' Judo Taney stated a historical fact. It was not a declaration of his own opinion. Died Scott, a slave, had been carried into a teuitoi y, and being m free soil, it was claimed that lie was free. A ca.se was piepared for !ii:n, to test the dis puted question whether a slave -ow ner could.take a b'.ave into a teiritory and there liold him to in voluntary servitude. The catc was inaiu.- up to i-tto.-e a legal decision upon the then (154) hotly eon tested issue as to the riyht of the slave owner to his projx'ity, when he removed bis slave lo a free territory. The District Court ruled out Dred Scott on the ground that he was still a slave, in the territory, and that a slave was not "a citizen," but property, and did not possess the legal i ighis of citizens.
