0142LLISSII—The ease of the Commonwealth
vs. William Bennett, . is the first case that has
arisen in Allegheny County under the Act of
14th of April; 1855, and is probably the first
that has arisen in this Commonwealth, under
that statute. _
Distinguished counsel have appeared, in ad
dition to the learned District Attorney, both on
behalf of the Commonwealth and the defence.
This being the tint cseenf the kind, the Court
deemed it expedient to permit couesel to go on
in their own way, to take their own time, and
„give utterance to every sort Of firgll4l4llt, elo

Their duty hes, been discharged, and ours be
gins. It is of a Serious and sober nature,' and
our conduct must be governed by the law and by
the evidence.. . .
The various branches in the administration of
civil government, has under the constitution,
each its specille, duties to perform, ita.certsin,
well-defined limited. pow ere to exercise.
Each lower revolves in its own orbit, and the
moment it departs from its own prescribed and
allotted sphere, there is a collision, and a shock
which jars the harmony of the whole. •.
So long as each public ftmotionery, composed
of - one or many, confines itself to its albtted
sphere and does Its duty, it merits reapnot and
confidence, and the moment • it departs therefrom
it justly forfeits both.

The jury have nothing to do with it,
Let us run this out %little. - You think the lew
ef 14th of April uneonstitutlonal, and you repeal
it by your verdict. The next jury bas the same
• powers, and it repeals, by its verdict, the law of
homicide; the next the law of anion; the next, of
- burgisryv•the next of larceny; and to on to the
end of the calendar. And thus you eee any jury
of any county . in this Commonwealth might, in
three weeks, in a County Court, repeal the legis
lation of one hundred and fifty-five years. The
_Legislature alone has the power to repeal it.
The law is constitutional, and the Court as
charges you.. '.
We cannot argue the law off the statute book.
There it remains, constitutional and nnrepealed.
Much - has been said, gentlemen, with regard
to the Jury being the judges of the law, and of
the feet. • And eo indeed - you are.
No explanation of this constitutional feature
has been . erten, and it becomes the duty of the
court to make it clear. . •

Ponder on this oath a moment, and then ask

What ti the lune joined, end whet is the evi
dence? The Indictment charges certain offences
against the law. The defending denies them by
hie plea.
1. Did he 'keep and maintain a house, room
and plane where lemons or epithelia liquors or
admixtures thereof were sold and drank.

2. Did he keep, for sale, sell and give vinous
or'pirilous liquors or some admixtures thereof,
receiving therefor, any price, profit or advantage,

the Indictment. .
The defendant exhibits a beer license, granted
by the Treasurer of Allegheny county, bearing
date belbre the pusage of theliet of Assembly
under which he is indicted.
This shields him from the penalties incident
to selling malt liquor: from the penalty of
Mg what he is licensed to sell; but it centers no
authority, and afforls hlm no protection from the
penalties of the law, if he has sold or given, es
charged in the indictment, miaow or spirituous
liquors, or admixtnrea thereof: wine, gin, rum,
brandy, for example.
The time of the commission of the offence laid
in the indictment is not material, and does not
confine the proofs within the limits of thee sae
tied.
- The indictment will be satisfied by proof of
the offence, by any day anterior to the finding
of the bill:of indictment by the Grand Jury.
There are exceptions to this rule; but the
case we are trying is not an exception to the
Where a bank note, or promissory note is set
forth,the date, if stated, should correspond
with the mideoce. •
Where time iit stated to be proved by a record,
the time stated must correspond with the record.
These are exceptions, and sae so, became the
date is easily accessible, and easily proved, by ,
looking at the note, or by looking at the record.
Where time is of the essence of the offence,
as in burglary (definition) the offence must be
proved to havebeen committed in the sight time:
but the lay of the month on which burglary is
charged to have been committed, is not militarist,
and may be proved to have been committed on
any other day previous to the preferring of the
indictment. Thus you see, Mote and date in
burglary, do not mean the same thing: time
means MAC time, withont any regard to the day
of the month.
The rule of law is just and far: It is bused
upon experience and observation.
Time is a unit. In silent celerity it eon on
and leaves no trace, no channel, no landmark.
For convenience sake it is notched and marked
24 ames a day by clocks and watches..
Time is the meet neheleits, most volatile, mer
curial 'end evanescent of all things, and out of
one hundred witnesses, who can recollect dis
tinctly a fact, a circumstance, a transaition, and
testify thereto clearly and distinctly, perhaps
none of thenx,‘M recoolleet time=the time—'
the _date 'of unless it be recent, or unless
something occur to fix it on the memory. When
men see an event they do not consider they
may be tolled to testify to it, and hence they
have no notice, and take no pains to remember
dates.
On reasons such as these the rule et law is
founded; that the time of the commission of the
offence laid In the indictment ill not material,
and does not - confine the proof within the limits
of that period.
.• It follows, then, ,that If the defendant has
'been' proved to have violated the law at any
time between the late of the indictment, Octo
ber 16th, and October the 2ad, the day the law
went Into force, it is sufficient.

FATAL ATTILAT.—Timothy Bosnian, the man
who was shot by Michael M'Carty, at Tunnel
toq, au Thursday the 11th inst., died on;the
lowing Monday. The particulars of the runtr-

to shut up and go to doep. Bcanlin told him to
go out of the room and let the men sleep.
duty replied that if he did not keep quiet, he
would shoot him, and went to another room and
returned with a pistol. Boutin said that If he
wan going to be shot, it would not be in bed, and
attempted to get up. As he was in the act of
doing 80, M'Carty fired—the charge entering
Soudan's abdomen, canning his death aa above
stated.
Mr. Woods arrested M'Carty next day, and
, took him to Edinburg, and after a hearing
' before Esq. Dougherty, be was committed to
jail st Indiana, when he is now . awaiting his
' Hawse-Dios—Coroner Ale:ender yesterday
held an Inquest on the body of a min named
James P. Uurdocb, of Palestine, Ohio, who was
found yesterday mewing lying in the west near
the Win in an insensible , condition. Ho was
muted into the engine house wad died in a few
minutes. 'Physicist's examined the body and

posure, he being at the tile staining from a
