Joba Real, convicted of tjio murder of Officer John Smcuick, now await tlio day of his execu tlon in the Tombs of New York. Me and afiti nd named Michael Moore went into Mr. Cook's saloon to have a glass of laser, when omebody went out and lold h'.ra (Sme.iick) I had a revolver, lie (Smedick) ran in and took hold of me. and said he would take mo anyhow. 1 said, "Let go of me," at the same time putting my hand lu my side-pocket. Ho ran out and lapped for help, and I went out oi the b.ick Way. The next morning, July 4, I gave niysolf up in the station house I had Mr. Daly with rue to go ball lor me. The sergeant sent for fcmedlek, and wben he camo in the station Itout-e Le went to hitnie, nud only for tho ser goant would have done so. When Smedick took nie up to the CJtirt he swore that I put the i istol to his head and tired a shot at him. This is a falsehood, as Mr. Cools, Michael Moore, Thomas Kiley, Mrs. Shields, aud others, can testify, for 1 did not point a pistol at him nor lire at him. He kept alter mo f rom that time until ho was shot. One night, in June, 1808, be came olf his post at the foot of Thirty first street, to the bnige where IVas watching, and said that twenty persons had been to the Ptotiou houso and made complaints that they heard women screaming. He knew thai I was on the boat, and wanted to raise a muss with me. Captain Allaire or any sergeant kiows that there were no such com plaints made. Patrick Craig aud James Ward were there, and they know different, but Smedick wa after me and wanted to get me In trouble. The following Sunday I met Sme dick in Cook's saloon. I told him tho best thing he could do was to let me alone. He came out after me and hit me from behind, knocked zae down, and was going to kick mo, when Mr. McGill put his hand before hlui and told him not to beat me, but arrest me if I had done anything wrong. Smedick said to Mr. McGill, "What is the matter with you?" and arretted him. A lew days after I got out a civil warrant for Smedick for beating me. When he got notice to appear In court he came to orreet mo for escaiiin-r, from him on the Suuday he hit me. He had seen mo every day alter until I got the warrant for him. A friend of niino told me to look out for my-elf, for Bmedick. was after me. I paid to my friend, "Let us have a drink; I don't think he will trouble me," When we were going to have a drink I saw Bmedick coming up First avenue. I turned up Thirty first (street, and he came after me with a revolver In his hand. I ran through the entry of a house and Into Thlrty feecond street, and got clear of him. That night he lound me stupid drunk In the entry and beat and clubbed mo and took me to the station hfcuse. I was so stupid 1 did not know that I was beaten, or that I had boon arrested till- the next morLlng, when I was told by a policeman that I was in the station bouse that night I don't want to mention the policeman's name, but he said that Bmedick told Sergeant Bead not to dress my wounds but to It the -die; it serves him right." The next morning Suaedick took me to court and ewore that I was lying behind a pllo of lumber with a loaded revolver to shoot him; and that with a well-directed blow he knocked me down and took the pistol from me; he wanted to show his bravery; after the judge committed me, and Sroedlcic went to take me down, he stood at the head of the stairs and hit me on the back of the neck, and tried to break my neck: I caught the banisters, as I wa9 fall tng, and said. "Don't kill me;" he felled me down and kicked me between the shoulders; I called the keeper. Docksey, and said, ' Don't let him kill me;" this the keeper. Docksey, can testify to; I was covered with blood from, the top of my head to the sole of my foot, and weak from the loss of blood. If Smedick bad not been a brute be would have had some pity for me. Officer Olmstead, John Dil lon, aud James MeDonouch were there the night Smedick clubbed me in the entry. Bmedick thought no more of taking a false oath than a person did a spit out of their month. I was ordered on $3000 bail, aud tho first after noon I was talking to a Iriend, on the corner of Thirty-fourth street, when Smedick ran up with bis drawn club, and said: "Get off this corner, or I will club your brain i out." I was told by different parties to look out for myself or Bmodick would kill me. I would have had all the evidence brought up on my trial butlthe court ruled it out. The night Smedick was shot I was coming from the barge to get something to fat. I was tisht at the time. 1 met Smedick. and be went to club me and I shot him, lor I knew that the next time he clubbed me he meant to finish me. He could then swear that I tried to take his life, and that would be the last of it. lie told several that if he killed me he would be made roundsman for it. 1 always tried to keep out of his way, lor I knew what kind of a man he wa?. I wish It to be kno n that I did not follow him to "Jay for him," as the press represented it. The press have mis represented me by saying that I was the leader of gangs which I know nothing about. I never was the leader of any gang. I was always a peaceable citizen when let alone. I was never drove (drafted?) In the 10th Regiment, as the press eay. I volunteered In it, and got an honorable discharge, which Colonel Bendix cau certify to. OBITUARY. Hector Berlioz.
