The doctrine cioollplaid down by the Jour. •ves; that where it is impossible for all the vo ters in a district to poll their votes within the legal time, it is the duty of the naturalised voters to stand back and let the native-born vote first, even to their own diefranchisement, is not only emblimely impudent, but prepos terous in the extreme. Nem J/11111111I.—Tbe Newark Mercury has been for more thin a year past an earnest and active advocate of the Know Nothing organisation, and hasiaid the flattering unction to its soul that it wan thereby best promoting the anti-Slavery came. Since the late action of the New Jersey State Council, however, resolving to adhere to the National Organization, and uttering a feeble pretest against the Kansas Iniquity, the Mercury has opened its eyes to the truth and now repu diates all connection with the Order. It says : "The American party this State has taken a position destructive to Its integrity and stee -1 fulness, and it now ceases to be a power in our political contests. It will undoubtedly be ab sorbed by that Republican organisation which is consonant with the views of nine-tenths of its members; and those who childishly imagined that the tame and impotent resolutions of the State Council would satisfy the determined spirit of those opposed to slavery aggression, will soon see their complete and utter folly. A more ridiculous Impairment upon the intelligence and integrity of the people of the State was never attempted. ' In this section a Corporal's guard will scarcely be found to sustain it. The resolutions adopted by the State Connell were evidently drawn by , one who had no sincere and honest convictions of the enormity of that wrong and villainy which are engaged in the work of planting Slavery, through Missouri rut. denim, in Kansas- They seek to ignore -the whole subject of Slavery, and only protest against ,I the twelfth article of the National Platform, when they should have thoroughly repudiated it. I , They declare the determination of the Suite I Council to adhere to the National organisation, bound as it is to the pro-slavery oar of the South, and thus they have destroyed the whole vitality of their movement. They will only be potent for injury in their future action, making those who - have given them support, regret their femme. It now remains for those who are impressed with the importance of the issues before the country to join hands in a movement which shall be felt in every section of the State . The titres demand no mealy-mouthed or doubtful policy. We must meet the pro-slavery forces, which are marshalled against us, with the determination and vigor, which is necessary to win a triumph ant victory." Judge Bane is a mere District- Judge, haZing no power to determine the law, abiolutely, or to bind any one with his decisions. He is com pelled, like an other embordieshein the judicial office, tcetaki the law as it 13 laid down for ?AM by those above him ; and we now undertake to show that he has not only paid Co regard to the well settled law, as determined by the Judges of the U. S. Supreme Court,' but has set theirdie °talons utterly at defiance. And first, the Constitution dote not reoognise sieves as property at all; or in! any sense. The following is the law on that subject as laid down by the Supreme Court of the U. 8. : If slaves are considered tame of the States as merchandise, that cannot divest them of the leading and controlling quality of persons by which they are designated in' the Corustitutior. The character of property is given them by the focal law. This law is respected, and all rights under it are protected by the ' , Federal Authori ties; but the Constitution acts 'Took slash as per . and not arproperty." So, then, Judge Kane, in heating slaves property, has violated the Conititution as inter preted by to superiors. 1 , , • And second : the • character ..property" which attaches to slaves under the laws of North Carolina, does not extend beyond the jurisdic tion of North Carolina. One of the Judges of the Supreme Court, the Hon. :John McLean, in the case of Jones os. Vansan4, says: "Slavery is local In tee character. It de pends on the municipal law of the State .where it is established. And if a person held in sla very go beyond the juristifotion where be Is so held, and into another sovereignty, where els: very is not tolerated, ha become free. _ This units the cue of Mr. Wheeler's exactly ; and Judge Kane will see, if he be not Judicially blind, that the SupreMe Court to against him on both the points made by him in the Williamson cue. For his edification, and to further strengthen bur we cite to him asobles opinion of Judge McLean, in which the whole Court concurred: "The power over slavery battings to the States respectively. It is local in its character and its effects; and the transfer of slaves cannot 6a sep arated from giepower." Such being the law, as interpreted to us by the U. S. Supreme Court, howidare a puny of ficial, like this Lou, set himself up to contra dict it? And how dare he make his unauthori zed, assumptions the heels of pereggietion against an individual, as malignant as , it is cruel and illegal? Is there no remedy for emelt usurpa tions of power? It Is a little remarkable that not only Judge KANN but Judge Lewis based his action on the assumption that Wheeler's slaves were properly regarded as Property: and not only so, but this consideration ie made the basis of ell the ergo ' meet' by which Williamson is condemned and the Judges sustained. Would it not be we 4to place these learned officials in posseesion of the decisions of the Supreme Court on that guts dlon f Is it not time that both OP.them should learn that it has been decided that the Constitu tion does not regard slaves as property at all, but simply as persons The foighiess of the public mind on such a question may be excused ; but Judges are presumed to Itiow the law, and shoit.uld be ashamed to display their ignorant* of TES Vail OF THE Crt.T.—Werrakted that the American party would poll 3, votes in the late election.
