This respondent further says, that at the time _he was first informed of the overdrawing of the account of O'Connor Bro. & Co., that firm had a large amount 9f funds in the personal custody and keeping of the President of said Bank. That the condition of the strount and dealings of O'Comuir Bro. & Co. with 'said bank, could _ and ought to have been, and were at illl titues .as well known to the officers of said bald 4 as they could, ought to have been, or were known to this respondent. And this respondent further avers, that ho was the acting partner of the firm of O'Connor Bro. & Co., which said firm Was ,composed of James O'Connor and Hercules O'Connor; that Hercules O'Connor gave but little, if any, atten tion to the business of said firm, he being en gaged in a separate business of his own, which demanded and received his presence and atten tion in other States of this Union. That in the transaction of the business of O'Connor Bro. & Co., thirtespoadent was frequently required to be absent from the city of Pittsburgh, and in view of such absence would, and did sign, large numbers of blank cheeks on said bank in the name of said firm of O'Connor Bro. & Co., and left the same in the possession end custody of I ' the clerks of the firm, to bo filled and used in the transaction of the business of the firm during his absence, and did on such occasions instruct his clerks to make their deposits for the firm with the said bank, and obey the directions of. the President and other officers of said bank in reference to all transactions with and for said , bank. And of these transactions daring his absences he has no further, nor has he any per sonal knowledge, other than such as ho derived from his said clerks and the other officers of said bank. And this respondent further solemnly avers, that in the entire course of his dealings and transaction with the bank, ho did mean to, and. did act with good faith and integrity to and with said bank, and not deceitfully, fraudulently I or in connivance with the book-keeper of said bank or any other person. But on the contrary his transactions were, so bras the respondent is concerned, open and with tke full knowledge of the proper officers of said bank. LAN. O'CONNOR. The above statement was not sworn to. O. P. Hamilton objected at. first to a paper's like I this statement of Mr. J. O'Connor and not sworn to, going on the file, but afterwards withdrew his objection. The Court received the paper . Mr Hamilton asked if Mr. James O'Connor was ready for examination before the Court T. M. Marshall, Esq., for respondents, read fnun the statute and contended that it was op tional with the respondent to answer or not under the Act. Mr. M. statedthat these proceed ings had ruined the business of Mr. O'Connor to this community. He dooms it useless, under existing cirenmatances, to go further into this examination. Mr. O'Connor has made an as signment of all his property for the benefit of his creditors and entered into bonds to appear ' and take the benefit of the insolvent laws. This step disposed of the case u far as Mr . J. O'Connor was concerned, under the bench warrant. nu. Although his business, which demanded and received his whole time and attention, was separate and distinct from that of O'Connor, Bro. & Co From the pub licity of the 4virge.s against Mr. O'Connor his business was ruined and he would be compelled 'to pursue the same course as James O'Connor An assignment had been made of all the prop• er:y of the defendant, and he would now tender security =tar the Act of Assembly—that he would apply for relief ander the Insolvent laws of this Commonwealth. Mr. Marshall then read as follows: To the Hon. M. Hampton, Prerutent Judge of the Datriet Court of Allegheny Co : Hercules O'Connor, of the firm of O'Connor Bro. & Co., reserving all legal exceptions and rights of exesption to the manifold errors, de fects and insufficiences of the complaint of John Scott, the alleged pro. tent. President of the Merchants' and Manufacturers' Bank of Pitts burgh, answers and says: That the firm of O'Connor, Bro. ft Co., to the best of his knowledge and belief, are not in debted to said Bank, with his knowledge and consent, in the sum of one hundred and eighty five thousand dollars for moneys had and re ccived by O'Connor, Bra & Co. from said bank, and denies that said alleged indebtedness, if any exists, was fraudulently contracted by or }with the knowledge, consent, or participation t of this respondent. This respondent farther denies that said al leged debt, if any such exists, was either in whole or in part fraudulently contracted by this respondent, or by or with his consent, knowl edge, direction or participation, by knowingly fraudulently, covertly and deceitfully overdraw ing the recount of O'Connor, Bro. & Co with said Bank, and obtaining moneys therefrom, upon checks of said firm with the knowledge of the proper officers thereof, by collusion with and conivance of the book-keeper of said Bank And h denies that he, this respdndent, was in any manner privy to the alleged fraudulent contracting of said alleged debt. And this respondent further avers, that although he was a member of the firm of O'Con nor Bro & Co., yet, for a long space of time last past, to, wit: for the period of twenty-four months, he has not interfered with the manage ment or conductance of the business of said firm; nor has he been acquainted with the condition, relation or extent of the account of the said firm with the Merchants' end Manufacturers' Bank , nor did he, to the best of his knowledge and be lief, ever draw any cheeks upon sad bank in :he name of firm, except, perhaps, is two in stances, in the absence of James O'Connor, the active partner of the firm, when said cheeks were so drawn -at the special instance and re quest of the President of said Bank, to the beat cf this respondents knowledge and belief .
