As 1 pre viously announced to you, tho warrant only in cluded Orsini and Pierri. The punishment of Do Rudio is commuted into penal servitude for life. Since their condemnation it was judged prop er to employ the straight-waistcoat with the ihreeconvictß asaprecautionnry measure against any possible act of violence cither on themselves or on those placed in contact with them. The reprieve of Do Radio rendered that restraint no longer necessary, and the tioverner did not de lay a moment in giving orders to freo him from it. When the turnkeys who were charged with (he duty entered De Rudio’scell they found him buried in sleep. They shook him odco or twice before he awoke ; when be opened his eycß and Bat up on his pallet he stared fearfully at them, and for a moment appeared bewildered. He thought they came to announco that his lost mo ment had arrived, and he recoiled from their touch. “Don’t be afraid,” they said, “Don’t be afraid, we are uot going to injure you ; far from.it. If lho execution did not lake place yesterday instead of this morning, it was in no wise owing to the superstitious leeliug about Friday ; but it happened that the Friday of this week followed the Thursday of Mi-Cartmr (Mid- Lent), and it was very properly felt to be im proper that two men should die on the scaffold at the samo time, in the same snbarb, and the same streets that were thronged wilh masks, rcvolers and mummers; that within sight of the guillotine yawning for its prey the most fantastic costames should figure ; that the joyous sound of horns and trumpets, and thejibes and laugh ter of those who were returning from festivities prolonged till the dawn, should contrast with the death-knell of tbo prison chapel; that the Drteenle de la Courlille should pass side by side with tbe scaffold. For tbeso veaons the ex ecution was postponed a day. This morning the weather was bitterly cold, and the ground wet from the snow which had fallen. Tho sky was covered with clouds of a slate color, aud under that dismal c&oopy, dark gray mists, transparent like funeral crape, were drifting about. Tho streets in the more distant port of the city were deserted, but as you near ed the quarter contiguous to the prison detach ed squads of Scrgens de Ville might be seen mov ing towards the same direction, 'the occasional 1la«h of bayonets in the gaslight was dsicernable and nearer stilljbe vague mass, without form or outline, and heaving to and fro, showed that the awful moment was approaching. On tho present occasion it contained, besides tbe chaplaius and the gov ernor of the prison, about 30persons, the prin cipal among whom were the grefficr, or clerk, representing the Court of Assize and the huis aicr, or usher, who was charged with reading the sentence on tbe scaffold. The remainder were apparently police agents, when tbe convicts entered tbeoAtfn&rf de la toilette, they were placed at different extremities of it, with their backs turned to each other. Tliero were two assistant executioners—one from Roueu, the other from Caen—beside him of Paris. These lost no time in preparing the convicts for the scaffold. Dur ing the dreadful operation Orsini remained calm and, (hough he was not so loud or contradictory as during his *rial, Pierri was somewhat excited The strait-waistcoat interfered with his gest iculations, but he hardly ceased talking for a moment. When tho executioner was pinioning him he asked that the fastenings should not be drawn too tight, as he had no intention of es caping. The cold touch of the stool on his < neck, when the scissors cut off bis hair so aa not to interfere with tbe guillotine, for an in stant appeared to thrill through him; bat be recovered himself when he found that bis beard was left untouched. He thanked the execution er for letting him die with his face as became a man. when tho hood, to which the vail which covers the features of the parricide is suspen ded, was put over his head, he is said to have laughed, and attempted a joke about the figure he must cut. At this moment.ho turned his head and perceived Orsini; he saluted him gaily and asked how he was getting on. He was in terrupted by Orsini, who was himself uodergo going the same operation with tho same rang froid as if ho were under tbe hands of a valet dressing for a party, with the words, “Be calm becalm, my friend.” Pieri’s tongue ran on, however. Orsini was supported by the chaplain of the Conclergerie, aud his calmness never abandoned him for a moment. When ho appeared on the platform it could bo seen from the movement of his body and head, though covered with tho veil, that he was looking out for tho crowd, and proba bly intended addressing them. Cutthey were 100 far off. Tho greffier then direolcd tho usher to read the sentenoe of the Court condemning the prisoners to the death of parrioides. The usher, who was an old man, OTcr 60, vras evidently much moved at having to perform this duty, and he trembled as much from emotion as from cold os he read the document,which noone listened to. After this formality was terminated Orsini and Picrri embraced their spiritual altcndenta, and pressed their lips on the crucifix offered to them. They then gave themselves op to tho headsman. He acknowledges that he [ disobeyed the State law of ISSo, which prohibl i ted a State Judge from holding a federal office, ; and asserts that ho did so because he deemed it unconstitutional. He denies the power of tbe Legislature to r establish tbe incompatibility of judicial offices,- because to do so would be to in terfere with the independence of the jadiciary; and asserts the right of overy magistrate to in terpret the Constitution for himself. It strikes us that Judge Loriog has not strengthened his case by this letter. The ground hitherto taken on his behalf has been that tho office of Commis sioner which he held was uot such a federal office as was equally incompatible with the judgeship which he held. He concedes that it was, and rests his action upon the alleged un constitutionality of the State law. This is clear ly untenable, for every law must be presumed to be constitutional uutil it is declared to be otherwise by competent authority.— N. Y. Timer.
