8 TI1E "CHESAPEAKE" AFFAIR. The Eiamination of the Pirate Braine Before United States Commissioner Newton, at Brook lyn, N. Y.-A New Secret Bebel Organization, Etc. Etc. This case came tip according to appointment n Tuesday. W. D. Croft, counsel lor toe prisoner, mated further evidence, documentary and oral, was necessary in the deienso. Some of the proofs are In British America, and some la the Bouthern Stales. The principal fact adduced In bis dcicnse Is his actfui; in subordination to superior ollicers on Mard the ChesaiMate. lie (counsel) statu that pardon Is due to hira as much as to other belligerents. lit moreover, avcis that at the Instance of our Government some of his associates on the thesapeake a second lieutenant and some sea menwere arrested, and subjected to a thorough and Impartial examination, ann then discharged, their conduct not being deemed capitally repre hensible. The prisoner also claims that his case is covered by the amnesty proclamation of President Lincoln and the subsequent procla mation of President Johnson. District Attorney Siillraan answered in an inpreulous areumeat, the gift of which was the following: Thut he was unwilling to deny any aian prosecuted for a criminal action an oppor tunity to procure all necessary evidence in his delense, but the ground on which the demand -was made lor an adjournment of the cate was Irrational, as the United States had not recog nized the so-called Confederate Government, and such a confederation could not be a cloak to any crime done under the same. Commissioner Newton said that he couM not rive an opinion In a case ot so much national Importance at this preliminary examination, but would eriint the customary adjournment Tin District Attorney said that he bad wit nesses present who were sealarinjr men, and whose presence was temporary, and he wished to take their evidence then. The opposite counsel not objecting, James Johnson, witness lor the prosecution, was called, nd tcstilied in effect that his calling was that fan engineer on a steam vessel; when serving In that capacity on board the Chesapeake, under Captain Willitts, she was captured by a party of men who came on board as passengers, ouo of whom was the prisoner; before her capture she was running between New York and Portland; during the encounter several of the crew and officers were inhumanly murdered, in which Jbutchery Brajne acted a conspicuous part; they compelled him to run the vessel until her recap ture; two men with loaded muskets stood by his side, as a precaution against bis doing the veosel any injury; the men who took the vessel numbered tifteen, lupludiug the pri soner; they were armed with revolvers; the Chesapeake's crew were not armed during the aflrnv, nor did he know of any on board who had' arm?. The party who captured her came on board Bt New York, ostensibly to take passage to Portland. Neither iirainc nor any of lis party hud a uniform on. Samuel II. Seaman, a New York merchant, testibed as to the ownership and object of the vessel. She was the sole property of H. 13. Cromwell, a resident of Brooklyn. Daniel Henderson, second mate of the Chesa peake when she wns captured, reiterated sub stantially the testimony of Jonnston. Captain Willitt substantiated the evidence of both in his examination. At the conclusion of the evidence District Attorney Siliunan said that he was unwilling to grant an adjournment of the case to procure further testimony, which mipht be found inad miBdible, but if the counsel wished further time to confer with his client, lie would cheerfully assent. Mr. Croft said he thought twenty days was as little as he could call lor, but as the opposite counsel had spread this testimony through the press of the country to the prejudice of his Client, ne tnount tnirty aas lime enouco. The further bearing of the case was postponed until October K We append the i'ollowiug Con stitution and By-Laws of the secret order to which the prisoner belongs, and which, mirabile dictu, is in existence to-day. Some ot his friends are at large, and attended tae hearing of bis case. Who knows what mischief may be im pending ? BY-LAWS OF TBI K. A , FOR THE BETrP.lt Iil'LE AND GUIDANCE OF THE OBDLR. ANOTHER CASE OF CHILD FLOGGING, A Little Girl Whipped to Death. The Kingston (C. W.) correspondent of the New York 'un, under date of the 15th, relates the following horrible story: Another case of fatal child flowering, if possible more revolting in shocking details than the recent Lindfley child murder in Medina, N. Y., occurred at Barnia, a few miles from this city, on Wednesday last, the victim in this instance being a little trirl tlve years of aire, named Kute Bibley, the llleeitlmate daughter of Schuyler Bibley and a Miss Kate Davis, and the alleeed provocation leading to the cruel act being the refusnl or the child to say its prayers. From the evidence elicited at the iuquest ou tho body of the child, it appears that on the tiiirht In ques tion the mother hud beaten the child with a raw hide lor nearly an hour, aud when rendered in sensible by puin aud Ions of blood, thrupt it into a chair, and went to bed. I'or a time the child was heard to moan as it in intense aeony, but scon became quiet, and nothing more was heard "until near mornincr, when a servant entering the room found the child dead, end immediately gave (he alarm. Upon lilting the chilJ from the floor, where it tad fallen, a most revolting sight was presented. The head, fuce, and shoulders were scarred aud discolored from the teirible blows of the raw kide, while tho body, from head to foot, pre sented a fchoekinely mangled and bloody ap jpearuuee. OJd tears, scarcijr Wealed, were also THE DAILY EVENING visible upon the body, testifying to former cruel flogelnirs. The medical evidence showe I that the injuries of the flogeing were alone sufficient to produce death, but that serious internal in juries, the result ol kicks or blows, had pre viously been received; and the entire absence of food for many hours had also something to do with the result The murderess, in being ex amined, confessed that a few days previous to the fatal act, the father of the child bad admin tered to It a most unmerciful beating for not saying its prayers, and ordered her to do the same whenever it refused. The jury returned a verdict, criminating both parents, whereupon they were both committed to prison to await trial for murder. FURNITURE, BEDDING, ETC.
