Tzlnimrea.—Yesterday was the third day of the .trial of Jones, charged with thi = order; Of.Wallam CampbelL A dense and steaming crowd of people jam med the Oyer and Terminer yesterday, listening with all ears to the testimony, and observing with great interest all the proceedings in the trial of James Jones. The prisoner, who had before, occupied a seat beside his counsel, wog yes tardily. placed in the prisoner's box. The defence produced ac, their first witness for the day, Mr. Robert Morrow, who testified in brief that he called. on Jones on the morning imme diately after the death of Campbell, at the re quest of Mr. •Hamilton, Jones' counsel, and charged-him that he should say nothing of the cake to any ono. 'McCoy, Richard Jones, Mayor Wearer, Mr.A`hoinpson and officer Fox, who testified as to Nelson, one of the witnesses for defence, that his character for truth was very bad. Mr. Col lier also submitted the records of the Court showing that Nelson had plead guilty in his time twice topetit larceny, and that he hadbecn guilty of ether . crimes and misdemeanors, and fieen in the lionitentiary. Josephino Thompson was then recalled by Commonwhealth, bat , her testimony, after a lengthy discussion, under the circumstances in, arid to the object for Which it was offered, was ruled out as cumulative when it was to be offer ed as rebutting. Mr. Glenn was called and testified that he would not believe Smith or Horton, another of the witnesses for defence, on oath. Thewitnes see having all bean examined— D. D. Druce,'Esq., opened in a very long and arduous speech for the Commonwealth. lie commenced his speech between eleven and twelve o'clock in the forenoon and, except the time of recess fur dinner, continued speak ing until twenty-five minutes past . three. He reviewed with considerable interest all the facts in the case as they were brought out by the ex amination, and upon them built up and fortified hie hypcithesis of the event under examination. At-half past three, G. P. Hamilton, Esq., com menced his speech, opening for the defendant. He stated that it was the first time he had ever appeared before a jury in a case involving issues of life and death, and that he felt deeply the., responsibilities devolved upon him. He knew, however, that whatsoever his experience might be wanting in, his colleagues would supply. Ai . - ter citing certain rules of law touching the force of evidence which it is necessary for the com monwealth to bring in a case like this, he passed at once to an examination and arrangement of the facts elicited by the previous examination, bringing them to bear upon the hypothesis of an accidental discharge of the pistol by which Campbell was killed. Mr. Hamilton proceeded in a clear; careful, calm and well considered speech until near 6 o'clock when be concluded. In the regular course, as agreed upon, it was undertitood that J. M. Kirkpatrick, Esq., was to spells ia Best for the Commonwealth. After Mr. _Hamilton had concluded Mr. K., however, arose and begged the indulgence of the Court. lie t i stated that ho had been suffering severely du ring e afternoon from a violent bead-ache and Baked hat the Court might grant him until af ter supper, when he would in all probability - be able Stipa on with such remarks as he intended making in the ease.. Judge M'Clureatetted that the trial could not go on, on the Sabbath, and as it alas highly desirable to conclude the case as soon as was just, right and proper, he wished their present eitting to continue until eight o'clock. While he was anxious to accommodate all parties as far as was consistent, be. trusted that such an arrangement could be made among learned counsel as that the trial could proceed without any interruption. Mr. Roberts, one of cottage' for defendant, proposed to pair off with Mr. Kirkpatrick, which proposition was accepted by the latter gentle man, and thereupon Mr. Swart:welder cows mended speaking for the defence. He spoke with great animation. lie contended that this was a case of murder in the first degree, or it wad an accidental shooting. He analyzed the testimony of Harriet Strew, the most important in the case; as going to show that it was a case of wilful murder. While engaged in this analy sis, at about 6 o'clock, with a sudden cry as of pain, Mr. S. threw up his hand. and fell over in a fainting fit. The Court was instantly in great confusion, this event coming to heighten the tragic circumstances which naturally cluster around a trial, involving issues of life and death. Mr. S. was as soon as possible borne from the room into thu fresh air where he soon revived. The Court adjourned for the day. The great wonder has been to us during this, as it was in the great trial of last term, how the Court and the bar manage to live through a pro tracted and important trial; one which draws in,a huge crowd of spectators. Never have we experienced in any room open to the light of heaven, a more depressing atmosphere than reigned in that Court room yesterday. It was packed with men, and each with a wet and reek ing...jacket, and many emitting at each expiration, filmes of tobacco and of whisky, polluted the vital air in such a manner as only,a room with the best ventilation could have rendered tolera ble. That room is miserably ventilated, and hence the personal discomfort and pain of one, and the fainting of another of the counsel in this case. From a protracted and crowded trial the Judges come forth from that Court room looking like men just from their sick beds. We trust that Mr. Swarttweliler will be able today to proceed with his speech and presume that thecase will go to the jury some time to-day. The Intelligencer of Thursday gives us come fur ther bets as follows: • "The young man Wilson, who left Sunfish so suddenly, when the search commenced for the 'body of the murdered girl, Allen, was arrested day before yesterday at Belmont station, on the Central Ohio It. lt., by officer Marshal of Sun fish. Wilion was secured and taken to Sunfish the same evening, where he is now confined awaiting examination, "The preliminary examination of Wm. Swain, one of the parties upon whom suspicion rests for complicity in this foul transaction, memo, cod on Tuesday afternoon, before Esquire Mor rell. We have no reliahle information as to lhe evidence elicited, but learn that Mr. Foreman's testimony in regard to the, clothing and general appearance of the two men seen by' him, from the orchard, on the day of the girl's disappear ' ante, corresponds with the clothing worn by and the appearance of Win. Swain and Wm. Morrl- Son at thitt time." The inkiligenerr further States that near the pitied where the crime was onimitted were foetid a largo cost button and a Wm covered rag, which had evidently been used to bind a finger wound.
