Secticn 1. The following districts
or areas heretcfore included in
Residence A d'stricts of said zoning
map, are hereby changed to and
| shall hereafter be Residence B dis-
triets, to wit:
(a) All the area the boundaries
of which are as follows: Beginning
at the northeast corner of Marietta
and Lumber Streets; thence north-
ward almg the easterly side of
Lumber Street, 543 feet to a point
15¢ feet south of David Street, be-
irs the southerly boundary of pres-
ent Resident B district fronting on
David Street; thence eastward a-
long said boundary 150 feet;
thence southward along the
western boundary of present Resi-
dence B district fronting on New
Haven Street, 523 feet to the
northwest side of Marietta Street;
thence southwestward along the
northwest side of Marietta Street
to Lumber Street. It is the intent

hereby that this description shall
include 2!l lands which are not
now residence B district, in the
area bounded by David, New Hav-
en, and Lumber Streets,
so that hereafter all lands bound-
ed by said Streets shall be Resi-
dence B district.
(b) All the area, the boundaries

southward along the westerly side
of New Haven Street 190 feet, more
or less, to Oak Alley; thence west-

WHEREAS, the interests and
welfare of the Borough of Mount
Joy make desirable and necessary

nrerated by the Borough; and the
Council is of the opinion
that said improvements and exfen-
gions can best be accomplished by
and through the agency of Mount
Jov Borcugh Authority, a Munici-
ral Authority, incorporated by this
Borough under the Municipality
Authorities Act of 1945; therefore:
Tae Boroush Council of the
Borough of Mcunt Joy, Lancaster
County, Pa., hereby ordains as
follows:
SECTION 1. The Burgess, the
President of Council and the Bo-
rough Secretary are hereby au-
thorized in the name and on behalf
of the Borough of Mount Joy, to
enter into an agreement (subject to
all the terms and conditions con-
tained in said Municipality Author-
ities Act of 1945) with Mt. Joy Bor-
cugh Autherity, whereby the Bor-
ough shall agree to transfer and
convey to said Authority, the Bor-
ough water system, and all assets
real and personal of the Borough
pertaining thereto, including cash
in the Borough Water account
over and above reserve for
bond interest due January 1,
1951; the Authority agreeing
to pay to the Borough periodically,
amounts sufficient to pay interest
due Julv 1, 1951 on $30,000.00 wa-
ter bonds, and to pay principal and
interest on $15,000.00 water bonds
which will mature July 1, 1961; al-
so to pay or credit to the Borough
frcm time to time amounts equal
to all amounts charged kv the Au-
thority against the Borough for any
water supplied bv the Authority to
the Bcrough including water sup-
plied at fire hydrants; also to oper=
ate said water system and, to the
extent that it is able to do so, 10
make imprcvements to and exten-
cions thereof from time to time.
SECTION 2. The said Borough
officers are authorized in the name
~f “ne Boroush to execute, acknow-
ledee and deliver deed conveying
to the said Authority, the real estate
on which are located the Borough
Water Works, the Borough Reser-
voir, and the Borough stand pipe,
together with all rights of way,
privileges, easements and franchises
of the Borcugh pertaining to said
wa’er system: also to execute and
deliver to said Authority. such bills
of sdle, transfers and other docu-
ments as in the opinion of counsel
for the Authority and the Bcrough
solicitor, shall be necessary or
rroper to vest in said Authority
full title to »ll assets real and per-
scnal, records and customers’ ac-
counts, belonging to or pertaining
to said water system, subject al-
ways to reconvevance provisions
as provided in said Municipality
Authcrities Act: also to deliver to

have authority to occupy and use
the streete and highways of the

respect to the opening and obstruc-
