WKnight and Kelly, in regard to the condition ef the Treasury, which were entirely satisfacto ry, whereon the matter mislaid over. Booth, and the defendant, . met on the 24th of October last at a tavern kept by Mrs - Bell, on the Fourth street - road Booth w". 11 ;intoxicated and-hidln his possession $4O, wkdch Brown took - - ehirge of at the request of • Mrs._Bell, promising to deliver it to llrs. Booth. The patties then left, and after taking a dish of oysters together on Wylie street, separated un Grant street. A day or two after, Booth called 'at a bitel on. Penn street, 'which Brown had - iiid was kept by him, but ascertained that itwas not the cam—and_vras informed that Brown kept a drinking. saloon on Diamond street, to which place Mrs. Booth repaired, and demanded the money. Brown did . not deny having had the possession of the motleys but stated that pro mos. to their separation. on the night alluded to, billed quarrelled with Booth, and placed the money in the watch fob of his vest. On hear ' ing this. Booth made information before Alder ' man Major, charging the defendant with larceny. The counsel for the prosecution urged a convic , tiotton the ground that the defendant was guilty .• .of constructive larceny--that is, be obtained the money with the consent of the prosecutor, but hie subsequent appropriation of it was evi dence of the felonious - intent. The defendant proved a good general character by several wit - nessm The jury returned 'a verdict of not guilty- Com. To; James Albertson; indictment, lar ceny. The prosecutor, Stewart Robertson, al leges that on the 28th of April, 1853, the de • fondant extracted $l7 in notes from the Gil of hie store, on Ohio street, Aliegbeny. - Thode fondant is a boy about seventeen years of age, and was in the employ of Mr. Robertson at the time the money was missed. - The jury return ed a verdict of guilty, and recommended the lad to the-mercy of the Court.
