W. V: Irwin, Esq., one of the counsel for the d_efend•tnt, at; peered- fiirrhim, F. C. Flanegin, Esq., f.ll- the Commonwealth. Mr. Irwin opened his ease, stating that ho brought this preliminary examination before their honors, because he did not wish his honor Dodge McClure to decide it, inasmuch as the fi nal Wit would take place before him. He con tended that every offence in Pennsylvania Is hail able with the exception of murder in the Ent de gree, and that, provided the evidence in this ease wan cot such as to render it evident that the crime was of that grade, it was tho duty of their honorer to admit him to bail. The Consti tution of Penalsylvania, 3d Ashmead, page 257, ith Watts, pare 434, and 6th Watt. and• Ber. gnat page 3il, were cited in support of this position. It could not be proved that the defendant, to appproaching the deceased, was guilty of any premeditated design totkilb if he were guilty of any thing, in attacking him, it was of ik mere talsdereeanor. lio thought that when their hon ors examines the Evidence, they would become satisfied that his client 11.01 innocent, so far as blood guiltiness woe coocerned. Let the guilty blow bo stricken by whom it might, Cochran had no-felonious participation in it. Sayer, far from it, ho had at his personal risk, and to his per sonal cost, as the fearful wound he had reccired meet!, endeavored to pret,t the deceased from Cie fatal knife Upon ar, view of the evidence, and taking into conslderatim the law as he had L olled it, he trusted that their honors would ad mit him to ball, the more particularly as unless this coalebe done, he would be consigned to on imprisonment of Lair months in the County jail, which would bring misery and ruin upon his fa mily, and perhaps utter destruction upon him self. Ile was on industrious mechanic, who had honorably maintained his family by his exer tions, and he trusted that excessive bail might not be demand ed. Tothe wealthy the amount was of but little impertanec, tot his client was a mechanic, - and the amount should be such as . world be within hit reach. F. C. Flanegin, I:sq., said that he had hadmo opportunity of being present at the preliminary examination. As he understood the case, It wan the duty of tho.relatore counsel to show that the offence is bailable, and to produce theeSti dence in the case. For-his part he would hare no objection In Mr. Irwin reading the testimony as taken before the Coroner's jury, or from any reliable sourer. as to tho law hearing on the case, he did not differ with the learned gentle man. Judge Forward would not like to decide the case without the pretence of at least two or three withesseu. Ile wished to ascertain the __connection the defendant had had with tho oth er pellet; what had taken place among them on that day; whetl.er Cochran had associated • with:them; what hooiness be pursued, and hie ukaricter. Mr: Irwin said that under the statute of Phil ip and Mary it wa. the business of the magic trete to reduce rreliminary examinations to waiting. This had been done in the present in stance by the Mayor, and Mr. Kennedy, one of the gentlemen on the jnry, bud taken notes of the evidence brought before the Coroner's In quest. Ids Irwinhere, by permission, read the evi dence before the Coroner's jury, and the Mayor, .as published in the Pittsburgh Daily Gazette of Wednesday At the conclusion, Mr. Irwin remarked that no 'past of it tead l ed to implicate his client in any prceoncerted.ienign to commit a felony, nor that to ehew he had struck the fatal blow; un the contrary it could be proved that he had sided the deceased in attempting to ward if off. It was not for him to soy who had struck that blow, hat be might ray that olient bad not, and had been wounded in endeavoring to pr event it. - This was proved by the testimony of Mr. • Caldwell, a merchant on Water street, who bad looked out of his window and saw ..one man basing hold of the deceased, and two et/len were pulling him off." Judge Forward referred to the evidence of Terrence langhran; who had seen Cochran strike the deceased first and then, together with the three other assailant. pursue him, knock him down and beat hits. From the evidence of Abra ham Greenwood, the learned Judge would infer that between two and three hours before that time; Alltehell and the prisoner had beta en gaged in a fight. Mr. William Pettifer, another of the witnesses, Pale four men kicking at .something; met the, four men:cording back, as unconcerned as if nothing had happened; they were laughing to themselves." The testimony - of Mr. Greenwood established the existence of a prelims, quarrel, and the fact of concerted action was a rational deduction • from the evidence. - Mr. Irwin thought that at best, supposing there were a concert of action among them, it was bat a udademeattor,.iind if a number of per son, attempted to commit a - misdemeanor, and one ecuimitted murder in the first degree, under the definition of the Aot of Assembly, all would not be guilty. The law only declares murder 7- committed with malice aforethought, or In the attempt to commit arson, rape, robbery•eur boo • glary, to bo murder in the first degree; if; then, • Mgt Were killed by a member of a party, at . 'tempting to commit a misdemeanor, no ono would he responsible for the death but theklllgr. 11 a man In a melee oyes a knife, his friends en. gaged in It were not responsible for that, if it • were an attempt to commit murder, it would be a different thing. Cochran struck Mitchell with his hand and employed no other weapon—was unarmed at the time; another in dividesi made use of a knife, and CO far as the evidence went to show anything, it showed that Cochran used every effort to ward off the blow, his band being nearly cut in two by the attempt Judge Forward'asked where was the evidence of that fact! • Mr. Irwin replied that Mr. Caldwell bad pros. ed It and that Dr. Dilirorth would prove it from the nature of the wound.' if Cochran had in tended to commit murder instead of astrault and battery, would his flat have been the Instrument ,he would have chosen, or a deadly weapon? Wan it not the fair—was it not the irresistible infer ease, that he had procured them to assist him. and entertained feelings of revenge and malice —that the deed had been done deliberately, pre cisely ie woe pointed out in the act of 1794.- - The gentleman /Jemmied to think that his design was merely •to whip Mitchell. He had had a fight with him before; Mitchell was aick and had attempted to beg off. That quarrel had been coded—yet it was contended that the defendant had shortly afterward, wished to inflict chaatise meet merely on a sick man—an invalid, when in company with three others, he assaulted him. One of them came armed with a deadly weapon, and although it had not been traced to Cochrane hands, yet he had probably procured and brought to the ground the man who used it. It was a principle of law that men were presumed to in tend the probable consequences flowing from their actions.. What would be the probable con sequence of an attack made by four stout men on one man, even if ho were stout, and not an invalid! The act of Assembly upon this subject was plain. If, hours after an attach upon a man, another was made by the same party, the law presumed malice, for he had had sufficient time for cooling his excite! passions, and if death resulted the jury under the circumstances would be warranted in inferring that the crime was murder in the first degree. lie (Mr. Flan egin,) had no feeling upon the subject, and had acquired all hii information relative to it from the same eources as their honors, Mr. Irwin was prepared to prove that Mr. Cochran bore the best of characters for peace, honesty and industry. Mr. Fisnegin' did not see the rolerency o each testimony in the present ease flit Honor, Judge Forward, felt inclined to John J. Mitchell, Eeq , wad' called and sworn. —Know J. A. ,Pochrati, and have known him ever ell]te he was a child; never heard anything to impeach his character until this occurrence, on the sth of July. Always thought he was a quiet, peaceable, inoffensive young man ; his buckles, is that of a blacksmith, engaged in making iron safes, iron railings, etc.; his charac ter is excellent, and se good as that of any young -man I know; never heard of his being concerned in soy quarrel. John Fox, (County Jailor) swarn—Know Jss. A. Cochran. Have known him for twelve or thirteen years. Ells character for peace is very good. His general character is ales very good. Gave had frequent opportunities of knowing him. Ile has been engaged in putting up the railings around, the Court Rome, and in ar ranging the iron work in the County prison.— Have been on the Police a long time, and never knew of hie being . concerned in anything im proper, or of his being in bad company, or of his being in bad company. Know nothing of his conviction with the accused. Wm. 11. Green, evorn—Know J A. Cochran. Have known him for three years. Have been in the police. Never heard anything against his character. /) James Callaney, sworn—Knew J. A. Cochran. About six year. ago I employed Alderman Par lainscn, of the Fifth Ward, to purchase an iron -safe for me. He went to the establishment of Mr. Cothran, father of the defendant. The defendant woo working there, and in the transaction of that business became avivainted with him. He was very attentive to business, and an exceedingly industrious, eober, quiet young man. I was perfectly astonished when I heard of this occurrence, for be is one of the best and most peaceable young - mechanics I know. James Mitchell. County Commissioner, sworn. —Am acquainted with James A. Cochran; have no great length of acquaintance with him, hut have frequently eeen..him of lute; he and his father were engage! upon the iron work for the county prison, and I of course saw him often he appeared to be a good and peaceable young man, and I never heard anything to the contrary until this occurrence. J. Herring, pediee,tlicer, testified that ho had known James A. Cochran ever since 1847 his character for peare and good order was very good, and be had never known him to n.sociate with rowdies: Mr. Irwin said l that he had numerous other witnesses present to testify to the defendant's character. Judge Forward said it was nutlet ecsary to call Mr. Cochran, Mr. Irwin said, was n husband and a father. The character of albthe aseeeiatee with whom he had mingled during hie life, went o repel the supposition that he could he guilty f a crime so foul as murder in the first degree, • crime which must he committed by one with n cry malignant disposition. lite remaining ail would ruin ' da character, and break the heart of his wife and hie aged parents. lie trusted, therefore, that their honors would admit him to hail. and make that hail as light no they could. Judge Forward. after asking whether Mr. Irwin had any other evidence to present, observed that this was a very serious case, affecting one who had hitherto horns a good character, and they would take time to re flect upon it, and pronounce their judgment this morning at nine o'clock. ARRESTED.— The Mayor's police yelterday arrested three men who gave their names as Edward Quinn, Michael Seamy and Michael Dolan, on a charge of being the parties eoncensed in the highway robbery committed on Alphonse Rinne, on Tee?- , day evening. Monsieur Rinne thinks he is able to recognise Quinn ea the man orbs assaulted him first. A pair of pantaloons claimed by the former were found in the possession of the latter. Mon. R. also rays that the voices and figures of Kearney and Dolan closely resemble those sof hie other assailants. The Jammed assert that they are innocent, that they have but recently come to Pittsburgh from Snodgrass' Section on the Penn sylvania Railroad, near Greensburgh, where they were engaged as laborers, and that they can account for all the money found in titeir poe- They further sllege, that on the night in quee• tion, they spent the evening and night, from eight o'clock until morning, in a house out the Fourth Street Road. Quinn claims the panta loons as-hie, gives the name of the tailor who made them, who resides near Greensburgh, and .deolarse that if they were his, hie name writ ten in ink, would be found upon the lining. fln examination, a name, so faded and discolored by nee that It could not be decyphered, was pointed out. Cour on SOLEIL .—llenry Barthirk, a Ger. man, who bad arrived in this country only a few weeks ago,. and who was assisting some brick- layere6ent the Perrysville Plank Road, four miles from Pittsburgh, suddenly dropped dead yesterday afternoon. The Physician who woe celled in, found him dead on his amid's!, and stated that ho died from the excessive heat of the weather.
