Brenninger, resists the motioh of the District Attorney to continue the trial kf the prisoner until the next term f. the following reasons: 1. By the ninth section of the ninth article of the Constitution of Pennsylvania, the prisoner is entitled ”to a rpeedy public trial by an impartial jury'of the vicinage" and that he is now ready to be put upon his trial, and demands as a right that the Commonwealth proceed to his arraign ment, and the empanneling a jury. 2. That the COmmonwealth has not shown cause by affidavit for any continuance of the case sufficient to deprive the prisoner of his right to a "iperdy 3. That the Commonwealth upon a m:tion to delay the trial until the next term, should be held to the same rule that compels a defendant to show to the Court at the first term when he is called to the bar, the reasons, sustained by affida;rlt, for a continuance, and that reasonable and ordinary diligence has been used to procure the attendance of the witnesses and that they are material. . .. 4th. We would pause a Yong time before we would say that the twelve men who formed the juryin the late case, acted with- out dne consideratiofi or without solemn sense of the fearful responsibility resting upon them. Indeed we feel that they dul so act, strangely at variance with our expectation as was the verdict which they rendered. And yet how a verdict of not guilty of any crime could have been render ed surpasses our conception. We'll - Ink the manoeuvring of the counsel for defence succeeded in throwingaround the circumstances in which the case transpired an atmosphere through which one could see certain shades of palliation of the offence thus far: that the pris oner under the secondary influence of debauch ery was not so much drunk as inane, and that there was ground for reasonable doubt whether or not he had the power to form Ft malicious de sign in his mind and execute it against the life of his victim. In order that ihe ends of Justice might be answered, every good and law-abiding citizen cannot but regret that some restraint or punishment could not have been visited upon this man. We are not of those who clamor for blood on every occasion, but in mercy to the man himself as well as to society, we wish that this crime, for crime it was even by the showing of the defence, as we understood it, could have been made in its effects an example to men of the class to which Jones hiss reduced himself. Let it have been some other degree of the crime for which he was indicted; let it have been something which would have kept this man sway from temptation hereafter, and the ends of law would have been satisfied. We trust now that this man may leave the scenes of his former life at once, and never again show himself in this community. Hero there are no chances of his reform. The good and virtuous cannot associate with him. Although acquitted it was with the admission that he is not blood guiltless. lie is in such case that honest men cannot receive him back from his prison tomb, to a life of honor and happiness, : — Thoseonly who have no regard for such things as make up a life of virtue and goodness, those only with whom his • former associations have been, wilLwelcome him back to congenial companionship, and we fear a life of infamy.— The near shadow of an ignominious death which has just passed him by a hair's breadth may be no warning to him when once again with boon companions, the degraded of both sexes. Let him leave this city, go where his story has nev er been told, form new associations, enter upon _itv scenes, and a new course of life, c.sst far from him the bowl of madness, and devote the rest of his days to the pursuit of objects which ennoble and dignify humanity.
