SATCEDAT WITfl THE CEIlIIX.iL JUDGES In the matter of toe petition of citizens of the Twenty-first ward for the removal of the School Board, consisting of George "W. Mc Neil, S. W. JeffrieS, A. H. Edwards, John Griest, R. AV. Thompson and J. H. Coot, an argument was made yesterday before Judge Stowe The petitioners stated that the School Board Sad divided the ward and compelled children living outside an imaginary line to go to a certain schoolhouse located in the further end of the ward. The board thus created a sub-district, and, it is claimed, UMirped the rights ol the Central Board of Education. The answer of the School Board was filed xeslerday. They admit dividing the ward, but state that it was done to create hctten school facilities because of the overcrowded condition ol the main school building. At the opening of the school term there vas an enroll ment if 1.133 pupils in the Lincoln school and but 9oSeat- in rooniNn. 1 there were 176 cluluif n, and tne mom had a seating capacity ofbutTO. Children were thus compelled to sit on the floors and recite in the balls. It finally became necessary to divide the pupils injlie, room. allotting one division to attend in the morning aud one in the afternoon. This ren dition anr .ed to all rooms of the school. Stockholders of the Sewickley Dairy Com pany Ask for a Receiver. A bill in equity was filed yesterday by the Bank of Pmsburg,tbe Fidelity Title and Trust Company, the Iron City National Hank and J. B. Keno. assignee of Fleming Bros., against the Sewickley Dairy Company, S. A. Duncan, as signee: Louis Irwin. President: James M. Bell, Treasuier: George Wood. J. J. Shaw. North West and W. J. Sawyer. The plaintiffs state that they hold about 2,000 shares of stock in the Sevuclvley Dairy Company, all of .which is Jullypaidup. The balanco of the stock is only about three-fourths paid up. The company on January 3 made an assignment to S. A. Duncan, who was .secretary of the co- ceni. withoutl any notice to the plaintiffs The indebtedness was about $SO,000, 533,000 of wiiich is a mortgage 3nd $47,000 floating indebt edness. The indebtedness, it is stated. as created bv mismanagement on the part of the oflicers. The assets consist of 2,500 acres of laud near fcewickley, lue stoct, etc. Prior to January 3 judgments were confessed tn the following persons: J. M. Bell, S9o6 34, E1.1B2 91, (112 41: Louis Irwin. Executions were issued on the judgments aud the Sheriff is now about to sell the property. The judgments, it is claimed, were fraudulent and were to give unjust preference to creditors who were directors, aud they should be de clared void. It is claimed that Mr. Duncan,tbe assignee, who is one of the creditors, wants to sell the pronertv without collecting the unpaid subscriptions on the stock. He issued an execution practically assigned to himself, and is in default as a subscriber, and in conse quence is not a proper person to act as as signee. The Court is asked to dismiss Duncan as assignee, restrain the defendants from sell ing the property at Sheriffs sale.andto appoint a receiver to take charge of the company's pi open v. She sets forth in her affidavit that on Decem ber 14 last, Mr. Gusky promised thaton January 1.. esterdaj. he would, in the language of Adam, or nearly so. make her bone of his bone and flesh ot his flesh; that the declaration was made at her home, in McKeesport, in the presrnceof witnesses, but that on Wednesday nigbtlast he repudiated the contract. Miss Berkowiu wants 45,000 damages. BAYS HE DID "V70BK. Alex. McGannegle Goes Into Court to Draw His December Salary. Alex. JIcK. McGunnegle yesterday filed a petition 13 Common Pleas Court No. 1 asking for a mandamus on County Controller Grier to compel him to pay McGunnegle bis salary of (100 tor services as a clerk in the Clerk of Courts' office dunng the month of December, which was refused by the Controller, who al leged that McGunnegle did no work. the petitioner claims that during the whole ot the month be faithfully pel formed his du ties. Controller Grier. however, would not ad minister the oath to him and would not coun tersign the warrant for bis payment. The Court issued a rule on the Controller to show cau-e why the writ should not be issued. Next Saturday was fixed for a hearing. ANn-LOITEBY LAW VICTIM. Tho Tint Case of a Man Who Used the Mails. The first suit tinder the new lottery law was brought before Commissioner McCanaless, yesterday against a young man named J. F. McKIbben. It Is alleged that the defendant sent a letter through the malls inquiring about a lottery. The defendent admitted sending the letter, but stated at the time, September 29th, be did not know or any anil-lottery law, which had been pissed only a few days pre vious. McKibbon was held In $300 bail for a 'bearing. Mr. Lyon as an Oleo Dealer. la the United States Court yesterday District Attorney Lyon asked for the forfeiture of 12,- 4SS pounds of oleomargarine, valued at $216 10, belonging to the Keystone Butter Company, and 34.060 pounds, valued at $3,169 61. belonging to the Western Butter Company. The goods were seized by Collector Warmcastle, who Is anxious to dispose ot them. Brewing Companyln Trouble. James McKay yesterday issued an execution for $27,429 9S against Joseph and Maria Spen cer. with notice to the William Tann Brewing Company. The Allegheny National Bank en. tered suit against Joseph Spencer and William Tann, to recover $4,000 on a promissory note given December IS, 189a Minor Notes of the Court. Suits for divorce on the grounds of deser tion were entered yesterday by Isabella Potts against John W. Potts, and Charles F. Eberle against Eleanor Eberle. Ox petition ot citizens of McKeesport the Quarter Sessions Court yesterday appointed polling places and officers for an election to be held in February, under the new charter as a third-class city. Judoe Stowe, yesterday issned attach ments for the arrest ot John Laban and Otto Kamm. for contempt Of court Laban had been ordered to pay his wife $35 a month, and Kamm to pay his wife $10 a mouth, which they neglected to do. In the snit of John and Anna Bettejewskl against J. McNulty and J. T. and M. L. Brown to recover damages for the death of their child, who ws killed by a stone counter toppling over on her, a verdict was given yes terday for $14U 50 for the plaintiffs as against J. T. and M. L. Brown. Judge Over yesterday handed down an opinion in the Goo estate case, which states thitsolongas the legacy remains in the cus tody ot tho executor it cannot be seized npon an execution attachment by his creditors. A Budget of News From the Schoolhouses and Board Booms Fire Alarms In the Buildings A Division Institute Next Saturday. Yesterday the night school teachers received their warrants for their salaries for the term of night school just completed. The amount of the pay roll is $3,436 25. It is a well-known fact that the night schools are not as efficient as they ought to be, and next year there is a probability that some plan will be brought for ward to have all the local boards act con. ccrtedly, so as to have the night schools more profitable. Occasionally some wild youngster comes to enroll the first night and gives a fictitious name. The following night on his arrival be will enroll again giving his own name. The teacher is not able to recog nize all the strange faces at once and she does not know how she is being treated. This class of pupils will only attend a fow nights, bnt it brings the enrollment very high, and the per centage will not be one-third. Prof. J. K. Bane, of the St. Clair, a principal of much solid ex perience, will endeavor next year to have this plan earned out at the night schools in the Twenty-seventh ward: "No pupil shall attend who has not a written permit from the school board stating that he attends for the purpose of tuition and also signed by the parent or guardian of the applicant who are also willing to be beld responsible fo.- any damage that the pupil may do to the furniture or building. In this way pupils who come simply to have a good time will not have the liberty to enroll at all. Mr. E. Ketchum, of Providence. B, L, writes to Superintendent Luckey asking if there Is not a system of false fire alarm in use in the Pittsburg schools by which chit area are trained to leave the building rapidly. There have been a number of destructive fires in Providence of late and one occurring in a large school, fortu nately on Saturday. There has been much talk in consequence of tho need of having a hre alarm counected with each school building. All the school buildings in Pittsburg are pro vided with fire escapes. The State law calls for this, but previous to the adoption of tho law the scnools had a fire alarm drill, which was considered in many cases superior to the present way of getting out of the building by the aid or tire escapes. At some buildings this drill is a feature at "reception days" yet. Architect Bailey will have completed by Tues day the design of the new building which is to be erected for the Allen School, Thirty-first ward. It is modeled after the plan ot the Wil kinsburg Public School. Efforts will be made to have 20 school-rooms in the building ready for school purposes by September 1. The build ing is to be so constructed that a mansard roof can be added, so that in time the Allen School building will contain 30 rooms. This ward has built up very rapidly of late, and the need of a very large building is most necessary. The board met last evening to elect a teacher. The circular asking the assent of the ward people to increase the assessment 1 mill will not be Issued till next week. A Division Institute, to wbicb the principals and the (teachers ot steps I, 2 and 3 are invited, will be given at 9 o'clock next Satur day morning at the Miller street building, A class drill will be given by Miss K. H. Fnnden berg, of tne Osceola School, Twentieth ward. There will be no pupils in the class who entered school prior to September. 1S90. The pro gramme will be varied, and consist of the fol lowing features: Music motion song, 'Our First Talk on Flowers." oral language, gym nastics, reading, written language, motion song, physiology, number, observation and imagina tion. Miss Ida McClure was elected last Tuesday to fill the vacancy in the Moorbead School caused by the marriage of Miss Dietrich. Prof. Rinchart's Saturday normal class m music for the teachers is starting with excel lent prospects. The next drill will not take place till the 31s( lost, on account of the insti tute called tor next Saturday. A class of 75 pupils will graduate from the Public Cooking School Saturday, January 31, and the happy young maidens have already tabulated the number and kinds of dishes with which they will feast their friends on the great occasion. Miss Nannie Pollock, of the Peebles Schools, was the bead promoter of the gay euchre party which surprised her sister Maud, also a teacher in the O'Hara School, on "the occasion of her birthday last Friday evening. Miss Maud was the fortunate winuer of the first prize. Every year the State Department 'at Harris burg sends 400 or 500large and rather un wieldy register books to the office of the Cen tral Board of Education, for which they have no use, as most of the Pittsburg school boards supply the teachers with the neat and small form of books for the enrolling of pupils. There are now 200 or 300 of these register books on the, officers' bands at the Central Board and they will soon cet their yearly supply. They are too large to be used conveniently, and are for country dis tricts; and, though tbey are a burden, the fun loving trio of officers of the Central Board have a good time in trying to palm the books off on the principals and the teachers. One lady principal sent last week for four of the books and four boys to carry them. Eighteen were sent her. If she bad sent six boys she wonld have been sent 40 books tbey told her afterward. When a request comes for one book the answer is: -They always go in pairs." The closing exercises of the Washington sight school Friday evening were very- en joy able. There was mnsic by the Misses Macin tosh. Lindsay and Fauble, readings by the Misses Myra Johns and Martha Irwin, and reci tations by Miss Nina Milligan. Messrs. George Seebickand John Fox addressed the pupils. The entertainment was under the direction of Mr. John Fox. the Central Board representa tive of the Seventeenth ward. Battery B.' Fair. The members of Battery B have decided to continue their fair on Wednesday and Satur day evenings as long as it proves profitable. So far about $600 has been netted above expenses and the prospects for the new uniforms are good. It Is probable that in the near future Captain Hunt will issue -an order discharging some of the members of the organization and materially effecting the standing of some of the others. The trouble is duo to the conduct of the men, who have been using the State property for improper purposes and making themselves generally obnoxious to the com mand. A court martial, while, as a rule, an un- desirable phase of soldiering, would evidently be productve of some good in the battery.
