Our readers will remember the circumstance, as we made mention of it in our local ool awns. The thief's name accompanied the letter. Judge Fisher flied a written-opinion ad e rse to granting the license, but was overruled by his associates, Judges Kuhn and McCurdy. As this case has excited more than usu al interest, we give In hail the opinions filed In the case. OPINIONS OF ZIIDGES KUHN AND/CM:MDT. In the rititter of the Petition of Jacob Stock to keep an Inn or Public House of entertainment in the Borough of Get tysburg : We regret exceedingly to Miler with the Hon. Presiding Judge on the subject of granting a License to Jacob /Rock ; but alter carefully considering the subject in all its bearings, we see no reason why a license should be withheld from him and granted to others. The license law makai no distinction. One man opining hero with-the proper recommendation, has as good a right to expect a license as anoth er; and that Jacob Stock, coming here with more'than an ordinarily good recom mendation, is as much entitled to a license satiny other man that may apply ; that the poor and humble travelers are as much entitled to have a place proVided for their accommodation as the rich and , more re fined ; that the public morals are no more (if as much) endangered by the one as the other; and that the community will nev er be purged of the curse of intemperance by - singling out one man and opposing his license, while others are granted and per. I ranted to violate the law withdut being punished ; and that to be 'consistent, the whole must be included and every man made to stand on the same platform, and all be punished alike for every violation of the law. With these views we have con cluded to grant him a License. JOSEPH J. KUHN, R. McerURDY. In the matter of the application of Jacob Stock, of the Borough of Gettyabrg, for a license to keep an r Inn or Tavern in said borough :" As I cannot agree with the majority of the Court iu granting" the application of the petitioner, it Is respectful to them to give my reasons for my dissent. I think the location not a suitable one, nor the applicant a suitable person. The location is in one of the smaller streets of the Borough, in which there is not much business done, and consequently the lukee will be more frequented by persona for the purpose of ' drinking than by strangers and traveler*. The location Is further objectionable, ifs it is in the vicin ity of a Seminary for the education of young ladies. As regards the fitness of the applicant, I would mention that on the hearing of,a former petition presented by the appli cant, in Aprll last, to be licensed to keep an Inn or Tavern at the same place, evi dence was given which tended to prove that several years ago he was a man of In temperate habits - , but bad reformed. In thy opinion, the greatest evil that could be inflicted upon him would be to grant him a license to sell intoxicating drinks, and thus place him in a situation, the natural result of which would moat likely be a relapse into his former babits of in temperance.
