The calamlty.that occurred a few weeks ago at the Ncwhall House in Milwaukee, resulting In the loss of nearly ono hundred lives, coupled with other disasters of n sim ilar nature, both in America and elsewhere, show that sonic practicable method of es cape should be furnished nt every building in which human beings work or live. In New York city every structuro of a certain height Is compelled by law to bo provided with efficient means of escape for inmates in case of lire. The practical benefit of this provision lias been proved over Mid over again, and even where no such law exists it would bo n wise procedure on the part of all to provide their houses or other build ings with such appliances. Tho indictment was Intended to bo for the violation of the 22d section of the Act of June 3, 1878, digest 2, 128, which enacts as follows t " It shall not bo lawful for any person or persons to place any fish-baskets, gill-nets, pond-nets, ecl-welrs, kiddles, brush or fascine nets, or nny other permn nently set means of taking fish, in nny of tho wntcrj of tills Commonwealth j any person violating tlio provisions of this sec tlon shall be liable to a penalty of $25.00 for each offense." The verdict has found what the Indictment charges, that an out lino nnchorcd to tho bottom of the stream is a permanent set means of taking fish, but tho question still remains whetherlt Is such a means, or Is prohibited by tho stntutc. If tho Act had prohibited the placing of any permanently set menus of taking llsh with in the waters of tho Commonwealth, with out more, the question In each case of an alleged violation of the law would have been whether the device employed was of that character ; but hero the words " nny other permanently set means of taking fish " are preceded by several specifically mentioned methods of taking fish, which methods are declared to bo unlawful. It Is well established rule of construction, that If general words follow an enumeration of particular nets, they arc to be held to apply nly too cases of a llko kind with those numerated. Cites authorities. Many instances might be given of the application of this rule j a reference to two or three, however, will suffice for Illustration. Where n statute employed the words, 'wherry, lighter, or other craft," the word " craft " was held not to Include a steam-tug j because, although n steam-tug Is n " craft," yet it Is not the same charac ter as a wherry or lighter. In construing a statute which enacted that no "tradesman, nrtificcr, or other person whatsoever" should excrciso his ordinary calling on the Lord's day, it was held that the phrase other person " did not include a farmer, who was not a person of like denomination with those persons particularly mentioned. (Kingrs. Whilmarsh, 7 llrownwell and Crest veil, Eng. Com. Law Rep.) In another case, where n statute provided thnt " ll any per son haul or draw upon nny turnpike road any timber, stones, or other thing " other wise than upon carriages therein described, he should be subject to n penalty of forty shillings, It was held that the other thing, to come within the prohibition, must be ot the same nature with timber or stone cnl eulated to do the same mischief to the road, Cites authority. In King vs. Whilmarth, above cited, it was remarked by Jialer, Justice, that if all persons were meant, there was no need of n specific enumeration ; tlio same reason npplics with full force to this case if the Legislature intended to prohibit nil permanently set means, thcro was no occasion for their mentioning wears and nets. It Is manifest that the drafter of the Act had in his mind only weirs or oth cr devices of llkokind,forming(to a greater or less extent) obstruction to the passage of fish in tlio stream " wlngwalls" drawing th cir course to a basket, from which after entering there Is no escape, " nets" so con 6tmcted ns toentanglo tho fish iu their meshes when attempting to migrate from one point to another, and other " nets" so arranged in n stream as to take the fish by reason of their entering tho wldo mouth thereof, and going thenco into smaller sec. tions or apartments from which they can. not escape nnd thnt having mentioned these, from fear thnt his enumeration did not embrace all the devices of this kind, ho added the words " nnd nil other permanently set means." An "outline" Is no doubt a term well understood among fishermen ns a pcruuv nently set means of taking llsh, but it is not set forth in the indictment that an out line is either n wclr, n basket, a net, n Kiddle, or a device of tho snmc kind or character with any of these. The verdict finds that an outline is n per. manently set means of taking fish, but that is not sufficient to bring it under tho ban of the Act. It ought to appear In the in- dictmeut ( by some sort of description oth cr than the name ) that It belongs to the Same class with tho devices prohibited specifically j without such description tlio charge Is Incomplete. If tho outline had been moro particularly described, nnd al leged to be such a device as those prohibit. cd In tho statute, I am now of opinion ( contrary to my first Impression ) that the prohibition does not extend to nn instru ment or device of this sort said to bo a cord or line having fastened to it short lines, with baited fishhooks at the ends of these Hues, n yard or more apart, and float ing down stream ; the cord, which Is placed in the water, being fastened at the ends, Bnd the fish caught ir. tlio mouth by tho hook when attempting to get tlio bait.
