Plasburgla, November 3, 1857. -flee C. IRVINE vs. M. F.: M. BANV.- —Guy C. Irvine, an extensive lumberman of Warren Co., had dealings with the Bank in the course of -which, some years ago, there was an alleged in debtedness upon the part of Irvine. In pursu insect a resolution of the Board of Directors, Irvine confessed a judg mem in favor of the Bank for $37,000 or $38,000. In 1850, the judgment was rendered for $lO,OOO, but that was satisfied without any payments upon it. The plaintiff alleges that he overpaid his in debtedness, by way of double payment of notes,. ,cbeeks &c., &c., to tho amount of many thousand dollars, and that he had been forced to pay in 1840 and 1841 a great deal of money in exchange, in excess_ of lawful interest, which should be refunded to the Bank. • • The defendants set up that on the 9th and 10th .of December, 1859, Irwin and the Bank had a lull and final settlement, so understood by all `the parties, by the terms of which Irvine receiv ed $17,818,11, $10,004) of which was in cash, and the remainder was applied to lifting bal ance of notes, protests &c., duo him. This settlement was sustained by the testimony of the late President and Book-keeper of the Bank, by the admission and affidavit 'of Irvine himself, and the toemmoranda made atthe Bank at the dateof the settlement. It was contended by the defendants that this settlement embraced every item in the plaintiff's account,. and that Irvine was really indebted to the Bank in $lOOO. At the settlement, several checks week missing, and Irvine refused to allow them, but agreed to repay the Bank when they were found. They were ciiseetered some months afterwards, and Irvine gave his notes in payment for all except the $lOOO check, which he refused to pay on account of an alleged alteration in the data of IL:. The Court charged the jury late yesterd4 afternoon, mainly upon the alleged settlement, which, if the jury believed to have been final, was to be conclusive; if otherwise they must reopen the account and examine the necoutits since 18:38. The.case was taken up on Wednesday of last week: Judge Church of Meadville and Col. M'Candless conducted the case for the plaintiff; Andecir Burke, Esq.., and Hon. A. W.
