CINCUINATI. Stays Cass.—This case was appointed to come up before the Slave Commis. stoner to-dity, according to adjotuument. A new writ of Habeas Corpus was, however, applied for on Friday to take the girl from the custody of the C. S. Marshal, and the case may have been decided yeiterday. The following ere the points in the decision of Judge Yorker, on the discharge of the alleged slave on the first writ of Aaiuns corpus: let., That whenever a writ of habeas corpus '. ; was applied for by the:proper affidavit, it was the duty of the Court, and as to which it had no discretion, to allow the writ, and inquire into the cause of the caption and detention. lld. That where it:appears by the return to the writ that the person was held under procesi - of law - regularly and properly issued,- charging a person with any offence of which it had juris diction, it would not go beyond the writ, but would remand the person to such legal custody. 3d. That upon writ of Aube= ,cospus issued by the Ccurts of the State. the Court might and would look into the legality of the detention of persons held under procees of a limited States Court, and if ouch detention were found to be illegal, would grant a discharge therefrom. 4th. That to authorize the Issuing of a war Sant for the arrest of a fugitive, under the EU- Wive Slave Act, it was necessary that it should be shown by affidavit, and that the warrant should allow, that the party claimed :was held to service and labor in a State where slavery was recognised; and that while so held to. service and labor, had escaped out of such State. 6th. The warrant in the present case only re cited that the party claimed had escaped from • the claimant, and that she owed service to him in thelltate of Kentucky. It did not show--that while held in a state of Slayery in a State permitting the same, that she had escaped therefrom.: The warrant was there, fore fatally defective and void, and for such in alone, the girl was entitled to her ffisciarge. 6th. That oven if the warrant were regular, ehe was entitled to discharge upon the facto be fore the Court. The Court distinctly and broad ly affirmed the doctrine as anlmmutable princi ple of law in Ohio, that whenever a slave, by the . content of the master, set his foot upon the soil of Ohio, he was a free man, equal in all respects to his - muter, nandnopower on earth was strong enough to take him back." 7th.- That it mad That difference that the bring ing' was by the agent of the master. The old "Winslow House" with forty4ive acres was next offered.— The "Winslow House" is the oldest in the State, and the land.wis the beet on the place and in high state of cultivation. The bidding was sp i r i te d an d it w as a nt ,thed down to Mr. Porter C. Wright, hir. Webster's head farmer, at $56 per sae. A lot of good arable land containing scree, was next sold for $4O per acre. The grist-mill, mill privileges and factory buildings were next disposed of for $2025. The ' , lsland Farm," situated on Hewitt's or Branches Island; close upon the sea, comprising about one 'hun dred and forty-two acres, sold for $2l an acre. Frim this land extends the well known "Brant Reek." 'lbis "Island Farm" was a favorite place of resort with Mr. Webster, for gunning and fishing. Lot. No. 11, on the catalogue, was "all the right, title and Interest of Mr. Webster in and to the Mansion House, outbuildings and land immediately adjoining the same." The land amounted to 840 acres. The lot inchides, if we are correctly informed, the original purchase of Mr. Webster at.hiarelilleld. It -is the original "Marshfield lot j"—the other lots which were sold being those which Mr. Webster added to hie estate by subsequent purchases. The first pur chase was made by Mr. Webster in 1835. There -is a mortgage on the estate of $3OOO or $4OOO, and a marriage settlement in- favor of Mrs. W e bster, which continues daring her life time. Theexecutors, is offering the property, did not waned any title or interest to the property.— Whatever that right and title might be after Mrs. Webster's decease, and to determine which, it would be necessary to have a legal decision I through a sole $t eqoiry, was offered for sale in order to close the estate ehd give a clear title to the estate. Mr. J. W. Paige was the purchaser, at $2OO.
