such age, and in such case the nimc shall be called to the clerks who shall make the like notes in ihe lL-tof voters kept by them. If any person shall prevent or attempt to preyent any officer of any election under this act from holding such election or use or threaten any violence to any such officer or shall interrupt or improperly interfere with him in the execution of his duty, or shall block up the window or avenue to any window where the same nay be holding, or shall riotous'y disturb the v;ace at such election, or shall use or practice any intimi dating threats force or violence, with design to influence unduly or overawe any elector or to prevent him from voting or n strain the freedom ot choice, such persons, on convic tion shall be fined in any sum not less than fie hundred dollars und be imprisoned for any time not less than three nor more thin twelve months, and if it slidl be shown to the Court where the trial of such offence shall be had that the person so offending was not a resident of the city, ward, district or township where the said offence was com mitted and not entitled to vote therein, then on conviction he shall be sentenced to pay a fine of not less than one hundred or more than one thousand dollurs,and be imprisoned not less than six months, nor more lhan two years. . If any person shall make any bet or wager upon the result of any election in this Com monwealth, or slnll offer to make any such bet or wagpr, either by verbal proclamation thereof, or by any written or printed adver tisement, or challenge or invite uny persons to make such het or wager, upon conviction thereof, he or they shall forfeit and pay three times the amount so bet or to be bet. If any person not by law qualified 6hall fraudulently, vote at any election in this commonwealth, or being otherwise qualified, shall vote out of his proper district, or if any tperson knowing the want of such qualifica tion, shall aid or procure such person t-i vote, the person offending shall on conviction, be fined in any sum not exceeding two hundred dollars, and be imprisoned for any term not exceeding three mnth. ."In all cases where the name of a person claiming to vote is found on the list furnish ed by Ihe Commissioner and Assessors, or his right to vote whether thereon or not ob jected to by any qualified citizen it thall be the duty of the inspector to examine' 6tich person on oath os to his qualifications, and if he claims to have resided wilhin the district fr one year or more his oath shall be suffi cient proof thereof, but he shall make proofat least by one competent witness wfio shall be a qualified elecor that he has resided within the district for more than ten days next pre ceding such election and shall also himsell swear, that his bona fide residence in pur suance of his lawful calling is within the district, and that he did not remove in said district for the purpose of voting therein. 'Every person qualified as aforesaid, and who shall make due proof, if required of his residence and payment of taxs aforesaiJ, shall be admitted to vote in the township, ward or district in which he shall reside. If any person shall vote at more than one erection district or otherwise fraudulently vote more than once on the same day, or shall fraudulently fold and deliver to the in spector two tickets together with the intent illegally to vote or advise and procure an other 60 to do, he or they so offending bhaU on conviction, be fined iu any sum not less ilnn fifty nor more linn five hundred dol lars, and be imprisoned for any term not. less than three nor more than twelve months. 'Section A. On the day of rlection any person whose name is not on the list, ami claiming the right to vote at and elect ior, shall produce at least one qualified voter of the district as a witness lo the residence of the claimant in the district in which he claimsto be a voter, for the period ot at least ten days next preceding said election, which witness shall lake and subscribe a written, or partly written nnd partly printed, afilduvii to the facts stated by him, which affidavit shall define clearly where the residence is of ihe person so claiming to be a voter, and the person so claiming the right to vote shall also lake and subscribe a written, or partly written and partly printed affidavit, stating, to the best of his knowledge and belief, where and when he was born; that he is a citizen of the commonwealth of Pennsylva nia and ot the United States; that he has re sided in the commonwealth one year, or if formerly a citizen therein and has moved therefiom, that he has resided therein six months next preceding said election ;ihat he has not moved into the district for the pur pose of voting therein ; that he h is paid a t-tate or county lax wuhin to years, which was assessed at least len days before said election; and, if a naturalized citizen, shall asi state when, where and by whit court he was naturalized, and shall lso produce h?s certificate of imturaJizaf;ion. for examin ation ; the said affidavit shall also state when and where the tax claimed to be pail by the affiant was assessed, and when, where and to whom paid; and the tax receipt thcre'or shall be produced for examination, unlcs the affiant slnll state in his affidavit lint il has been lo or destroyed, or thai he never re ceived any; but if the person so claiming the right lo vote shall take and subscribe an affidavit, that he is a native born citizen of the United States, (or if horn elsewhere, shall state that fact in his allldavit, and t-ha'l produce evidence that he has been mtural ized, or that he is entitled to ciiizen.-hip by reason of his father's naturalization :) and shall further state in his affidavit tint tie is at Ihe time of taking the affidavit, between the iiges oflwenty one and twenly-twoycars; that he has resided in the 6tate oneyear and in the election district fen days next prece ding such election, he shall be entitled to vote, although he shall not have paid taxes; the said affidavits nf all persons making such claims, and the affidavits of the witnesses to their residence, shall be preserved by ihe eh ction bard, and at the close of Ihe elec tion they shall be enclosed with the lUt of voters, tally list and other papers required by law to be filed by the return judge with the prothonotary, and shall remain on tile therewith in l he prothonolory's office, sub ject lo examination, as other election papers are; if the election officers shall find lhat the applicant or applicants possess all Ihe legal qualifications of voters, he or they 6haP be permitted to vote, and the name or names shall be added to the list of taxables. by l he election officers, the word 'tax" bein; added where ihe claimant claims to vote on tax, and the word "age" where declaims to vote on age ; the same words being added by the clerks in each case respectively, on the listt of persons voting at such election. Section a. It shall be lawful for anv qualified citizen of ihe district, notwithstand ing the name of Ihe proposed voter is con tained on the list of resident taxables, to challenge the vote of each person; where upon the same prouf of the right of suffrage iis is now required by law shall be publicly made and acted on by the election board, and the vote ndmitted or rejected, according to the evidence; every per-on claiming to be a tvttur-ilizcd citizen shall be required to pro duce his naturalization certificteatthe elec tion before voting, except where he has been for ten years, consecutively, a voter in the district 'in which he oners his vote; and on the vote of such p -rson being received, il shall be ihe duty of the election o'.ficers to write or stamp on such certificate the word voted," with the month and ypar;and it any election officer or officers shall receive a second vote on the same day, by virtue o' the same certifficate. excepting where sons are entitled to vote by virtue of iIip natural ization of their fathers, l hey and the person who shall offer such second vote, upon so of fending shall be guilty of a high misdemean or, and on conviction thereof, be fined or imprisoned, or b .th, at the discretion of the court; but the fine shall not exceed one hun dred dollars in each case, nor tho imprison ment one year; the like punishment shall ho inflicted on conviction, on the f-flrcers of election who shall neglect or refuse toinaks, or cause to be made, the indorsement requir ed as aforesaid on said naturalization certi ficate. On the petition of five or trioflB citizens of the county, stating under oath that they verily believe lhat frauds will ba practiced at the election about to be hthj in any district, it shall be the duly of the cOflft of common pleas of said County, If in fffstio'n or if not a judge thereof in vacation to 8p- point two judicious, eober and intelligent citizens of the county to act a overseer at said election; said overseers shall bo selected, from different political pnrtirf, where the inspectors belong io differert. parties, and where both of said inspectors belong to ihe same political party, both of the overseers shall bo la ken from the opposite political party ; said overseers shall have the right lo be present with the officers of the eleccion, during ihe whole time the same is held, the votes counted and the re'urns made out and sign d by ihe election i-fficers; to keep a list of voters if they see proper ; to chal lenge nny p rson offering to vote, interro gate him and his witness tinder oath, in re gard to Ins right nf stiffrago at said elec lion, and to examine his papers proluced; and the officers of said election are required to nffbrd'to said overseers 6o selected and appointed every convenience and facility for the discharge ol their duties; and if said eleciion officers shall refuse to pprmit said overseers be present and peform their duties as aforesaid, or if they shall he driven away from the polls by violence or intimidation, ill the votes poiled at such election district may be rejected by any tribunal trying a contest under said elpction : Provided, That no person signing the petition shall Le appointed an overseer. Stic. 12. If any prothonotary, clerk, or the deputy of eiihcr,nr any other person, shall atTix tlie seal of office to any naiurabzition paper, or permit the same to be affixed, cr give out, or cause or permit the bAw.d to br given out, in blink, whereby it may be fraudlently used, or furnish a naturalization certificate, to any person who sh'il I not have been duly examined and sworn in open court, in the presence of some of ihe iudges there of, according to the acl of Congress, or sha! aid in, connive at, or in any way permit the issue of any fraulu'ent naturalization certi ficate, he shall be guilty of a high misdemeanor; or ifany on shall fraudulently use any such certificate of naturalization,, knowing that it was fraudulently issued, or shall vote, or attempt to vote thereon, ifany one shall vote, or attempt to vote, on any certificate of naturalization not issued to hiui, he shall be guilty of a high misJc.neanrr ; and either or any o' the persons, their aiders it abettors, guilty of either of the misdemea nors afresaid, shall, on conviction, be fined; in a sum not exceeding one thousand dollars, and imprisoned in the proper penitentiary for a period not exceeding three y ars. Sec 13. Any person viho on oith or affirmation, in or before' any court in th s State, or officer authorized to administer oaths, shall, lo procure a certificate of naturalization, for himself or any other per son, wilfully depase, deciore or affirm any matter to be fact, knowing the same to be false, or shall in like manner deny any mat ter to be fact, knowing the same to be true, shall be deemed guilty of perjury ; and any certificate of naturalization issued in pursur ance of any such deposition, declaration er aff rmation, shall he null and void; and it shall be the duty of the court issuing lh samo, upon proof beinj made before is that it was fraudlently obtanined, lo take im mediate measures for re-caliing the same foe cancelation ; and any person who shall v-ntey or attempt lo vole, on any paper so obtained or who shall in any way aid in, connive at, or have any agency whatever in the' issue, circulation or useof any fnudient naturaliza tion cerificate, shall be deemed guilty of a misdemeanor, and, upon conviction thereof, .-hall undergo an- imprisonment in thr. penitentiary for not inoro than two years, and pay a fine, not more thin one thousand dollars, for eveyfftfch offence, or bolh, at the discretion of ihe court. Sec. 14. Any assessor, election ofiiccr cr or person appointed' as an overseer, who shall' neglect or refue to perform any duty en joined by this act,- without reasonable or legal cause, sha'l be subject to a penalty of one hundred dollars, and if an assessor shall assess any person as a voter who is not qualifi ed ; or shall refuse to assess any one who i qualified, he shall be guilty of a misdemeanor in office, nnd on conviction be punir-hed by fine or imprisonment, and also be subject to an action for damages by the party aggriev ed ; nnd if any person shall fraudulently niter, add to, deface or destroy any list cf voters made out as directed by 1 hist act , or tear down or remove the same from the plco where it has been fixed. With fraudulent or mischievous intent, or for any improper pur pose, the person so offending shall be guilty of a high misdemeanor, and- on conviction shall be punished by a fine not exceeding five hundred dollars, or imprisonment not exceeding two year, or both, at ihe discre tion of the court. Sec. 10. At all elections herafter held uu der the laws of this conmon wealth, the polls shall be opened between the hours of six aud seven o'clock, a m, and closed at seven o'clock, p. m. Sec. 17. It shall bo tho duty of the Secre tary of the Commonwealth to prepare forms for all the blanks mide necessary by this act. and furnish copies of the same to the county commissioners of the several counties of the commonwealth; and the county commis sioners of each county shall, as soon as may he necessary after receipt of the same at the proper exprre ot Ihe county, procure and furnish ttall the election officers of the elec tion distictsyof I he respective counties copies of such blanks in such quantities as may be rendered necessary for the discharge of their duties under this act Sec. 10. That citizens of this State temporally in 'he service ot the State or of the United Stttes governments,on clerical or other duty, and vvh do. not vote where ihus employed, shall not "be thereby deprived of I be right to vote in their several election dis tricts if otherwise duly qu alified. Sec. 2U. The act, entitled A further supplement to the act regulating to tho elec tions of this commonwealth," approved April fourth. Anno Domini one thousand eight hundred and sixty-eight, and all other lawn uttered 'or suppiied by this act, be and the same are hereby repealed.
