BATS HE OXLT FOLLOWED A PRECEDENT Theodore Myler, Assistant Postmaster of Allegheny, was given a hearing before United States Commissioner McCandless on a charge of embezzlement The only witness examined was Mr. Myler. He said he had been appointed Assistant Postmaster in Allegheny on July 1, 189L Previous to that he was a clerk. Speaking of the 5100 he is charged with taking lrom Miss Steele he said: "That money was taken for the purpose of making up shortages in the Money Order Department in which she was a clerk. She had paid out the money in mistake." When asked whether that was not more than the amount of the shortage he replied, "I never received a cent of the money for my own use. I know there was more than 5100 in shortages. I remember of one short age of 515 and another of S4S. It was paid out by mistake and never returned." At the time the money was taken from Miss Steele the witness was not Assistant Postmaster, but was acting in the capacity of cashier. Miss Steele took charge ot the Money Order Department when the witness was appointed Assistant Postmaster. Mvler continuing, said: "Xone Mr. ot the money taken was used shortases while I was for in the Money Order Department, and when the ?1W was lasen irom .una oiccie iucib was no intention to defraud the Govern ment. There was a continual shortage in this department. It was all caused by mis takes and carelessness in paying out money. Of course these mistakes occur in most postoffices. Unless this shortage was paid up by money taken from Miss Steele we would have had to make it up. What was taken was simply a redaction in Miss Steele's salary as they had concluded $700 a year was enough for her." The case was argued bv Mr. McMullen for the defendant He took the ground that fhe statute under which the information was made applied only to the Internal Revenue Department, Mint and United States depositories and not to Postofice officers or employes. Outside of this no intent to commit a crime was shown, and the defendant had only followed a pre cedent As soon as it was discovered that the department did not like the transaction the money was returned to Miss Steele, so that no money was lost by anybody, and, above all, there was no intent to cheat or defraud the Government District Attorney Lyon simply asked that the testimony be considered, and if there was sufficient grounds the defendant be held for trial.
