DAUSIE.—Dear Sir :—I harejust seen a copy of the Harrisburg Union, containing Arlet, ter from Mr. Vnscu, With an approbatorynotice by the editor, affirming the right of a majority of the Legislature to-re-assemble in Convention on the first Monday of Ootober, after, an indefi nite adjournment of the two Homo for the pur pose of electing a Senator. _ - I do not feel that I have any eepecial concern in this matter myself. It strikes the, boweier, that there is a fallacy in the argument—and as the highly respectable character of the author may give it a currency which may potsibly 02- poso on others, and be in the end productive of mischief, it occurred to me that I might be per haps excused for making it the subject of a few remarks, which it seemed to me very fairly to The argument rests on the distinction between the Legislature assembled in joint Conventieh to elect a Senator, and the same body sitting , in separate Houses to enact laws. It denies that these bodies have anything in common exQept the personal and official identity of theirje• spective membere. It asserts, moreover, -- that the "Legislature" referred to in the elatitie of the Constitution, bestowing the , power of eleo. tion, is ono thing; while the Legislature, which is authorized to prescribe the time, place and manner of election, is another. It is not to be questioned that the powei of election is not in its nature a legislative power ; and that when the Legislature is engaged in k its exercise, it is not performing any of the..pr dinary functions of a legislative body. It 'does not, however, follow that there is any difference between the two bodies arising out of the diger sity of functions, or the different modes of pro cedure adopted in the two cases. They are and must be essentially the same. If they are hot, the consequence ensues by the strictest loghuil necessity—that the body in Convention has no power of election at all. The authority is epn ferred by the Federal Constitution on "the Leg. islature" only. The Legislature is only another term for the law-giver, or the power which makes the laws. It might be held to compre hend even the Governor, but for , the uniform an universal usage to the contrary. It is elVar, however, that the Legislature cannot delegate the power to any other body, or even to Ruyan dividual member of its own body; whether. it can properly delegate it even to a joint conven tion of its own members, or exercise it in tiny other way than by the concurrent action of the two houses, sitting in separate.apartmentsi,al a Legislature, has been doubted by the ablest law yers. The late Chancellor Kent regards the practice as defensible only on the footing of long acquiescence, "although I should think," be says, "if the question was a new one, that whEn the Constitution directed that Senators should be chosen by the Legislature, it meant not.,the members of the Legislature, per capita, but . tha Legislature, in its technical sense, being the'itbo Houses acting in .thew separate and organized ca pacities, with the constitutional right of negative on each other's proceedings", 4 Com. 22. And, he adds, that this was a contemporary expoel tion of the clause in question, and was particu larly maintained in the well known letters of the Federal Farmer, who surveyed the constitution with a jealous and scrutinizing eye. Referring, however, to the practice, it seems sufficiently clear that it is only to be sustained upon the hypothesis which the argument of Mr.- Veech denies, that the joint convention is, in substantle and point of fact, the Legislature. The distinction which he asserts between the same Legislature as applied to the election and the identical term as appliedlto the mere matter Of regulation, is unwarranted by the Constitution, as it is by any rule of construction with which lam acquainted. Its unsoundness id, however, illustrated by himself in the suggestion that:Zhe Legislature, in its elective capacity; " acts as one body, and would be a perfect body if every Senator were absent." It may be possible that the body would 1301,8 rerfeet one, under the law , in the - case which' he has supposed. If it be, however, then it is clear either that it is an unconvitutionaktody for the ,purpose for which it was designed, or that. the power to elect may reside in a body whit:Ail:3 unquestionably not the Legislature, because it id deficient in one of the constituent and essential elements. It cannot find its way there; how ever, except by delegationowd if it may, ,by virtue of the law which prescribes the manner of election, then it resolves itself into a case of delegation of a power which cannot be delega ted, and the law itself is set up in the place of the Constitution. Mr. Veech seems to have leap! ed more to the former than to the latter. There is a point, however, which ho has over; looked entirely, that touches the hew itself; and seems to have no doubt in regard to-tha under. standing of its makers. The act of Assembly which prescribes, i r pursuance of the Constittp. tional provision, the time, place and manner of election, refers to each of the two Houses as an independent element in a state of complete or ganization, antecedent to the election, and pro vides expressly for the entry of the certificates of the result (at a period subsequent of course) upon the Journals of both of them. Mr. Vixen, in his endeavor to distinguish between the Con vention and the Legislature, and to show by con sequence, as it seems to me, that the formee have ncrpowcr at all under the Constitution, as-, sects that ~ t he Journals of the two Houses show no record of the doings of the Cpvention" what- This se3erlion is an inference, and a necessary one, from his position, that the mem- .
