Cll4lOll Or VIZ CMS?. 0142LLISSII—The ease of the Commonwealth vs. William Bennett, . is the first case that has arisen in Allegheny County under the Act of 14th of April; 1855, and is probably the first that has arisen in this Commonwealth, under that statute. _ Distinguished counsel have appeared, in ad dition to the learned District Attorney, both on behalf of the Commonwealth and the defence. The next jury bas the same • powers, and it repeals, by its verdict, the law of homicide; the next the law of anion; the next, of - burgisryv•the next of larceny; and to on to the end of the calendar. And thus you eee any jury of any county . in this Commonwealth might, in three weeks, in a County Court, repeal the legis lation of one hundred and fifty-five years. The _Legislature alone has the power to repeal it. The law is constitutional, and the Court as charges you.. '. We cannot argue the law off the statute book. Did he 'keep and maintain a house, room and plane where lemons or epithelia liquors or admixtures thereof were sold and drank. ILhe did he is guilty on the first count in the isdiotmeaa 2. Did he keep, for sale, sell and give vinous or'pirilous liquors or some admixtures thereof, receiving therefor, any price, profit or advantage, -and did he then and there at the name time vol untarily afford a place or convenience for drink lo t he did Leis guilty on the second count in -the indictment. Did he keep for sale and sell, vinous or spirituous liquors or admixtures thereof, re ceiving a price, a profit and idvantsge, and at the same time voluntarily egad a place and other ocevenienee and inducenient, by which the same was used as a bare rage. The defendant exhibits a beer license, granted by the Treasurer of Allegheny county, bearing date belbre the pusage of theliet of Assembly under which he is indicted. This shields him from the penalties incident to selling malt liquor: from the penalty of Mg what he is licensed to sell; but it centers no authority, and afforls hlm no protection from the penalties of the law, if he has sold or given, es charged in the indictment, miaow or spirituous liquors, or admixtnrea thereof: wine, gin, rum, brandy, for example. The time of the commission of the offence laid in the indictment is not material, and does not confine the proofs within the limits of thee sae tied. - The indictment will be satisfied by proof of the offence, by any day anterior to the finding of the bill:of indictment by the Grand Jury. There are exceptions to this rule; but the case we are trying is not an exception to the Where a bank note, or promissory note is set forth,the date, if stated, should correspond with the mideoce. • Where time iit stated to be proved by a record, the time stated must correspond with the record. These are exceptions, and sae so, became the date is easily accessible, and easily proved, by , looking at the note, or by looking at the record. Where time is of the essence of the offence, as in burglary (definition) the offence must be proved to havebeen committed in the sight time: but the lay of the month on which burglary is charged to have been committed, is not militarist, and may be proved to have been committed on any other day previous to the preferring of the indictment. Thus you see, Mote and date in burglary, do not mean the same thing: time means MAC time, withont any regard to the day of the month. The rule of law is just and far: It is bused upon experience and observation. Time is a unit. In silent celerity it eon on and leaves no trace, no channel, no landmark. For convenience sake it is notched and marked 24 ames a day by clocks and watches.. When men see an event they do not consider they may be tolled to testify to it, and hence they have no notice, and take no pains to remember dates. On reasons such as these the rule et law is founded; that the time of the commission of the offence laid In the indictment ill not material, and does not - confine the proof within the limits of that period. .• It follows, then, ,that If the defendant has 'been' proved to have violated the law at any time between the late of the indictment, Octo ber 16th, and October the 2ad, the day the law went Into force, it is sufficient.
