Mr. McClintock replied at some length In vin dication of hie course on the subject, and in de fence of the bill proposed to be repealed, argu ing from statistics and facto as to the effect of the law, against the assumptions of his colleague, and those opposing the law, end to show that its effect was not only not lojorions • and notagainst the wishes of the people, but highly beneficial, and satisfactory to a large portionof the citizens, which, at a proper period, he would show to the Senate. With regard to the reference to the bill, be said he had no objection 'whatever to Its refer ence to a select committee. The motion to refer to a select committee was then agreed to. Mg. Kilhinger called up Semite bill No. .05, relative to the Sheriff of Lebanon county. Mr. K. submitted an amendment making the bill general, and providing that the County Com missioners of the several counties, (except Phil adelphia and Allegheny,) Ma ll have power to regulate the pay of sheriffs or keepers of county prisons for the board of prisoner!, provided the amount be not higher than thirty centta day. Mr. Welch moved to &hike out "thirty" sad isert "twenty-See" acute; which was agreed to; when the bill passed finally—yeas 21, nays 10. On motion of Mr. McClintock, Senate bill No. 166, to incorporate the Monongahela Turnpike Road company was taken up and permed its sever al readings. Mr. McClintock called up. Senate bill No. 286, to ðerize the Coal Hill and Pittsburgh Turn pike road company to borrow money. Passed Its several readings. In the House, the consideration of the bill to incorporate the Franciscan Brothers of Canthrte county was resumed. Mr. McComb moved that the bill be oral' , witted to the committee, with nutructio in vestigate and report to the Horse the cm:unite don and by-laws of the Titird Order of Francis can Brothers, and the old obligations taken at initiation into the said order. Mr. Miller was an advocate of this bill, but be did not understand that this order was open to any of the objections which had been inside againstit. In Europe, the civil powers had given these institutions greater powers than they should have had; and the same abuses would have co attired if the parties thus entrusted with great power had been Protestants. This bill gives no extraordinary powers, ouoh as they enjoyed in Spain or Italy. They ask only each privileges as have been granted to other religions societies, and es were entirely consistent with the public good. The aot of 1865 regulated the whole qnsetion, and was sufficiently guarded to protect the people. With regard to the exemption of the property of this company from taxation, we every day exempted like property held by other parties.; and it was perfectly right to grant it. The bill was, in his opinion, clearly not within the jurisdiction of the courts, as It included sev eral distinct purposes, in which oozes the courts could not act. Mr. McComb said that the courts have the power to sot in the matter, and the more be ex amined the matter the stronger was. his °envie tion. He had learned, as the debate had pro gressed, that thie bill was Intended to incorpor ate Into a political existence a secret !moiety which was bound by the most solonm oaths and obligations slummed, on banded knee, in the pres ence ofaspiritual adviser. The Legislature had never passed such a bill as the preeenti and he hoped that we would pause before taking such a stop. At least before noting, Shwas proper that we should be informed folly of the objects and organization of the society. Mr. Phelps was surprised that members of the Howe, of acknowledged legal ability, should doubt the power of the courts over this bill. If the word "religious" was alone embraced es the designation of the society, It would comprehend all which the bill contains, and the courts have power to incorporate "religious" societies. The place of this corporation is not designated, ex• oept that it meat be established in Cambria county. He was averpe to notion now, as be wished to have an investigation of the objects and constitution of the order asking to be incor porated by this House. If their purposes were ae charged upon them, they had no right to ex tended pe tßeges. This State:and country was es sentially Protestant, es It extended to all religi ose equal 'privileges. Wilkins, Senate hill No. 184, relative to grading and paring streets and al leys in tha city of Allegheny, was token up and passed its several readings. Senate bill No. 7, to restraba the sale of In toxicating liquors, came up on second reading, pending the amendment of Mr. WOlintnak to the amendment of Mr. Browne. Mr. M'Clintook ad dreseed the Senate at length, on the general subject, and in explanation and support of his amendment especially. He de• precated the mixing up of this question with politics, and appealed to Senators to approach It not as politicians, but as moralists, and to dis miss it in this spirit. He thought his bill was better calculated to satisfy the wants of the peo ple than either of the other propositions pend ing. Hie amendment was negatived by yeas 2, nays 29. se follower Yeas--Messrs. Ingram and and M'Clintook-2. The queetton now reaming on the amend ment of Mr. Browne, that Senator took the floor in explanation and support of his bill. Mr. Wilkins followed in some general remarks in reply to Borne of the positions assumed by the Senator from Philadelphia (Mr. Browne) as to the details of this bill. Taws.—The Cin oinnati Horticultural Society, at their meeting, Jan. 26th, had an interesting discussion on the effect of the cold weather on fruit trees R. Buchanan requested the members to state their observations respecting the offsets of the frost upon fruit trees, and pkrtionlarly the fruit buds. He round the peach buds and those of the beer cherries were killed; those of the applen. the grapes the hardier pears and cherries are still safe. Mr. Kelly thought the examination prema ture; some of the young shoots are destroyed; this wee true of iiesebee, ebonies, and pears, that Ind made a late growth in the fa& AA heretofore remarked by him, the blauardeber ry had suffered more than some of the finer kinds. W. Reilly reports all the Morellos sate.— Napoleon, the Spanish, the Dukes and other finest varieties are killed, not only the bade but the fruit opera; also, the finer Pears have their spurs killed and the blsolmees often descends to the main 'branch. Some early apples appear killed; the late ones look well. The peaches are evidently killed. Ills trees, (five years old) he thinks are not killed. Mr. Hares finds some of the young growth of pears looking badly, but In 1862 the tame appearances were followed with no bad results. No peaches except a few buds, perhaps one per cent., on low branches near the ground. Cher ries appear to be all dead. , Fruit spore look badly - , but believes they will recover F. G. Carey has not examined sufficiently, but believes the cherries are all killed; a few, perhaps, will twelve on the Study May. Plums are not injured. Peaches are killed now; some of the trees appear to be injured. He ap prehended that we should see the effects of the front daring the next amen in various blights. Mr. Kelly reminded us that four years ago we had the same appearances, and where the "shoote were used for grafts they failed; but where left on the tree they , recovered entirely. He thought this discussion was altogether pre mature, except as had been) suggested, by way of showing our powers of guessing; we moat wait until the trees begin to prow in the spring. John K. Greene said that ,Mr. Davis, of Cler mont county, reported a depreision of twenty degrees below zero. He is on white-oak levels; morethan half of his tries appear to be killed; those in the nurseries were also much injured. At Loveland, sear him in the valley, the mer- cury was reported to be from twenty-four thirty degrees below rero. A 11. Hp thinks the young cherry and peach trees would throw off the injury by their intrin sic vitality. Mr. Orange and others thought it premature to judge of the effects at this time, and this is the general sentiment of the members. ‘.
