There has been very little done in Lan caster during the past week except that a geed many previous purchases have been . delivered, and that packing gees en briskly at most, of the warehouses. A geed many leads of the leaf brought te town during the week were refused en the ground that they were net put up according te con tract. Very few buyers are new in the Held, many of the country reads being miuukcu up wiui suew, maiung travel upon them very unpleasant. It is estimated that fully one thud of the crop remains unsold. This morning before Alderman McCou McCeu McCou eray was heard the case of Kerb3 & Spiess against Adam Smith for damages incurred by the plaintiils by the failuroef the latter te deliver a crop of tobacco, purchased by one of the plaintinV agents. Defendant acknowledged that plaintiff bought the obacce, and that he sold it te another dealer. Iiis defense was that plaintiff would net receive it until the holidays. As there was nothing in the contract as te the time when the tobacco was te be de livered, the alderman gave judgment for the plaintiff in the sum of 625 and costs. Mr. Daniel Mayer, manager for Kerbs & Spiess, brought the suit net for the amount of less sustained, but for the pur pose of letting tobacco growers knew that they must fulfdl the conditions of their contracts. A LANCAsTEK MAN'S MONfck. Alleging That linnke Operation!) Secure Ella CliecK, Upen Winch Mult is Brought. Pldnbutelphia Times. A .suit of Jehn W. Green, against Janus I'. IVitchett te recover the value of a check for 102 was called for trial yesterday Jiefere Judge Ludlow. Green says that Te leceived the check for value given, but that payment was stepped at the haul: and Pritchclt himself refused te pay it. The latter, in his affidavit of de fense, aveis that the check was ob tained by a buuke operation from Isaac L. Bacr, of the firm of Baer Ac Bre., te whom he gave it as a business transaction. Mr. Baer, who is of Lancaster, was approached while in this city in July, 1880, by a man who said that he had just come from Washington, where he had wen five hun dred dollars iu a lottery. He induced Mr. lj.ier te visit a heuse somewhere in town he thinks it was in Decatur street and join in a pleasant game of cards. After playing a little while Baer was delighted te lind that h had wen 8500. Before he could have it, however, he was obliged te pay something iu the way of commis sions. He accordingly planked down Pritchett's check. Soen after that he was told that his winnings amounted te i,000. .Mere commissions were expected. Baer, who had very little cash, hurried around te Pritchett's effice te borrow some. The latter who had been in from the country for several years, knocked the bottom out of his friend's exultation by alleging thai the gain was moenshino and the playeis very substantial swindlers. Such, 1'ritchett avers, turned out te be the case and the operators get off with the check. Pritchclt paid the check, he claims, te Bacr, receiving a bend protect ing him against less iu se doing, and pub licly gave warning te the public in regard te the check. He says tnat the check was traced te two or three persons but he can not imagine hew it came into Mr. Green's possession. Court of Common Picas. HEFOItE.IUDGE LIVINGSTON : Dr. Themas B. Cox vs. Henry Kraber, administrator r. . . of Margaret Bier, de ceased. This is an action te recover v $926.00 pay for medical services rendered Ttlie deceased by the plaintiff during her lifetime. Miss Bier for many years re sided en Seuth Queen street and was always iu delicate health. She died iu May, 1881, at the advanced age of 80 years. The plaintiff occupied a portion of her house as an office and was her phy Mciau. He attended her from August, 1S79, te May, 1881, especially in the latter year, when he visited her daily, and claims that he was net paid. Te recover the money this suit is brought. The defense is that the plaintiff's bill is tee high by far, and it is claimed that he did net make as many visits as he claims en professional business, but that he often dropped in te see the deceased te chat with her and then charged for it ; that a settlement was had between them up te November, 1880, since which time only they admit they ewe him for professional services. The jurv found in favor of the plaintiff for 8507. Iu the case of Jacob Rccser vs. Jehn N. Plank the defense amended their plea and the plaintiff plead surprise, where upon the case was continued. r.r.Fenc judge iwtteksen. Aaren Mehaffy vs. Henry S. Hcrr. This was an action of replevin te recover a let of tobacco valued at $27C. According te the plaintiff's testimony it appeared that Jeseph Hcrr obtained judgment against Aaren Mehaffy for $100. He had exe cution issued and the tobacco in question was sold by a constable. Henry S. Hen- was the purchaser at $5. The tobacco plaintiff alleged belonged te him exclu sively. The defense was that the tobacco in question belonged te Aaren Mehaffy and as such was levied upon, sold and purchas ed by Henry S. Herr, the defendant. ACCIUENTS. Philip Wallace, a brakeman en the engine Union en Heading railroad, while coupling cars at Junction this morning had three of his fingers se badly crushed that they will bave te be amputated. Feltz was caught between a car and the wall and very badly squeezed, and it is feared his shoulder is broken. He was taken home and a sur geon summoned te attend him. II. B. Rogers, brakeman en extra en gine 314 west, while en the top of a car was struck by an overhead bridge 'near Bryn Mawr about 12 o'clock last night. Trains from New Orleans with excursionists te witness the prize fight between Patrick Ryan, of Trey, and Jehn L. Sullivan, of Bosten, arrived here between 10 and 11 o'clock this morning. Tha pugilists did most of their training in New Orleans and en the line of the Mobile railroad. Ryan's height is 6 feet 2J. his fighting weight 190 pounds. Sullivan stands 5 feet 10, and weighs 175 trained and in condi tion. Charles E. Davies, of Chicago, rep resented the interests of Sullivan's backer; McDonald and W. E. Harding represented Richard K. Fex, Ryan's backer. Among the backers of Sullivan arc James Keeuan, Ed. McEvery, the Bosten athlete ; Joe Gess and Wm. Emmett, of Chicago. Champien Harry Slade, amateur boxer of England ; Joe Oess, ex-champion pugilist; Billy Madden, Pete McCoy, Beb Farrell, Jimmy Gallagher, well known sparrers; Jim and Mike Keenan, of Bos Bes Bos eon ; Johnny Reche, Charlie Perkins, Wm. Emmett, Arthur Chambers, cham pion light weight ; Eugene Beebe, of Montgomery, Ala., and Fred Englehart. There were a large number of newspaper ftorrespendents, representing prominent papers of the North and West. A Big Crowd of Spectators. Crowds of people are assembling from overy direction, and the crowds from the city are pouring into the hotel grounds. Sullivan took a room at the hotel opposite Ryan's room, and within 200 feet of the ring, which was pitched in front of the Barnes hotel, under a grove of live oaks. The sheriff has found some business iu Biloxi. The balcony and trees were black with people, and indications are that any attempt te step the lilit will be pio pie ventcd. The Men la the King At 11:4.1 the ring was cleared and Sulli van cast his cap into the ring amid great applause. The enthusiasm was as great when at 11 :57 Ryan entered the ring and, winning the choice of eerner.s, selected the southwest corner, leaving Sullivan with the sun in his face. A dispute took place ever the choice of a referee which was finally adjusted by cheesing two referees, Alexander Brewster, of New Orleans, and Jack Hardy, of Yicksburg, who will act jointly. The Fight Hirst Meed for Sullivan. At 1 o'clock the men steed up for the first round, Ryan offering Sullivan a bet of one thousand dollars, which was premptl y accepted. The first round ended by Sul livan knocking Ryan down. First knock down aud first bleed claimed for Sullivan, and both honeis allowed. The second round was en.lc.l by Hy.ni throwing Snllivaa. Third round : Ryan was again knocked down by Sullivan. Fourth reuud ended by Ryan knocking Sullivau down. Fifth round : i'hc men clinched ami Sul livan threw Ryan. Sixth round : Ryau was fairly knocked down again. In the seventh round theie was some sharp Hunting, in which both men wcre severely punished and both went down to gether. The eighth round was ended by Sullivan knocking Paddy completely out of time. Sullivan the Victer. Iu the ninth aud last round Ryan came up groggy and Sullivan at once forced him into his corner, deliveiiug one heavy blew, but Ryan recovered aud drove Sulli van out, and just beyond the middle of the ring Sullivan get in a right-hander under the left ear and Ryau went down senseless.
