Commissioners "Want Legal Advice Before Tailing of It THE BOARD'S ACTION MUST BEKEYERSED It was reported yesterday that the bonds men of ex-Warden Berlin, of the county jail, would be called upon to foot up the bills incurred on account of the escape of Fred Fitzsimmons. Investi gation proved that nothing definite in this matter, but that there had been some talk about it. Several members of the Prison board'have thought of the question and decided to secure some legal opinion on it The expenses necessitated by the efforts to capture Fitzsimmons were rather heavy. An immense amount of advertising, with circulars and photographs to the number of 30,000 has cost considerable money. Should the fugitive be captured the amount will be swelled by the f 1,000 reward offered. THE BOND GIVEN TOR FAITHFULNESS. Countv Commissioner Mercer when tpoken to produced the act of Assemblyprc viding that the Warden furnish bond in the sum of $20,000 "for the faithful per formance of his duties.' "The question," said Commissioner Mercer, "lias not been discussed by the Prison Board. If, however, it can be proven that the Warden was responsible for the es cape of Fitzsimmons and a jury can be brought to f-ee it in that light the county might recover on the bond. Count- Commissioner AVeir agreed with Jlercernndi-aid: "I do not tee what the lond is given for unless it is to cover such cases. But 1 would rather not discuss the matter without first getting au opinion from an attorney. Since it would be necesary to prove ex Warden Berlin responsible for the escape there i not much prospect of the county getting any return tor its expense. When Berlin tendered his resicnatiou the Prison Board, by unanimous resolution, exoner ated him from all blame in the matter. They had testimony from both sides of the case and made their decision on it. There is little probability of their find ing being reverse-! PRISON BOAKD MEETS THIS 2108311X0. A s-pecial meeting of the Prison Board lias been called for 9 o'clock this morning, when, if the judge-, will attend, Keeper Price w ill be given an opportunity to ex plain away the charges against him. Several members of the board are desir ous of having it settled and done with. The reason they cive is that if the charges are true Warden McAleese should not be hampered with incompetent or untrust worthy men for a moment longer than is necessary, ana he should be given permis sion promptly to make such changes among his subordinates as he may deem necessary to the high class of discipline he desires to Utain. It is also argued that the responsibility for making these changes should propcrly oe assumed by the boaid, and not by the .varden, who, however, will not hesitate in 3is duty if the board should fail to take iction in that direction.
