Tux Darn SCOTT DECISION TURNING UV coons. —Judge Taney, when be made this famous de cision to please a political Pfesideut and hie party, did not foresee the amount of trouble in which it would involve him. He was not, with all the legal foresight and judgment which his friends claim for him, gifted with the power to anticipate the protean shapes which it would as sume—sometimes serving his party, and again becoming to it a source of annoyance and em barrassment. The truth is, the decision wad wrong—essentially and radically eo--and its utterers are compelled to pay the penalty which error entails upon those who prefer the wrong to the right. A case has just been decided by Jndge Taney in which ho hoe been forced to give a new construction to one of the chief points In the Deed Scott decision. A slave named Amy was found guilty before the U. S. Court, East , Virginia, of robbing the mail, which subjected him to imprisonment in the Penitentiary for not loss than two, nor more than ten years. Counsel for the prisoner applied to the U. S. Circuit Court for the Eastern District of Virginia to set aside the verdict, on the ground that the Act made it penal for any person to steal a letter, bat a slave being recognized bylaw only asproperty, and not as a person, could not be punished for the offence. It was contended that this view of the law was supported by the Dred Scott de cision. It was further contended that ho could not be fined or iipprisoncd, because he had no property_ or liberty to be deprived of: that the Act gives a jury trial, but as slaves could not be _.jurors, a slave could not be tried by a jury of his peers ; and that as slaves are pnnisbe!, the atltutc-laste of the several St. eral Government tilia FIG right to interfere, bat that Amy should have been tried by the State laws for the larceny of the-i-etter. The following response of the Chief Jus tice., shows that he considers a negro citizen enough to be punished, like a Concession, if he is 'not oufffdiently a "person" to have rights which a white M 35 need respect. This may be regarded as an appendix to tho Drcd Scott case, issued for toe benefit nI the "innocent" Mare. holders: Judge Taney pronounced judgment, confirm ing the verdict of the jury. He said that though slaves were property, yet they were also coneid- • ered and spoken of as .rpereons" in law. The clause which protected the right of masters in them aaproperty, provided “that no person held tweerrice in one State, under the laws thereof, • escaping onto soother, shall io consequence of any law therein be disehareed from such eerrice, hut shall be delivered tip," &e. If the slave ; was not within the law, the mails might be rob bed daily with impunity. • As a person, the flare was bound to obey the law. The judge admitted that the impoottiort of pecuniary tines, I could not be intended to apply to slave, bectuise they could not bold property, and to imprison a ; Blare until the fine 'Was paid, would he to subject hint to perpetual imprisonment. To imprison I him, to compel the master to pay the fine, would be equally objectionable, as it would be punish ing an innocent man for the grime of another. Ile affirmed the authority of Congress to plies such No law; fur, 'although nothing could be taken from a citizen for the use of the State without compensation, he contended that there was a difference be tween the imprisonment of a slave, as a punish ment for crime, and the taking of property for public nee. The former was for the safety of society, and the slave owner must run his share of the risk. In the latter case, if the blare wee taken for - the nee of the Government. the mas ter was entitled to compensation. E.—From information I have received flow all quarters, the strength of the enemy could not be under from 15,000 to 11300 men, and if I should believe the statements of the prisoners, it would exceed that number considerably. English Account of the Battle MIMI. May 21, 1859.—At last there has been a fight. You have doubtless already received the telegraphic bulletins of the affair. Montebello, which seems to have been the principal scene of this fight, is a small village situate about six MilPlil to the north' east of Cogh• era. It was there (and between it and Costeg gio) that Lances won his glorious, but gallantly contested victory over the AnArians, on the 9th of June,ihoo. Although the bulletin is niggardly in details, we may infer from it viirietis things which it does not explicitly state. The combat deseribid by it as '•furious;" but, considering that, betide the Sardinian cavalry, a French di vis:9x, was engaged, and that the time the fight ing lasted is stated at Six hours, we are hardly justified in believing the engagement to have been of re very desperate nature, when we find the casualties of the allies limited to about 300 killed and wounded. The Austrians appear in the first inslanco to have taken Montebello from the Sardinians, and to have been afterwards expelled from the village by the French, and it was most probably among its lanes and houses that the 200 prisoners were made by the latter. The bulletin wisely abstained from guessing at the amount of the Austrian lose, and limits it self to stating it as very considerable (notevolit • elm.), an expression which means nothing, be cause an army almost invariably believes its op ponent to have suffered more than Itself, and the bulletin of the trifling skirmish at Frassinetto immured us that the Austrians hail there suffered greatly, whereas we have since learned that their total loss was nine killed and wounded, or about one-half of that of the Piedmontese. !The unmber of field officers killed and wound ed yesterday on the side of the French and Sar dinians is Dine, including a General killed. This seems a large proportion out of a total of FOO caeualties; but if tome of the Tyrolean Jagers were there it wiStild easily be accounted for by the deadly accuracy of their fire.
