The tenoning very important opinion as to the conostruotion of the Act of 1849, known as the "Three Hundred Dollar Law Act," which cumpletely reverses the practice upon it, was read yesterday by hie tionor,Cldei Justice Black, of the Supreme. Court : Hammer vs.' Freese. In the Northern M ulct. Appeal from the Common Pleas of North . umberbuol. . ' Peewee's personal property was levied on and sold. The proceeds amounted to $464,11. The defendant in the excoriate was present when the levy was made, but did not then claim that any of the goods were exempted by the Act of 1849. About the commencement of the sale, however, he demanded. the benefit of the Statute. The Sheriff sold the property, and paid the proof:vie into Court, aid the Court, on Preese'e petition, ordered.sBoo of the money to be paid by him. We are of Opinion that the debtor cannot, tin der any circumstances, entitle himself to three hundred doSereof (he money for - which per, sena! property Inns at Sheriff's sale. The Act 'pests of property, not money. It requires him to select the goods he wishes to retain. and have them appraised, 'and property thus chosen and appealeed, shall be exempt from levy and sale. This excludes the idea that, he is to have his choice between retaining the property, and de manding money out of the proceeds. There are sound reasons why he should take the goods or_ . take nothing. The law was made' for the benefit of the families of debtors, rather than for the debtors themselves, andfamilysdript of every comfort, might not be mach the better of $BOO - the pocket of a thriftless father. Property which appraisers would value at three hundred dollen, might not sell for the half of it, and if debtors had this choice, it would deprive the creditors of twice as much property as the law intended to tike from them. A convenient friend could be got to buy it In at a price far below its value, and a part.of the money award ed by the Cour t would pay for The. former laws on this subject specified the particular articles which might be retained. The act of 1849, gine the right of designating them to the debtor himself, fixes the quantity of them by their value, and points out the mode of as certaining that vaineiliut if he may be Went until after sale, - he can virtually take property - which he has not elected, to an amount far great , er than the bin allows him, and with Out apply ing the legal standard of Revalue. Such a con struction is against the spirit as well es the let ter of statute. The debtor not being entitled to money under anycircumetenoes, would have no other remedy than an action against theofficer, even if he had demanded his right, in a proper way, and been refused; but he did not make the demand here in a manner which the sheriff was beund to no tice. He did not point out the property he -elected to retain, nor ask for an appreieement. He said nothing on the, subject until it was toe Iste."l,Regalarly, a debtor who wishes to avail himself - of this act should make his election at the time of the levy; the Legislature could have meant nothieg else by saying that property' so. . elected should be exempt from levy. But he maybe in time if be demands it after it is seis ed, provided he does not wait so long that • com pliance with his request would postpone the sale. His right is clearly gone, if be waits until the sale has began. Democratic Stets Canna- I lion met here yesterday and organised by ceiling Nathaniel Wood to the Chair. There was a long debate, attended with much excitement, on the resolution opposed to coalition with the Free Sollars. Finally those opposed to the coalition retired to another room and appointed S. B. Branford temporary chairman, when it was de cided to await the notion of the regular Canaan- Son with regard to coalition. The Hall was densely crowded; upwards of two thousand were present. The resolution having been adopted. the Convention proceeded to ballot for a guber natorial candidate when Henry W. Bishop was nominated, ho having received 839 votes out cf 1182. The balance of the vote, was chiefly; fur David Renshaw and Pliny Merrick. A commit tee on Platform was appointed, who reported the Baltimore Platform and resolutions eulogis ing the Presidential candidate. The resolution offered by Mr. Bradford opposing coalition wee then reported by-the committee without comment far - the action of the Convention, when the great eat confusion and excitement , ensued. It was laid on the table by a decialth vote, whereupon somc'two or three hundred of the delegates left the Hall The Hon. Jewel; B. Thompson, otNew Bed ford, was then nominated for bleat. Governor and Charles. C Green, of Boston, and /mei W. Conway were chosen Electors at large. ' After other buinesa of an unimportant char , acter, the Convention adjourned sine die. The seceders or National Democrats organised another Convention, and appointed J. D. Brad ford President; and a large number of Vice Pie sidenta and Secretaries. A State Committee was appointed and another committee which reported resolutions against a coalition, which were ad opted with applause. Speeches were made denouncing the other Convention and a provisional committee were empowered to call a Convention of the true De mocracy if deemed expedient. The Convention was then disardved.
