The Charge ot Judge Graoget Criticised as Favoring tlio Accused Gofislp About the Defendants. At last the great Malley cane is ended. State's Attorney Doolittle did not close his powerful argument for tlio state until about 3 o'clock Friday afternoon. He charged 1 La .accused with murder in the first degree ; showed that the motive was sufficient, and that the state had proved its case beyond a reasonable doubt. Judge Granger, after a short recess, be gan at 3.-05 his charge to the jury. He said the accused wore on trial for murder by poison and not for rape nor telling lies. Ho continued : "You will consider care fully how this girl came to her death. You want to bo satisfied, in the first place, as to tlio cause of death ; if you have any doubt about it, the law gives the prisoueis the benefit or this doubt. The state claims there is positive evidence to show that death did not result from drowniug, while the defense claims there are enough evidences of drowning to at least raise a reasonable doubt. Then you have to consider whether she died of arse nic ; whether the quantity taken was sufii cicnt to cause death. Then you arc to consider when, where and by whom the arsenic was udministcicd. All these are vitally important matters. Circumstan tial evidence is to be relied on, but all the circumstances must correspond ; all point in one direction. If there is any theory which cau reasonably account for death on any other hypothesis thau that which the state placed before you it must bo ac cepted. You know, gentlemen, how diffi cult it is to fix the question of the identity of a poison. If the circumstances satis factory pioved constitute, when grouped together, ovidei.co equal to that of two witnesses, it is jour duty to find a verdict of conviction ; if you are not thus im pressed you may find a verdict in the sec ond debtee. This is within your power under tin: Jaw ; but it is claimed, and I concur, that this is cither a case ol mur Jer in the first degree or none at all. SVith these remarks 1 leave the case in your hands." The chargo was twenty-five minutes long. At 3:30 the judge handed the in dictmcut to the foiemau of the jury, and sent them to their room. The prisoners grew nervous, aud their friends expected a verdict of acquittal immediately. It did not come, but in about five minutes Juror Ilobcit O. Gates created some excitement by appeal iuc at the door and asking for a doctor. It appeared that Juror Hotclikiss. of Bethany, bad a fit of vertigo. A eon stable carried in a pitcher of water, and the juror began to improve. Then the court room resumed its customary appearatice. Blanche ti ied to indicate her carelessness by reading a newspaper. The Mai leys chatted with their counsel aud relatives. At 3:40 Shcrifr Tucker took to the jury room the big map of the West Haven Shore used on the tiial. The jurors were evident ly fixing tho Shore locations. At 4:30, afte: being just an hour out, the jury returned with a verdict of acquittal in tlio cas.es of all three, James, Walter aud Blanche . A miumur of applause swept through the court room, but was promptly check ed. The boys were congratulated by friends and relatives; their aunt k'ssed them. Blanche also had her friends, who crowd ed about her. The prisoueis at once Ielt the com t room. Walter Malley, especially seemed to be in a hurry. Tho whole family consider this acquittal a vindication of their characters and a condemnation of the accusers. Mrs. Cramer denounces tho whole proceeding as unjust, aud tho West Haven authorities aie still confident that their course was the only one they could have consistently pursued. Whether Walter and James will remain in New Haven is not positively known, but it is supposed they will once inoie handle their father's and uncle's dry goods. As for Blanche, after being cared for by her counsel and otheis, she will probably return to New York. The ver dict has not cieated very great .surprise in this city, for nndt r the later develop ments, or lack of developments, in the case a disagreement was the worst result anticipated.
