After the organliatlon of tfie Court, Judge McClure ■prooeodoJ to deliver the following CHARGE TO THE GRAND JURY: GSHTI.IUBN: —Opop the 14th of April last the Legislature of Pennsylvania passed a law enti tled “ an Anfrto restrain the sale of intoxicating liquors.” X shall advert to some of the main features Of tblß highly important law, whloh takes effect this day, October Ist, 1855. It ropealsall laws and parts of laws iuconsis ■ tent therewith There are existing laws which are not inoon eistent therewith, but auxiliary thereunto. Buoh laws are not repealed, for example, what is known by the name of the Sunday Liquor Law, also, the aot of 1854, against fnruißhing intoxi cating drinks to a person of known intemperate habits, and laws of kindred obaraoter. This law Is partial prohibition of the tramo ; and total prohibition under the measure of one quart, and the oourts of this Commonwealth are expressly forbidden to grant any license to sell at all, by any measure great or small, to the keeper of any hotel, inn, tavern, restaurant, eating house, oyster house or cellar, theatre, or other plaoe of entertainment, amusement, or re freshment, and the power to lioense heretofore existing in oity and county treasurers in this be half is taken away. However muoh honest men may differ as to the expediency of a law before it is passed, no man can refuse to yield obodienoe when it has becomo the law of the land. There is an immense difference between the dutios of the cititen and of the Court, whioh all men should bear in mind. . It is the easy and passive duty of the oiuzan, and the easy and paasivo duly of eaoh member of the oourt, as oitizons, to oboy the law. But tho oourt, as a court, and as men oom -posing it, are bound under the tremendous sano- Uon of a-solemn oath to administer the laws of <tho land, and this is one of them. _ This oath is reoorded in t-.e Recorder's office, Sftd no honoßt and fearless magistrate can for one momout oeaao to remember that it is also reoorded olsowhoro, in oharaoters that ooduro fforever. This law we shall administor—without fear, -without favor, and without afleotion. Every man should pay a decent respect to tho opinions of others, although they may differ from his own. Every man knows that popular sanction adds weight and diguity to law itself. In October last the majority in Allegheny oounty in favor of total prohibition was between six and seven thousand votes. Tbe voioo of Allegheny county was in its be half, more loud and overpowering lhan that of aDy county in this Commonwealth. Io this looality, at least, the law has had an overwhelming and solemn reoorded expression of popalar ss otioa. If done contrary to tbo provisoes of this law the following are violations thereof: It is a violation of this law to koep or main tain any house, room, or placo, where vinous, spirit nous, malt, or brewed liquors, or any ad mixtures are sold, or drunk. It is a violation of this law, to keep for sale, end Bstl, or In connection with any other bust ness, or profitable employment to girt, receiving therefor any price, profit or advantage, by any measure whatever, and at the same time volun tarily to afford a plane, or any other convenience or Indnocment, by wbloh any intoxicating drink or any admixture thoreof may be nsod as a bev to aid, abet or assist therein, is equally violation of tho law. Itis-a violation of tho law, for two or moro • porsoon to oooßpire, or act together, with intent , to evade it, by whioh one may sell and the other .provide a plaoe or convenience for drinking It Is a violation of this law for any person to .sell or keep for Bale Bny vinous, spirituous, .malt or brewed liquors, or any admixtures -tberoof. It is a violotion of tbo law to sell spirituous, -vinous, or malt liquors, contrary ,to tho pro -visions of tho aot. The law is framed in such a manner as to prevent all ohanoes of escape by any pretext, | evasion, devioe, or ingenious oontnvanoe Tbo .perfection of this feature in a new and lengthy •penal law is ver/Temarkable. This law is a working moohlne, a praotioal -thing, and the wisest and oheapest way to treat ■it, is to obey it. . They are “giving, and “reoeiving &o advantage” in return for thj legislature intended utterly to abolish ell eroe shops, and tippling booses, and dnokiog rosorte ; it intended to mnoveUhe temptations that beset trail men at every turn and ooroer The legislature well knew that drinking is a so cial habit, and know well also tbo powerful moral restraints of home. The law prohibits furnishing a plaoe, or other ooovcmenoo for drinking. Men do not got drunk in presenoo of their families ; for that melancholy purpose they always go elsewhore. There is no tyrant more exacting or unrolouting than fashion Time out of mind in this country, it has been the fashion to •• stand treat.” Let the social oompany con sist of few or many, eaoh treats in turn, and each must drink or give offence, and in this ut ter disregard of differed oapaoity for drinking, or ability to bear it. The fashion is cruel, an equal, and absurd ; this faslan has slain whole hecatombs of men. One man may carry without iooonvenionce what will drive another mad. The legislature has taken deliberate aim nt this fashion, and hit it. Almost ovsry term of this court proves that .some victim of this fashion wakes from his de lirium in a oelt, to be told that he is in jnl awaiting his trial in tbo Oyer and Terminer, tor aome outrage oommlUed by him, which he can not even reoolleot. , The Courts of Quarter Sessions are authorized to grant lioenses to citizens of the Uoited States if temperate and honest, to sell by the quart or greater measure, they advertising in the modo formerly prescribed for taverns, but the oertih eate of twelve men to vouch for oharaoter, and the necessity of tho plaoe of sale, are not rc- a license Is granted the recipient must rive bond, With two sufficient sureties, in the of one thousand dollars to be approved by of the oonrt, conditioned for the faithful observance of all the laws of this Stale relating to the business of vending snoh liquors. The seotion containing these exceptions must ] be interpreted by the oourt in aooordance with the spirit and true meaning of tho law, and the plain intention of tho Loiislatnro. To import and sell in paokages of a gallou or a quart would be retailing, and a violation of tho law. . , To auotion off by publio ontory by tho pint or quart would be a violation of tho law, from the oonseqnenoes of which tho auctioneer a commis sion would not protect him. The distiller and brewer aro authorised to soli by the five gallons or larger measure thoir owu domestio produot or manufacture. To eell for eign liquors, or domestio not manufactured by themselves, would be a plain infraction of tho law. The “ rectifier" is not B prodnoor or man ufacturer. , , As regards tbs druggist, the exemption only applies to mixtures made in good faith in medi oine to be administered to the siek.
